If your Canadian home insurer denies a storm-damage claim, first protect people and property, document the damage, and get the insurer’s reasons in writing. Then compare those reasons with the exact policy wording, make a focused written complaint through the insurer’s escalation process, and—if the dispute remains unresolved—check whether the General Insurance OmbudService (GIO) or your provincial or territorial regulator is the right next step. A storm-related loss is not automatically covered or excluded: the cause, policy wording, endorsements, evidence, and applicable rules matter.

What to do first after a denial

  1. Make the site safe and limit additional damage. Do not enter an unsafe building, climb onto a damaged roof, or attempt hazardous electrical work. When it is safe, take reasonable steps to protect the property—for example, arranging for a qualified professional to cover a damaged roof or board a broken window. Keep receipts and before-and-after photos. The Insurance Bureau of Canada (IBC) advises policyholders to protect property from further damage when safe and to use a qualified professional if temporary work is unsafe (IBC severe-weather guidance).
  2. Record the loss. Photograph or video the damage, water paths, affected belongings, and any temporary work. Write down when the storm occurred, when you discovered the damage, and what happened afterward. Keep damaged items unless they pose a safety or health risk. Save cleanup, repair, accommodation, and replacement receipts, plus written contractor or engineer findings and itemized estimates.
  3. Preserve the insurer’s decision and policy. Keep the denial letter, claim number, the policy that applied on the date of loss, and all endorsements. Record calls, including dates, names, and what was said. If anything was explained only by phone, ask for it in writing.
  4. Ask about urgent handling while you investigate. Contact the insurer in writing to ask whether it wants to inspect before repairs, what temporary work it authorizes, whether reasonable emergency-mitigation costs may be considered, and whether Additional Living Expenses (ALE) apply if the home cannot be occupied. These questions do not guarantee payment; retain receipts and keep the insurer updated.

IBC recommends keeping a list of damaged items, photographs, notes, and receipts. Organize the material in one folder so it is easy to refer to in the complaint.

Find out exactly why the claim was denied

Ask the adjuster or claims manager to identify the specific policy clause, exclusion, condition, or factual finding behind the decision. Request the evidence the insurer relied on, including relevant inspection findings or estimates, and ask what additional information it will consider. If the explanation is incomplete, ask for a supervisor or claims manager. IBC also recommends asking the representative or adjuster to explain the decision and escalating when needed.

Then compare the explanation with the policy wording in force on the loss date, including endorsements. A storm claim may turn on questions such as:

  • What caused the damage, and what evidence establishes the cause and timing?
  • Does the insurer say the event or type of damage is outside the insured perils, excluded, or subject to a limit?
  • Is the insurer relying on wear and tear, maintenance, vacancy, late notice, or another policy condition?
  • Does the dispute concern coverage, the amount of damage, or both?
  • Has the insurer accepted some damage while denying other items or parts of the repair?

For water damage, be precise about how the water entered or accumulated. Rain entering through an opening created by storm damage, overland flooding, sewer backup, and gradual seepage are not interchangeable descriptions; their treatment depends on the contract and the established cause. The Financial Consumer Agency of Canada (FCAC) says home insurance may cover unexpected events such as windstorm, while flood damage is usually not covered unless additional coverage was purchased. Policy wording and endorsements decide the individual claim (FCAC home insurance guide).

If you have an independent contractor or engineer report that differs from the insurer’s findings, explain the disagreement point by point. Include the author’s qualifications and the evidence supporting the report. Ask the insurer to address the disputed findings rather than relying on a general disagreement.

Make a specific written complaint to the insurer

Use the insurer’s formal complaint process, which may involve a claims manager, supervisor, or internal ombuds office. FCAC advises consumers to gather the policy number, agent or broker details, key facts, desired resolution, and supporting documents before complaining. A concise complaint is easier to assess than an unorganized bundle of material.

  1. Write a short chronology. List the storm, discovery of damage, claim submission, inspections, and denial dates.
  2. State what you dispute. Identify the insurer’s conclusion and the policy provision or evidence you believe it has misunderstood or overlooked.
  3. Say what outcome you seek. For example, ask the insurer to reconsider coverage, assess specific damaged items, or explain an itemized valuation.
  4. Attach labeled evidence. Include relevant policy pages, photographs, reports, estimates, receipts, and correspondence. Keep a copy of everything sent.
  5. Ask for a final position letter. Request a written decision that explains the insurer’s final position and the applicable policy wording.

You can also ask the insurer to identify what evidence, if any, could change its view and to clarify how it is handling any undisputed damage or partial payment. Keep a log of every contact. FCAC explains the complaint process but does not resolve individual complaints (FCAC complaint guide).

Escalate outside the insurer if the complaint is unresolved

General Insurance OmbudService

GIO may be an option for an eligible home, auto, or business insurance complaint involving a subscriber insurer after the insurer’s complaint process is complete and you have received its final position letter. GIO describes its service as free and available in English and French across Canada; it makes non-binding recommendations. It cannot take every dispute: matters before a court, issues outside its mandate, and some disputes governed by legislated processes may not proceed. Check its current eligibility and scope before filing (GIO contact and FAQ; GIO mandate and scope).

Provincial or territorial regulator

You may also contact the insurance regulator for your province or territory. Its role and the remedies it can offer vary by jurisdiction; do not assume it can order the insurer to pay a particular claim. FCAC provides a regulator directory and says consumers can contact the relevant regulator separately. FCAC directs Quebec residents to the Autorité des marchés financiers (AMF) for the applicable complaint route. Check the current instructions for your location through the FCAC complaint guide.

Protect deadlines and settlement options

Do not assume one deadline applies to every stage of a claim. FCAC says policy claim-submission periods usually range from 90 days to 12 months and advises checking the policy. Proof-of-loss requirements, complaint routes, and legal limitation periods can be different and depend on the policy and jurisdiction. IBC’s severe-weather guidance also refers to a two-year period from the incident in its claim-reporting material; that should not be treated as a universal deadline for every policy obligation, lawsuit, or dispute process. Check the contract and applicable law promptly, and seek legal advice if a deadline may be near (FCAC making-a-claim guide; IBC severe-weather guidance).

For a high-value loss, a complicated dispute over cause, or a threatened deadline, consider speaking with a lawyer licensed in your province or territory. If the insurer accepts only part of the loss

Ask for an itemized decision showing what the insurer accepts, what it denies, and how it calculated the proposed settlement. Coverage and valuation are separate questions: even when damage is covered, the settlement can depend on the deductible and whether the policy settles on an actual-cash-value or replacement-value basis. FCAC describes actual cash value as subtracting depreciation, while replacement value pays the actual cost to replace an item after a covered loss, subject to the policy terms (FCAC home insurance guide).
