Stop driving the vehicle on public roads and arrange prompt draining and fuel-system cleanup. Keep the fuel receipt and note how much was added, when, and whether the engine was started or the vehicle driven. Then contact the fuel-tax authority for the place where the fuel was used: tax, reporting rules, and penalties depend on jurisdiction and circumstances. Do not assume that adding clear diesel or paying tax alone makes the vehicle road-compliant.
What to do immediately
- Stop public-road use. Park safely and avoid driving the vehicle again until a qualified service provider or the relevant authority confirms what cleanup is needed and it has been completed. Record the date, location, quantity and type of fuel purchased, and whether the engine was started or the vehicle driven.
- Arrange removal and cleanup. Contact a qualified diesel service shop if you are unsure how much fuel entered the system, whether it circulated, or how your vehicle is designed. Tell the shop what happened and ask for an invoice documenting the work.
- Ask the local authority what to report and pay. Contact the fuel-tax agency for the jurisdiction where the fuel was used. Explain that the fueling was accidental, how much was added, and whether the vehicle was driven. In the United States, federal and state rules may both apply.
- Keep the paperwork. Retain the receipt, service records, fuel quantity, date, and any available odometer or trip details. Document draining, filter replacement, cleaning, and refueling. Records help establish the corrective steps taken but do not guarantee immunity from tax or penalties.
Why draining and cleanup matter
Dyed diesel is marked fuel generally sold for uses that do not incur the usual highway fuel taxes. The dye identifies its tax status; it is not a mechanical additive that can be made acceptable for road use by diluting it. Rules vary, and in some places the presence of dyed fuel in a licensed vehicle’s supply tank can matter regardless of the driver’s intent or distance traveled.
Official guidance in Idaho and the United Kingdom calls for removing the fuel and cleaning affected parts of the system. The precise procedure depends on the applicable rules and the vehicle. Do not simply top up with clear diesel and resume driving, and do not try to hide or alter the dye.

Idaho
The Idaho State Tax Commission’s instructions for accidental fueling say to drain dyed diesel from the licensed vehicle’s main supply tank, replace the fuel filter, clean the tank and fuel-supply lines, and pay fuels tax on dyed diesel used on a taxable road using Form 75. This is Idaho guidance, not a universal repair procedure. The Commission says operators found using dyed diesel in the main tank of a licensed or required-to-be-licensed vehicle owe motor fuels tax and may receive a fine; penalties start at $250, with additional federal penalties potentially applying. United Kingdom
HMRC says the owner or operator is responsible for removing the fuel as soon as it is discovered and before the vehicle is used again on a public highway. Its stated procedure is to drain the tank, fill and flush the system with 5 litres (one gallon) of duty-paid road diesel, drain that fuel, change filters, then refill with duty-paid road diesel. HMRC also says to retain records of the cleanup. This procedure is specific to the UK guidance; do not apply its flush quantity or sequence automatically in another country. Elsewhere
Ask the relevant authority and a qualified diesel service provider what removal, cleaning, reporting, and tax steps apply where the fuel was used. There is no universal home-repair procedure: the quantity, whether fuel circulated, vehicle layout, and local fuel-handling requirements all matter. Do not pump or handle fuel at home unless you have confirmed that the method is safe and lawful.

Tax and penalties: check the rules for your location
United States federal rules
IRS Publication 510 (12/2025) describes a federal penalty for dyed fuel held for taxable use or used when the person knew or had reason to know it was dyed. The penalty is the greater of $1,000 or $10 per gallon of dyed diesel involved, in addition to tax. The publication also describes federal backup tax when dyed fuel intended for a nontaxable use is delivered into the supply tank of a diesel-powered highway vehicle, generally at $0.244 per gallon. These are federal provisions, not a complete account of state rules; whether they apply in a particular accidental-fueling case requires advice from the relevant authority or a tax professional. North Carolina’s narrow, temporary agricultural provision
A North Carolina Department of Revenue notice dated October 1, 2026 says specified penalties will not be imposed through December 31, 2026 for dyed diesel sold or used from bulk storage for highway use associated with farming or agricultural purposes, subject to payment of the state excise tax at 41 cents per gallon. The notice says this relief applies only within North Carolina and warns that use outside the state may be subject to federal and other-state penalties. It is not a general exception for accidental fueling. Check the notice and its current status before relying on it. North Carolina Department of Revenue: Dyed Diesel Notice

Ontario
Ontario’s official guidance is summarized as treating any presence of red dye as disqualifying fuel for a licensed motor vehicle and advising immediate notification and draining if coloured fuel is found. - CLEANS INJECTORS: AR6500's detergent package removes injector deposits and restores spray patterns for improved atomization, supporting better performance and fuel economy
What not to do
- Do not keep driving to use up the fuel. Official guidance reviewed for Idaho and the UK calls for removal and cleanup, not continued road use.
- Do not dilute it with clear diesel as a workaround. Adding clear fuel does not establish that the vehicle is compliant; the reviewed cleanup guidance calls for removal and cleaning.
- Do not conceal or alter the dye. IRS Publication 510 separately addresses penalties for willful alteration of dye. Use legitimate cleanup and contact the authority instead.
- Do not assume accidental fueling means no tax or penalty. The outcome depends on the jurisdiction and facts, including applicable federal, state, or local rules.
What to tell the service shop and tax authority
- Where and when the fuel was purchased, and the type shown on the receipt.
- How much dyed fuel was added and the approximate fuel level before fueling.
- Whether the engine was started, how far the vehicle was driven, and whether the fuel may have circulated.
- The vehicle’s location and registration jurisdiction.
- What cleanup was completed, with receipts or service documentation.
