Discovery does not automatically mean dismissal everywhere: the outcome depends on your location, contract, job duties, and whether the second job creates a conflict, exposes confidential information, overlaps with scheduled work, or affects your performance.
What to do first
- Review your documents. Read your signed employment agreement, handbook, and any outside-employment, disclosure, approval, conflict-of-interest, confidentiality, intellectual-property, or competition policies. Note the exact wording and any stated process for notifying your employer or requesting approval.
- Map out the second job. Write down its duties, employer or client, schedule, and whether it overlaps with your main employer’s customers, business, or confidential information.
- Check for practical problems. Consider missed shifts, changes to your availability, fatigue, performance issues, use of company time or equipment, and any sharing of information. Preserve relevant communications and records rather than deleting them.
- Answer questions truthfully and briefly. Explain what the second job involves, when you do it, and how you keep its work and information separate. Ask which policy or agreement clause your employer believes applies and what information or response it is requesting.
- Use the stated process if disclosure or approval is required. Follow the applicable steps and keep a record of your exchange. If the work directly competes or involves sensitive information, pause any activity that could risk misuse of information while you seek advice; that does not mean you must automatically quit the second job.
- Get help if the matter becomes formal. If your employer raises discipline or termination, ask for the allegations and next steps in writing where appropriate, preserve relevant documents, and promptly contact a local employment lawyer, union, or worker-advice service. Do not sign a resignation, settlement, or admission under pressure without understanding it.
What can make a second job a workplace issue?
The existence of another job is only part of the picture. The specific concerns raised in official guidance include:
- Competition or conflicts: The second job may compete with your employer or create a conflict that cannot be managed.
- Confidentiality or intellectual property: Work may expose business-sensitive information, customer details, or intellectual property to another employer or client.
- Work time and equipment: Performing the second job during your main job’s scheduled hours or using its equipment can create a separate workplace concern.
- Availability and performance: Missed shifts, reduced performance, or unreliable availability can matter even when the jobs are in different industries.
- Hours, health, and safety: Long or irregular hours may affect safe work or the ability to perform either job.
These are practical factors to assess, not a universal legal test. Their significance depends on your location, contract, workplace rules, and circumstances.
Does having a second job automatically justify dismissal?
No single answer applies worldwide. The reviewed official sources do not establish a global rule that a second job is either always allowed or always grounds for dismissal. They also provide no relevant published figure for how often employers discover second jobs or how often discovery leads to discipline.

New Zealand
New Zealand’s Employment Relations Act 2000, section 67H, limits when an employment agreement may include a restriction on secondary employment. The employer must have genuine reasons based on reasonable grounds, state those reasons in the agreement, and not restrict outside work more than necessary for those reasons. The section identifies interests such as commercially sensitive information, intellectual property, commercial reputation, and a real conflict that cannot otherwise be managed. This is a New Zealand rule, not a worldwide standard. Read section 67H of the Employment Relations Act 2000.
Japan
Japan’s Ministry of Health, Labour and Welfare provides guidance and materials on side jobs and concurrent employment. Its worker-facing guidance advises checking company rules and considering the duties and hours involved. The materials also address advance reporting, working-time aggregation in qualifying employee relationships, health and safety, confidentiality, and competition. The Ministry page records guideline versions from January 2018, September 2020, and July 2022, and lists a pamphlet revision dated March 31, 2025; check the current material and its application to your circumstances. As a Japan-specific regional example, Osaka Labour Bureau’s FAQ discusses a case involving a worker who took a second job without telling the main employer. It summarizes a court’s consideration of effects on work performance and workplace order when evaluating a consent rule. That example does not establish a universal rule, even within Japan. Taiwan
Taiwan’s Ministry of Labor says an employee may work outside normal hours, but workplace rules may provide concrete and appropriate sanctions if the side job affects performance of the employment contract. How to handle a meeting or investigation
- Listen to the concern and ask which agreement term, policy, or work impact is at issue.
- Give accurate information about the second job’s duties and schedule. Do not misrepresent them or make unsupported claims about whether a policy is enforceable.
- Explain concrete steps you take to separate the jobs, such as keeping work to different hours and not using or sharing your employer’s information or equipment.
- Keep copies of relevant policies, messages, and meeting notes. If discipline, dismissal, or confidential-information allegations are involved, seek advice from a local employment lawyer, union, or worker-advice service before making a consequential decision.
Why local advice matters
Rules differ by country, and the examples above cannot determine your rights in another jurisdiction. Before deciding whether to disclose, seek approval, change the second job, or challenge a restriction, establish which law and documents apply. A local adviser can assess your location, employment status, agreement, any collective agreement or occupation-specific rule, the nature of the potential conflict, and whether a formal disciplinary process has begun.
