Spam messages can lead to legal action when the sender violates a law—not simply because the recipient did not want them. In the United States, commercial email is principally covered by CAN-SPAM, while certain texts and calls may fall under the Telephone Consumer Protection Act (TCPA) and Federal Communications Commission (FCC) rules. The channel, message purpose, sending technology, consent, and jurisdiction all matter.
What makes a spam message legally actionable?
“Spam” is a colloquial label, not one legal category. An unwanted message may be lawful, while a deceptive offer, an email with misleading sender information, or a text sent in violation of applicable consent rules may create legal exposure. The analysis changes depending on whether the message was commercial email, a text to a wireless number, or another kind of communication.
This is a U.S. federal overview. State laws can impose additional protections, and the rules in other countries differ. A recipient’s facts and location can affect whether a private claim is available.

The CAN-SPAM Act applies to commercial email whose primary purpose is advertising or promoting a commercial product or service, including commercial website content. It is not limited to bulk blasts: a single commercial email or a business-to-business message is not automatically exempt. The Federal Trade Commission (FTC) identifies duties that include:
#1 Best Overall
- COMPATIBILITY: For traditional analog landline phones and services from providers such as AT&T, Verizon, Frontier Communications, CenturyLink, and Brightspeed. Not compatible with internet-based or digital phone services (VoIP), including Vonage, Ooma, Xfinity Voice, and Quantum Fiber.
- IMPORTANT: The V5000 CPR Call Blocker requires Caller ID service and an analog telephone line. Without Caller ID, incoming numbers cannot be identified or blocked. No mains power required - just plug it into your phone line and use.
- Powerful Blocking, Made Simple: Preloaded with 5,000 verified scam and nuisance numbers, the V5000 starts protecting you right out of the box. And if a new or spoofed number gets through, the large “BLOCK NOW” button makes it easy to instantly block it - up to 1,500 additional numbers at your command.
- Realistic & Reliable Protection: While no device can stop 100% of spam (scammers constantly change numbers), the V5000 gives you the power to shut down repeat offenders quickly and effectively - offering more control than passive filters alone.
- Hassle-Free Design: NO POWER supply needed, NO APP, and NO SUBSCRIPTIONS. The V5000 is easy to install, with a clear screen and loud button click for extra confidence. Designed with seniors in mind, it’s ready to use and simple to maintain. For even stronger protection, you can pair it with your phone provider’s spam filtering service.
- Using accurate routing and header information, rather than false or misleading sender details.
- Avoiding deceptive subject lines.
- Identifying the message as an advertisement where required and including a valid physical postal address.
- Providing a clear way to opt out and honoring opt-out requests.
A company cannot avoid its responsibility merely by hiring a marketing vendor. The FTC says both the company promoting its product and the company that originated the email may be responsible. See the FTC’s CAN-SPAM compliance guide and CAN-SPAM Act guidance.
The FTC guide, edited in January 2024, states that each separate violating email can carry a civil penalty of up to $53,088. That is an inflation-adjusted maximum stated in that guidance, not a typical award or an amount automatically owed to each recipient; check current FTC guidance for later adjustments.

- SIMPLE TO USE – NO APP OR SUBSCRIPTION – Connect the V100K to your compatible landline and start taking control of unwanted calls. No app, Wi-Fi, monthly subscription or external power supply required. The large display and tactile BLOCK NOW button make it particularly easy to use.

Who can bring a CAN-SPAM case?
The FTC is the primary enforcer. The statute also permits certain private entities, including internet access service providers, to bring actions. An ordinary recipient should not assume they can sue for damages just because they received spam email. The FTC explains the distinction in its business compliance guidance and staff Q&A on CAN-SPAM and text messages.

When unwanted texts may violate the TCPA
The TCPA restricts certain calls made using an automatic telephone dialing system or an artificial or prerecorded voice, subject to exceptions. The FCC has interpreted the TCPA’s protections to include text messages sent to wireless numbers. For certain telemarketing texts to wireless numbers using an autodialer or prerecorded voice, FCC materials describe a prior express written consent requirement.

Whether a particular text falls within a covered restriction can depend on the number contacted, the technology and message, the consent obtained or withdrawn, applicable exceptions, and current statutes and court decisions. The Supreme Court’s interpretation of “automatic telephone dialing system,” along with later rules and decisions, can affect the analysis. A bulk or automated text is not automatically unlawful just because it was sent at scale. Review the FCC’s telemarketing and robocalls guidance and the text of 47 U.S.C. § 227.
Phone-to-phone SMS and internet-to-phone texts
CAN-SPAM is not a general law for ordinary texts sent from one phone to another. FTC staff explains that ordinary phone-to-phone SMS is generally outside CAN-SPAM, but marketers still need to consider FTC Act restrictions on deceptive or unfair conduct and FCC rules under the TCPA. Certain internet-to-phone text messages can fall within FCC rules. The FCC has said that some apps that send texts to all or substantially all text-capable U.S. numbers require consumer consent; it has described internet-to-phone texts as functionally equivalent to phone-to-phone texts from the recipient’s perspective. That agency interpretation does not mean every delivery method is identical for every element of liability. See the FTC’s staff Q&A and the FCC’s 2015 order.

Consent revocation and opt-outs
FCC rules and orders address how consent may be revoked and how opt-out requests must be handled. Preserve what you received and how you responded: the original message, any consent or account record, and the time and method of an opt-out request. “Reply STOP” is not a universal legal rule for every sender and message type; the relevant obligations depend on the program and communication.
When can an individual sue over spam texts?
A private TCPA claim may be possible if the texts meet the statute’s requirements. The law provides a private action for a person or entity that receives more than one telephone call within a 12-month period in violation of the relevant subsection, and it permits a claim for actual monetary loss or statutory damages. For a qualifying violation, the statutory amount is $500 per violation or actual monetary loss, whichever is greater; a court may increase statutory damages up to three times for a knowing or willful violation.

Those amounts apply only if the plaintiff establishes a covered violation and meets procedural and other legal requirements. The statute, controlling court decisions, and the recipient’s state can affect the result. The statutory text is available at 47 U.S.C. § 227; it does not establish that every unwanted text qualifies for compensation.
How deceptive messages can bring separate enforcement
A campaign may draw scrutiny for conduct beyond sending unsolicited messages. In 2014, the FTC reported a case involving allegations of deceptive “free” offers, collection and sale of personal information, unwanted charges, and illegal robocalls connected to text messages. The settlement totaled approximately $10 million. In a separate 2013 case, the FTC alleged an internet marketer sent more than 20 million unwanted text messages and reported a $60,950 monetary judgment, suspended because of inability to pay. These were case-specific enforcement outcomes, not a per-message formula or a prediction of what another sender will owe. See the FTC’s 2014 enforcement announcement and 2013 case announcement.
Government complaints and private lawsuits are different
The FTC and FCC can investigate or pursue enforcement independently of an individual recipient’s case. The FCC accepts complaints about unwanted calls and texts, but says its consumer complaint process does not resolve each person’s dispute or award compensation. Complaints can inform its policy work and potential enforcement. You can submit a report through the FCC Consumer Complaint Center.

What to do if you receive spam texts or email
- Keep evidence. Save the original message, sender details, date and time, and related account or consent records. Keep evidence of any opt-out request and response.
- Use an appropriate opt-out route. For commercial email, use the message’s opt-out mechanism when appropriate. For texts, consider the sender’s instructions in light of the message and applicable rules; do not assume one keyword governs every situation.
- Contact your carrier or report the message. The FCC accepts reports through its consumer complaint process, though it does not resolve each individual dispute.
- Consider legal advice for persistent or deceptive conduct. A lawyer can assess the technology, consent, recipient number, state law, and procedural requirements that a federal overview cannot settle.
