Ask the repairer for the exact missing part, its order status and a written completion date before you agree to keep waiting. Then identify who is responsible—seller, manufacturer, carrier, insurer or repair shop—and request a loaner, another authorized location, an alternative repair, or return of the phone. Your right to a refund, replacement or reimbursement depends on your country, warranty and contract; there is no worldwide deadline or automatic loaner entitlement.
Take these steps before the delay gets longer
A statement such as “the part is unavailable” is not enough to plan around. Get a precise record and a date you can challenge if it slips.
- Request the facts in writing. Ask for the exact part name or part number, why it is unavailable, whether it has been ordered, the supplier or manufacturer’s estimate, and whether an original, approved substitute or different authorized repair route exists.
- Ask for a firm revised completion date. A range such as “soon” is difficult to assess. Ask when the repairer expects the phone to be ready and what will happen if that date is missed.
- Ask whether you can have the phone back while waiting. Confirm whether removing it from the repair queue affects the warranty, diagnostic fee, repair estimate or your place in line. Ask for the device’s condition, accessories and any parts already removed to be recorded at return.
- Preserve your paperwork. Keep the repair order, intake photos, proof of purchase, warranty or service-plan terms, invoices, diagnostic reports and every email or message. Record the dates you delivered the phone, were promised completion and were told about the parts shortage.
- Ask for alternatives before authorizing anything. Request a loaner, another authorized location, a different repair method, a replacement process or a refund route if your applicable law or agreement provides one.
Do not authorize a new shop solely on a verbal promise. First ask whether the current provider will release the phone, whether the original warranty remains in force, what parts the second shop would use, whether data may be erased and what warranty the second shop gives on its work.
Work out who is responsible for the delay
The party you should contact depends on how the repair was arranged. A seller’s statutory obligation, a manufacturer warranty, a carrier or insurance plan and a paid repair agreement can impose different duties and exclusions.

| How the repair was arranged | First contact | Questions to ask |
|---|---|---|
| Phone bought from a retailer and returned under consumer law | The retailer or seller | What remedy is available if it cannot repair within a reasonable time, and who pays if another repairer is needed? |
| Manufacturer warranty | The seller and the manufacturer’s warranty administrator | Which party must coordinate the claim, and does a different authorized location have the part? |
| Carrier protection or insurance plan | The plan administrator or carrier | Is a loaner, replacement or cash settlement available, and are there deductibles or return deadlines? |
| Paid independent repair | The repair shop named on your receipt | Is the part back-ordered, can the phone be returned, and what refund or cancellation terms apply? |
In Victoria, Australia, Consumer Affairs Victoria says a valid consumer claim is generally handled by the store, even when a manufacturer warranty applies. That allocation is Victoria-specific; do not assume a retailer in another state or country has the same obligation.
Compare your practical options
Choose an option by weighing the time you can tolerate without the phone, your likely out-of-pocket cost and the risk to coverage. These are decision criteria, not a promise that any option is legally available in your location.
| Option | When it can make sense | Risks and checks |
|---|---|---|
| Keep waiting with the current provider | The part has been ordered and the revised date is short and credible. | Ask what happens if the date slips; keep the written estimate and escalation date. |
| Use another authorized location | A network location can source the same approved part sooner. | Confirm that the first provider transfers the job and that diagnostic work is not duplicated or charged twice. |
| Have another repairer do the work | The delay is substantial and local law or the seller’s terms allow an alternative repair. | Get a written quote, part provenance, repair warranty, data-handling terms and confirmation of who may reimburse the cost. |
| Request a replacement or refund | The provider cannot repair within the applicable reasonable period or the contract gives that remedy. | Eligibility, depreciation, restocking and return conditions vary. Do not assume a universal entitlement. |
| Borrow or rent a temporary phone | You need calls, two-factor authentication or work access immediately. | Check SIM or eSIM transfer, account access, security, return date and any rental fee. |
| Buy an unlocked smartphone temporarily | No suitable loaner is available and the delay is long enough to justify the expense. | Verify carrier and network compatibility, condition, return policy and total cost before buying. A purchase may not be reimbursed. |
For any path, check six things: expected time to a working phone, total cost and possible reimbursement, preservation of warranty or statutory coverage, part quality and repair warranty, data-loss and security exposure, and whether a borrowed device meets your connectivity needs.
Location-specific rights and procedures
Victoria, Australia
Consumer Affairs Victoria says that when a store cannot arrange a repair—for example, because the manufacturer lacks the necessary part—or cannot do so within a reasonable time, you can have the product fixed elsewhere and claim reasonable costs from the store that sold it. The guidance also describes asking for a refund or replacement. It was last updated 13 October 2023 and applies to Victoria, not automatically to every Australian state or territory.

Before using another repairer, give the store a written opportunity to resolve the problem. State the original promise, the missing part, the new date you need and the remedy you are requesting. Keep the alternative repairer’s quote and final invoice; “reasonable costs” will depend on the facts and applicable law.
Québec, Canada
Québec’s Office de la protection du consommateur describes an availability warranty for cell phones. For a reasonable period after purchase, the merchant and manufacturer must make replacement parts, repair services and repair information available, subject to the required notices. If a merchant or manufacturer does not intend to guarantee availability of an element, it must provide clear written notice before purchase. Without that notice, the consumer may ask that the necessary repair be performed at that party’s expense when the availability obligation is not met.
The Office’s current guidance, accessed in 2026, describes a specific process:
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches- The merchant or manufacturer has 10 days to notify you in writing of the timeframe it proposes for the repair.
- If you accept the timeframe and the party misses it, you may demand reimbursement or replacement as described by the Office.
- If the proposed timeframe is unacceptable, you may refuse it and have another party repair the phone at the merchant’s or manufacturer’s expense, under the conditions the Office describes.
- If no satisfactory reply arrives, you may demand replacement or reimbursement and return the broken phone.
The Office notes that its plain-language explanation does not replace Québec legislation. Keep your notice, response and receipts, and confirm how the rules apply to your phone, purchase date and contract.

United States
Federal Trade Commission consumer guidance says that if an earlier independent repair was unrelated to a later repair, and the later repair is covered by an unexpired warranty, the manufacturer cannot refuse that later covered repair merely because of the earlier independent work. If a company tells you the warranty was voided for that reason, the FTC encourages consumers to report the issue.
In a July 2024 release, FTC Bureau of Consumer Protection Director Samuel Levine said, “These warning letters put companies on notice that restricting consumers’ right to repair violates the law.” The release concerned FTC staff warning letters to eight companies in other product categories. It describes enforcement concerns, not a court judgment resolving every phone dispute. Coverage can still turn on the actual fault, exclusions, damage and warranty terms.
Ask the warranty provider to identify in writing the clause it relies on, the causal connection it alleges between independent work and the failure, and the repair or appeal route. Do not assume that opening a phone automatically voids every warranty, but do not assume an independent repair is covered either.

European Union
Directive (EU) 2024/1799 was adopted on 13 June 2024. Member States had to transpose and apply it from 31 July 2026. It creates repair obligations for manufacturers of goods subject to EU repairability requirements and listed in Annex II. Where the directive covers the product and fault, repairs must be completed within a reasonable time and for a reasonable price. Manufacturers supplying spare parts must charge reasonable prices and may provide a replacement good during the repair.

The directive does not cover every phone, every failure or every national procedure automatically. Check your country’s implementing rules and whether your particular device appears within the covered product scope. The European Commission says an online repair platform is expected to become operational in January 2028; it should not be treated as an available service before then.
How long should a phone repair take?
There is no single worldwide number of days. “Reasonable” depends on the device, fault, part supply, promised service level, warranty and local law. A credible estimate should identify the part, explain the supply problem and set a date. An indefinite “we are waiting” response gives you a reason to escalate, not a reliable deadline.
Use the written date as a checkpoint. If the date passes, send a notice that states the original promise, the part status, the missed date, the remedy you want and the date by which you expect a reply. A short, factual record is more useful than repeated telephone calls with no confirmation.
Can you get your phone back while waiting for parts?
Ask the current provider. It may be able to return the phone after documenting its condition, or it may explain that disassembly, missing components or a safety issue prevents immediate use. Ask whether taking it back changes your warranty position, estimate, storage fee or queue position. Before leaving, verify that you have the SIM or eSIM information, accessories and any backed-up data you need.

If a loaner is offered, clarify the fee, insurance, return date, SIM or eSIM transfer, storage access and whether you must erase the loaner before return. In qualifying EU cases, a manufacturer may provide a replacement good during repair, but EU rules do not create a universal right to a loaner.
Stay connected without creating a second problem
Borrow first
A spare family phone, employer device or carrier loaner can avoid a purchase. Confirm that it supports your carrier’s bands, your SIM or eSIM, required authentication apps and accessibility features. Sign out of accounts and erase personal data before returning it.
Buy only when the numbers work
If the delay is substantial and no loan is available, an unlocked smartphone can be a temporary fallback. “Unlocked” does not guarantee compatibility: check the carrier’s supported network, activation policy, device condition, return window and total cost. Research did not establish a particular model, price, stock position or retailer program, so treat this as an option rather than a recommendation or guaranteed reimbursement.
Escalate a parts delay in writing
- Send the repairer or responsible warranty provider a concise timeline with intake date, promised date, missing part and latest estimate.
- Request one specific outcome: completion by a stated date, transfer to another authorized location, return of the phone, a loaner, an approved alternative repair, replacement or reimbursement.
- Set a response date that gives the provider a practical opportunity to act.
- If the response is inadequate, contact the seller or warranty administrator’s complaints team and attach the record.
- Contact the consumer-protection agency for your location if the written escalation fails. Complaint routes and remedies differ by jurisdiction.
Do not send original documents unless requested; provide copies and keep delivery confirmation. If you hand the phone to a second repairer, photograph its condition and remove sensitive accounts where possible.
Questions to ask before changing repairers
- Can you source the exact part, and is it manufacturer-supplied, refurbished or compatible?
- What is the all-in price, including diagnostic, labor, shipping and taxes?
- What warranty covers your work and the part, and for how long?
- Will opening or modifying the phone affect an existing warranty or insurance claim?
- Could the repair erase data, disable biometric functions or require a factory reset?
- Will the first provider release the device and its removed parts?
- Who, if anyone, has agreed in writing to reimburse the cost?
What to put in your written complaint
Use a subject such as “Delayed phone repair—replacement part unavailable.” Include the phone model and repair number, delivery date, promised completion date, the exact part status, your requested remedy and a response deadline. Attach the receipt and relevant warranty clause, but redact passwords, full payment-card numbers and unnecessary personal data.
Keep the tone factual. A clear record helps the seller, warranty administrator or consumer agency see what was promised, what changed and what resolution you are seeking.
