A woman identified in court filings as Jane Doe alleges that seven members of Cornell University’s Chi Phi fraternity drugged and sexually assaulted her in October 2024. Cornell conducted a separate student-conduct investigation and imposed discipline, while the criminal investigation has been reopened: on October 2, 2026, New York Governor Kathy Hochul appointed Attorney General Letitia James as special prosecutor. No criminal charges or final outcome of the state investigation had been announced as of October 3, 2026. The allegations remain contested, and criminal guilt has not been established.
What does the lawsuit allege?
In a civil lawsuit filed in September 2026, Jane Doe alleges that she was given ketamine and repeatedly sexually assaulted at the Chi Phi fraternity house at Cornell in October 2024. The suit names Cornell and seven former students, among others. These are allegations in a civil complaint, not findings of criminal guilt. Several of the men accused have denied nonconsensual sex or said they did not touch her, according to Associated Press reporting.
The public record is incomplete and accounts of the events are disputed. The lawsuit does not itself establish what happened, and Cornell’s disciplinary process was not a criminal trial.
What did Cornell investigate, and what did it decide?
Cornell’s student-conduct and Title IX process considered whether university policies had been violated and what discipline was appropriate. It was separate from the prosecutor’s decision about whether criminal charges could be supported.

Associated Press reporting on Cornell’s records says the university investigation included 50 interviews with 32 witnesses and 12 days of hearings. A 99-page hearing-panel report was among the records filed in court. AP reported that some students were expelled or suspended. Cornell has not disclosed individual sanctions, citing student privacy, and said the Xi chapter of Chi Phi remained barred from campus.
At a May 2025 university hearing, Doe described her condition to investigators this way, as quoted by AP: “You look like an operating human being. You don’t look dead or asleep necessarily. So, lights are on, but nobody’s home. Your brain is not functioning at its proper level.” This is her account to the university, not an independent medical finding.

AP also quoted Doe describing how she felt: “I felt like bait. I felt like lions around me. It just was a totally debilitating place to be in.” That statement appeared in the university disciplinary record; it is not a criminal adjudication.

The dispute centers in part on the information available to Tompkins County District Attorney Matthew Van Houten when he initially declined to prosecute or pursue more investigation. Van Houten said his office relied on a summary prepared from two days of Cornell campus-police interviews and did not receive the complete interview transcript. He said the summary did not include statements that Doe was certain she had been raped, had been drugged against her will, or had been forced into sex acts.

In an October 3, 2026 fact check, AP reported on a transcript obtained by CBS News. AP said the transcript shows Doe describing coercion and incapacitation and saying she was “100% confident” she had been raped. The distinction matters: the public accounts describe a detailed interview transcript and a shorter summary Van Houten says his office received. AP’s reporting does not establish that the DA had the transcript when he made his initial decision.
After the September 2026 lawsuit disclosed allegations he said he had not previously seen, Van Houten spoke with Doe and her attorney and reopened the county investigation in late September. AP quoted him saying, “Seeking justice sometimes requires us to reconsider or reopen cases when we are provided with additional evidence.”

Who is leading the investigation now?
On October 2, 2026, Governor Kathy Hochul appointed New York Attorney General Letitia James as special prosecutor to lead the renewed criminal investigation. AP reported that James described the work as a months-long process with no predetermined outcome. As of October 3, no charging decision or result had been announced.
The change in prosecutor does not mean charges have been filed or that the allegations have been proven. It means the renewed criminal investigation is being led by the state special prosecutor rather than the county district attorney.

These processes answer different questions. A university disciplinary decision is not a criminal conviction, and the existence or outcome of one process does not automatically decide another.
What is the timeline?
- October 2024: The alleged incident took place at the Chi Phi house, according to the civil lawsuit.
- November 2024: About three weeks later, Doe reported the matter to Cornell campus police and gave an account over two days, according to AP.
- 2024–2025: Cornell conducted its student-conduct process, which included interviews and hearings.
- May 2025: Doe described her condition to Cornell investigators during a university hearing, as quoted in AP’s account of the disciplinary record.
- September 2026: Doe filed the civil lawsuit against Cornell and seven former students, among others. The filing brought renewed attention to the case.
- Late September 2026: Van Houten reopened the county criminal investigation after speaking with Doe and her attorney and reviewing allegations in the lawsuit.
- October 2, 2026: Hochul appointed James as special prosecutor.
- October 3, 2026: AP published an explainer and fact check on the case and the discrepancy between the interview transcript and the summary Van Houten said his office received. The state investigation remained pending.
What does Cornell’s broader campus survey say?
Cornell’s Presidential Task Force on Campus Sexual Assault reported findings from the university’s 2025 SARM survey. The undergraduate response rate was 13%, compared with 34% in 2023. The task force cautioned that the low response rate limits estimates and interpretation, so these figures should be read as reports from survey respondents—not precise estimates for the whole undergraduate population or evidence about this individual case.
- Among 2025 survey respondents, 35% of undergraduate women and 8% of undergraduate men reported experiencing sexual assault during their time at Cornell.
- Among reported locations in the 2025 survey responses, residence halls accounted for 29%, off-campus residences 23%, and fraternity chapter houses 17%.
The figures provide broader campus context but do not establish what happened to Doe or resolve the allegations in her lawsuit.

- What evidence the state special prosecutor will ultimately assess and whether it will become public.
- The complete details of Cornell’s disciplinary findings and the individual sanctions, which Cornell has not disclosed.
- A definitive criminal determination about the allegations. The public record includes contested pleadings and only part of the university investigative record, with some material redacted.
