If your HOA or condo board has not answered a repair request, first determine who is responsible for the item, then send a documented written follow-up asking for a specific next step. There is no universal response deadline established for every association. The right escalation depends on your state, association type, recorded documents, the defect, and any applicable filing deadlines.
First, find out who is responsible for the repair
Before pressing the board to act—or arranging work yourself—check your declaration or CC&Rs, bylaws, maintenance schedule, property boundary descriptions, insurance provisions, and repair-request rules. In a condominium, determine whether the affected area or item is part of your unit, a common element, or a limited common element. The declaration may allocate responsibility differently from a general default rule.
For example, Utah community-association guidance says that the declaration and plat answer whether a failing item belongs to an owner or the association. Its condominium guidance describes how boundaries and the item’s function can affect responsibility: finished surfaces may be treated differently from material behind them, and pipes or ducts may be classified according to what they serve. A balcony or other limited common area may also have a specific allocation in the declaration. These are Utah examples, not rules to apply in another state. Utah community-association maintenance guidance and Utah condominium guidance.
Florida law provides another state-specific example: section 718.113(1) assigns maintenance of common elements to the association, except where the declaration assigns maintenance of limited common elements to unit owners. It also addresses maintenance, repair, and replacement of condominium property for which the association is responsible under the declaration. The cited statute page is the 2024 Florida Statutes edition; check current law before relying on it.

How long does a condo association have to respond?
There is no universal response deadline established by the sources cited here. A deadline may depend on your state or local law, your association’s governing documents, and the type of request or hazard. Do not assume a particular number of days applies unless you can verify it in a current law, local rule, or association document that covers your situation.
Send a clear, documented follow-up
A concise written follow-up makes the condition and your request easier to track. Use the association’s official contact channel, such as the management portal or designated email or mailing address, and retain your message and delivery evidence. This is a practical recordkeeping step; it is not a universally mandated legal notice method.

- Describe the defect. Include its location, when it began, and any worsening, disruption, or effect on neighboring property.
- Attach relevant evidence. Include dated photos, copies of earlier requests, and any replies. Keep your originals.
- Identify the apparent responsibility provision. If you have found a section of the declaration, maintenance chart, or rule that appears relevant, cite it without presenting an uncertain interpretation as settled fact.
- Ask for a concrete next step. Request acknowledgment, an inspection date, a repair schedule, or a written explanation if the association believes the work is not its responsibility.
- Keep a timeline. Record when you sent each message, how you sent it, and what response—if any—you received.
If there is still no reply, check the available escalation route
Follow any internal complaint, meeting, or hearing procedure in the association documents. Then check the responsible state or local agency, if one has jurisdiction, and verify whether your type of dispute is eligible for a complaint, mediation, arbitration, or court action. Some processes have prerequisites or deadlines, so confirm those before filing.

When comparing routes, establish whether the issue concerns an association maintenance duty, owner responsibility, insurance, or damage; whether the documents require internal notice or a hearing; whether an agency has jurisdiction; and whether mediation or arbitration must come before court. Consider urgency, available evidence, cost, and deadlines. A local attorney familiar with community-association law may be useful if the dispute involves safety, property damage, substantial expense, disputed responsibility, or a possible missed deadline. No particular result or recovery of legal fees is assured.
Handle urgent hazards differently
If the condition creates an immediate threat to life, health, safety, or property, contact the appropriate emergency services, utility provider, insurer, or qualified local professional as warranted. Document the condition and your contacts. Do not assume that the board’s silence gives you authority to alter common property or hire work on the association’s behalf; the sources cited here do not establish a universal emergency exception for owner repairs.

Avoid steps that can create a second dispute
- Do not withhold assessments because the association has not responded.
- Do not deduct repair costs from dues or assume the association must reimburse a contractor you hired.
- Do not authorize changes to common elements without confirming you have authority.
Before taking any of these steps, confirm the governing documents and applicable law with qualified local advice.
