California’s AB 2244 creates a voluntary “Non-Ultraprocessed Certified” seal for qualifying foods and beverages sold at retail. It does not ban ultraprocessed foods in grocery stores or require every product to carry a warning. The state’s Department of Public Health (CDPH) must accredit certification agents by June 1, 2029; the law does not establish that the seal or a public list of certified products is available yet.
What AB 2244 does
Signed and filed on September 28, 2026, AB 2244 (Chapter 721) establishes a state certification standard for finished foods and beverages intended for sale in retail food facilities. Manufacturers may seek certification; the seal is not mandatory. The governor’s office described the program as a voluntary standard for manufacturers and a way for consumers to identify qualifying products. The governor’s announcement identifies the bill’s author, Assemblymember Jesse Gabriel, who said, “Parents shouldn’t need a Ph.D. in chemistry to understand what they’re feeding their kids.”
The law’s stated aim is to give consumers accessible information for making nutrition choices. In practice, it creates an optional certification mark—not a universal “ultra-processed” warning label, a ban, or a requirement that retailers remove non-certified products. The chaptered statute sets the certification and display rules.

Only a product certified by an agent accredited by CDPH may display the state’s standardized seal. The seal may include the wording “Non-Ultraprocessed Certified Food Standard” or “Non-UPF Certified.” A product cannot be certified if it meets the statute’s additive criteria for an ultraprocessed food, is classified as an “Ultraprocessed Food of Concern,” or is classified as a “Restricted School Food.”

Certification applies to a specific product, not automatically to every item made by the same brand. Certification must be renewed at least once every three years. If the product is reformulated, it must be recertified before it continues using the seal.
Where the seal may appear and how to verify a product
The seal can appear on a package’s principal display panel, information panel, or another location, provided it does not obscure required label information. The law also requires certification agents to report product details to CDPH, including the product name, ingredients, nutrition facts, manufacturer and brand, GTIN and UPC, and certification date. CDPH must maintain a public webpage listing currently certified foods as reported by agents.

- Look for the state seal. General claims such as “healthy” or “natural,” or a manufacturer-designed front-of-package mark, are not the same as this certification.
- Check CDPH’s certified-food webpage when it is available. The statute requires a public list, but the official materials do not establish that the list is live now. Confirm a product against that list rather than relying on a package claim alone.
When the label and store displays may appear

These are statutory milestones, not confirmation that applications, certifications, or the public product list are already operating. The official materials do not establish that CDPH has opened agent applications or issued final implementation requirements. Check CDPH’s Real Food, Healthy Kids page for updates; its current status should be verified before assuming the program has launched.

When grocery stores must make certified products identifiable
Once CDPH creates the seal, a covered grocery store must make at least three certified products clearly identifiable if it offers more than 25 certified items. The store must also have gross annual sales above $10 million. The statute allows identification through physical separation, signage, or other visual cues. Both thresholds apply, and the law excludes certain convenience and fuel-oriented stores from its definition of a grocery store.

How this differs from California’s school-food law
AB 2244 concerns voluntary retail certification and a product list. It is separate from AB 1264, signed in 2025, which addresses school foods and set a timeline for phasing out ultraprocessed foods from schools. CDPH has implementation responsibilities related to defining “Ultraprocessed Foods of Concern” and “Restricted School Foods.” Those school-food categories also matter to AB 2244 because products classified in either category cannot qualify for its retail seal; that connection does not make AB 2244 the school-meal phaseout law.
