A utility’s “no” is the start of a diligence process, not a complete answer. Get the constraint, available megawatts, upgrade requirements, schedule, cost allocation and remaining approvals in writing. Then test staged service, flexible load, onsite generation or storage, efficiency measures, and another site against the same reliability and timing requirements.
The practical objective is to determine exactly what can be energized, when, under which tariff and operating conditions, and at what risk. No single workaround creates grid capacity automatically; utility, grid-operator, state, engineering and reliability rules control the result.
First, turn the utility’s answer into a documented constraint
Ask for a written response that identifies the limiting element rather than accepting a general statement that the area has “no power.” The constraint could be distribution equipment, substation capacity, transmission capability, generation adequacy, a study queue, protection limits or another condition. The remedy and schedule depend on which one applies.
Questions to send in writing
- What service is available now? Request dependable megawatts (MW), voltage and service configuration, and any firm, non-firm or interruptible limitations.
- What can be served in phases? Ask for available capacity at each proposed operating phase, the earliest date for each increment and the conditions attached to energizing it.
- What upgrades are required? Request the affected feeders, substations, transmission facilities, generation resources, protection systems and communications equipment.
- Who pays? Ask for estimated customer-funded construction, utility contributions, deposits, studies, tariff charges, demand charges and any cost-reallocation rules.
- What process remains? Identify required load studies, interconnection or service agreements, environmental permits, siting approvals, equipment lead times and reliability reviews.
- Are alternative service arrangements available? Ask whether a smaller initial service, ramp schedule, demand-response arrangement or interruptible/non-firm product exists under the applicable tariff.
These are diligence questions, not assumptions that a utility must offer every option. The Federal Energy Regulatory Commission’s large-load docket specifically raises study timing, flexibility and curtailment, upgrade cost allocation and reliability when a power plant serves a colocated large customer. See the FERC RM26-4 docket overview.

Ask which jurisdiction and queue apply
Request the utility’s explanation of whether the project is handled through a distribution service process, a transmission process, an RTO/ISO procedure or a state-regulated tariff. FERC’s ANOPR materials generally discuss loads above 20 MW as “large loads,” but thresholds and procedures differ by utility, tariff and jurisdiction. A headline about regional generation supply does not prove that a particular parcel can receive service.
Build one load model before negotiating alternatives
Use the same forecast in every conversation with the utility, grid operator, engineers and investors. Changing assumptions between studies can produce conflicting upgrade requirements and undermine a request for phased service.
| Input | What to document | Why it matters |
|---|---|---|
| Existing demand | Measured peak and average MW, voltage, power factor and operating hours | Separates current service from the expansion request |
| Requested capacity | Peak MW by building, electrical block and commissioning phase | Lets the utility test partial energization |
| Ramp dates | Construction, commissioning and workload dates for each increment | Links equipment delivery and studies to a usable schedule |
| Critical load | Minimum dependable MW for essential IT, cooling, controls and life-safety systems | Defines what must remain powered during curtailment or outages |
| Deferrable load | Workloads that can shift, throttle or stop, with response time and duration | Creates a measurable flexibility offer |
| Resilience requirement | Redundancy level, outage ride-through and backup duration | Prevents a nominal MW solution from failing reliability requirements |
Have qualified electrical and controls engineers validate the model. State the minimum dependable capacity separately from nameplate capacity: a generator, battery or non-firm grid service may not deliver its rated output under every fuel, weather, maintenance or curtailment condition.

Can the utility connect part of the data center now?
Ask for staged grid connection. A lower initial capacity can preserve project value while network upgrades are designed and built, but it does not create new grid capacity by itself. The arrangement is useful only when the utility documents the conditions and schedule for later increments.

How to structure a staged request
- Submit the load model with a firm initial MW requirement and later phase dates.
- Ask the utility to identify the maximum initial service that does not depend on the delayed upgrade.
- Request a milestone schedule for studies, equipment procurement, construction, testing and authorization of each increment.
- Define what happens if a milestone slips: extension rights, temporary operating limits, refund treatment and responsibility for customer equipment.
- Confirm whether the initial service is firm, non-firm or subject to curtailment, and how much notice the utility may provide before an interruption.
Do not treat a verbal target date as a capacity commitment. The service agreement, tariff and construction contract should state the conditions for each increase.
Can we get power sooner if we agree to be curtailed?
Possibly, but expedited interconnection is not guaranteed. Start by identifying workloads that can be shifted, delayed, throttled or shut down temporarily. Quantify the reduction in MW, response time, maximum event duration, frequency, recovery behavior and any minimum operating level.
What to ask about a flexibility program
- Whether the utility or RTO/ISO has demand-response, interruptible-service or another flexibility product applicable to this load.
- Required telemetry, metering, testing, cybersecurity controls and performance measurement.
- Advance notice, event duration, seasonal limits and penalties for nonperformance.
- Compensation structure and whether payment depends on verified reduction or market conditions.
- How curtailment interacts with backup generators, batteries, maintenance windows and customer reliability commitments.
FERC states that “Effective demand response can help reduce electric price volatility, mitigate generation market power, and enhance reliability.” Its market-compensation discussion is conditional: demand response must balance supply and demand as an alternative to generation, and dispatch must be cost-effective. See FERC’s demand-response explanation.

Can we bring our own power or connect to a nearby generator?
Evaluate onsite generation, battery energy storage, a hybrid microgrid or co-location with an existing generator as engineering options. They may supply some energy or capacity, bridge a service delay or support a flexible grid arrangement. They do not automatically bypass transmission, retail-service, environmental or reliability requirements.
Onsite-generation checklist
- Fuel: verify firm fuel supply, delivery logistics, storage, price exposure and emergency provisions.
- Permits: identify air, noise, water, land-use and emissions approvals, including operating-hour limits.
- Electrical design: engineer protection, synchronization, islanding, transfer schemes, grounding and fault-current performance.
- Reliability: model generator availability, maintenance outages, black-start needs and the number of independent units required.
- Operations: budget staffing, testing, fuel treatment, spare parts, emissions monitoring and maintenance.
- Grid relationship: determine export restrictions, interconnection studies, standby tariffs and how the utility treats parallel operation.
A battery can provide short-duration capacity, fast response or peak reduction, but its useful MW depends on duration, state of charge, degradation, recharge time and thermal conditions. A microgrid must be designed around the critical-load model rather than the facility’s total nameplate demand.
Co-location is jurisdiction-specific
FERC’s December 2025 fact sheet directed PJM to create tariff rules for loads co-located with generation, including transmission-service choices. The applicable tariff and service arrangement must be checked in the current PJM proceedings; that pathway should not be generalized to another RTO, ISO or state. FERC identifies co-location and behind-the-meter arrangements as requiring explicit reliability and cost-allocation treatment. See the PJM co-location fact sheet.
Reduce the connection capacity you actually need
Review cooling design, power-conversion efficiency, workload scheduling, utilization assumptions and commissioning plans with qualified engineers. Load shaping may lower peak MW or delay a later increment. Examples include scheduling batch workloads outside coincident peaks, improving cooling controls, increasing server utilization and separating noncritical compute from essential services.

Present any reduction as an engineered forecast with testable assumptions. The available sources do not establish a universal percentage saving or payback period, so do not promise one. The utility may still study the original configuration if the lower demand is not contractually enforceable.
Compare another site or utility territory
If the project is not irrevocably committed to its current location, compare candidate sites using verified service data rather than regional headlines.
| Site-screening factor | Evidence to obtain |
|---|---|
| Power delivery | Written available MW, phase dates, upgrade scope and utility commitments |
| Cost allocation | Tariff, deposits, customer-funded facilities, demand charges and stranded-asset exposure |
| Reliability | Outage history, redundancy, restoration practices and firm versus interruptible terms |
| Energy and environment | Generation mix, carbon-free matching options, fuel access, emissions limits and permits |
| Physical infrastructure | Transmission and distribution corridors, fiber, water, cooling constraints and land |
| Execution risk | Study queue, equipment lead times, permitting schedule, workforce and community requirements |
A site with abundant generation nearby can still lack substation capacity or an approved delivery path. Require utility studies and written commitments for the specific parcel.

What the U.S. regulatory landscape means in 2026
FERC’s large-load proceeding
FERC’s RM26-4-000 page describes an advanced-notice-of-proposed-rulemaking process on interconnection of large loads to the interstate transmission system. The questions include whether flexible loads could move faster through studies, how grid-upgrade costs should be allocated and how reliability should be assessed when an existing generator serves a new customer at the same location. These are proposed policy issues, not a general entitlement to service.
In an April 16, 2026 release, FERC said it intended to act by June 2026 and cited related actions, including the December 2025 PJM co-location order and approval of SPP’s High Impact Large Load initiative in January 2026. In June 2026, FERC announced show-cause orders to six RTOs/ISOs concerning large-load tariffs. The cited materials do not establish the final disposition of RM26-4-000 by October 13, 2026, so check the docket before relying on a final rule. FERC Chairman Laura V. Swett described the moment this way: “Our nation stands at a pivotal moment as we face rapid growth in demand from data centers and other large-scale consumers that are reshaping our transmission landscape.” The release is available at FERC’s April 16, 2026 announcement; the June action is summarized at FERC’s June 18, 2026 release.
Do not confuse generator-queue reform with a load connection
FERC Order No. 2023 addresses generator interconnection, not a guaranteed route for a data-center load request. FERC’s interconnection explainer describes a first-ready, first-served cluster process, queue information and study deadlines. Its historical figures—more than 10,000 active U.S. generation requests representing over 2,000 GW at the end of 2022, and 68% of 2,179 studies issued late in 2022—describe generator queues, not current data-center load wait times.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteDOE roadmap targets are not guarantees
The Department of Energy’s Distributed Energy Resource Interconnection Roadmap sets 2030 targets of a median request-to-agreement time below 140 days for large distributed-energy projects above 5 MW and a queue-to-agreement completion rate above 85% for that category. Those are roadmap targets, not observed current performance or guaranteed timelines for a transmission-level data-center load.
Quick Recap
A practical 30-day response plan
- Days 1–5: send the written constraint questions, appoint one internal owner and preserve every utility study, tariff and email.
- Days 6–10: freeze the load model, separate critical and deferrable MW, and have engineers validate reliability and ramp assumptions.
- Days 11–15: request meetings with the utility and applicable RTO/ISO; ask for staged, flexible and non-firm service scenarios in writing.
- Days 16–22: commission concept studies for generation, storage, microgrid, efficiency and alternate sites, including permits and fuel logistics.
- Days 23–30: score every scenario on dependable MW, date, cost, reliability, environmental constraints and regulatory availability; select a preferred path and a contingency.
Pitfalls that cause avoidable delays
- Relying on a verbal “no” or “yes”: require a written constraint and conditions.
- Using nameplate MW as dependable capacity: model fuel, maintenance, weather, state of charge and curtailment.
- Assuming curtailment guarantees priority: ask for the actual tariff and study treatment.
- Treating behind-the-meter generation as exempt: verify permits, interconnection, standby service and protection requirements.
- Comparing options with different load forecasts: use one approved model and document every changed assumption.
- Quoting federal proposals as final rules: check the current FERC docket and local tariff before signing commitments.
