In the United States, owning a PS2 or original Xbox disc does not by itself settle whether making an emulator image is lawful. Copyright and anti-circumvention rules raise separate questions, and the current federal video-game exemptions are limited to specific circumstances—not a general personal-backup permission. The technical steps also differ: PCSX2 documents disc dumping for PS2 games, while xemu uses Xbox-specific routes to create XISO images.
Does owning the game make a backup legal?
Not automatically. The U.S. Copyright Office describes Section 1201 of the Copyright Act as addressing circumvention of technological measures that control access to copyrighted works. The statute states: “No person shall circumvent a technological measure that effectively controls access to a work protected under this title.” A personal-use purpose or possession of the original disc does not, by itself, answer whether a particular act circumvents an access control or whether an exemption applies.
Copyright and anti-circumvention are distinct issues. Whether a particular copy infringes copyright and whether a method circumvents an access control are not interchangeable questions. A legal assessment can depend on the title, the protection involved, the exact copying or modification performed, its purpose, and the applicable jurisdiction.

The current text of 37 CFR 201.40(b)(19) describes defined video-game situations. Its conditions are narrower than a general right for an individual to copy any game they own.

- Games requiring discontinued external-server authentication: One category concerns lawfully acquired complete games where the copyright owner or its representative has ceased providing an external server needed for authentication. The rule permits specified copying or modification for personal local gameplay. The regulation defines terms such as “ceased to provide access” and “local gameplay”; the category should not be read without those definitions and conditions.
- Preservation involving those games: A related route applies to eligible libraries, archives, or museums and has additional requirements.
- Some server-independent games no longer commercially available: A separate category concerns certain complete games that do not require an external server and are no longer reasonably available in the commercial marketplace. It is a preservation route for eligible libraries, archives, or museums, not a general personal-use exemption.
The Copyright Office says the tenth Section 1201 triennial rulemaking is underway, with existing exemptions being considered for renewal for October 2027–October 2030. These exemptions are temporary and cycle-specific, so check the current regulation before relying on one. The described categories do not establish a blanket exemption for making personal PS2 or original Xbox disc images.
How do the PS2 and original Xbox backup paths differ?
| Console | Emulator documentation’s image requirement or workflow | Hardware or source-console considerations |
|---|---|---|
| PlayStation 2 | PCSX2 documents dumping PS2 CDs and DVDs using an optical drive that supports those media. | A standard optical drive is the documented route; an external USB optical drive is an option if the computer has no built-in drive. PCSX2 also requires a BIOS dumped from the user’s own PS2. |
| Original Xbox | xemu requires game images in XISO format and describes Xbox-specific backup routes. | The documented routes use a real Xbox with a custom dashboard to transfer files over FTP, or a specially reflashed DVD drive. An ordinary USB DVD drive is not established by xemu’s documentation as a solution. |
These are technical descriptions from the emulator projects, not legal conclusions. Being able to create an image in a supported format does not establish that every step used to create it is legally permitted.

What does PCSX2 require for PS2 games?
Dumping a PS2 disc
PCSX2’s documentation says PS2 discs are unencrypted CDs or DVDs and describes Windows, macOS, and Linux workflows using an optical drive that supports the relevant disc type. If your computer lacks a built-in drive, the documentation identifies an external USB optical drive as an option; check that a specific model supports the media you need. The documentation also warns that an imperfect dump can cause game problems and describes a verification process to help identify a successful dump.
Supplying the PS2 BIOS
The game image is not the only file PCSX2 needs. Its BIOS documentation says the BIOS is proprietary software, required to run games in the emulator, and must be dumped from the user’s own PS2. The disc-dumping instructions do not supply or replace this separate requirement.

What does xemu require for original Xbox games?
xemu requires game discs in XISO format. Its documentation describes backing up a legally purchased game by transferring files over FTP from a real Xbox running a custom dashboard, or by using a specially reflashed DVD drive. These are distinct from the ordinary optical-drive workflow PCSX2 documents for PS2 discs.
A full Redump-style image contains two partitions and, according to xemu’s documentation, is not directly compatible with xemu. The second partition must be extracted or repacked for use. xemu’s project also says it does not endorse piracy, disallows sharing games through its channels, and expects game files to come from a real physical copy. Those statements describe the project’s position; they are not a legal ruling.

What should you check before making or using an image?
- Identify the jurisdiction. The legal framework above is a U.S. federal baseline. It does not determine the law in other countries or resolve every state or fact-specific issue.
- Separate the acts involved. Consider the copying, any modification, and any circumvention of an access control as distinct parts of the process rather than assuming ownership answers all of them.
- Check whether a specific exemption actually fits. Read the current text of 37 CFR 201.40(b)(19), including its definitions and conditions. The exemptions described above are not a general individual backup permission.
- Use the correct project documentation for the console. PCSX2 documents PS2 CD/DVD dumping and a separately sourced BIOS; xemu documents Xbox-specific routes and XISO images. Do not assume that a drive or workflow documented for one console applies to the other.
- Get jurisdiction-specific legal advice when the consequences matter. The federal sources do not decide the legal status of every title, protection, or method.
What the documentation does—and does not—establish
The U.S. Copyright Office’s Section 1201 FAQ and Chapter 12 explain the federal anti-circumvention framework and its limited exemption process; 37 CFR 201.40 supplies the exemption text. PCSX2 and xemu document technical requirements for their respective emulators. None of those project instructions is a legal opinion that every individual backup method is allowed. The available federal sources also do not support either categorical claim that every personal console image is unlawful or that owning the disc makes bypassing any access control lawful.
