Stay calm, identify the request, and preserve the data. Ask who is contacting you, what device or records they want, which dates and location are involved, and whether the request is voluntary or backed by a warrant, subpoena, court order, or other legal process. Do not delete, edit, reset, or overwrite potentially relevant material. Ask a qualified lawyer licensed where the project occurred to review the request promptly; the correct response depends on the jurisdiction, the type of data, and your role.
This guide is general U.S. information, not individualized legal advice. Federal rules do not settle every state or local camera, audio, or tracking question.
Start by establishing exactly who is asking and what they want
Police contact can involve very different situations: an informal request for a copy of security video, a demand for live access to an account, service of a subpoena, or execution of a search warrant. The legal duties and risks are not interchangeable. Before discussing the facts of an incident, collect the basic information that lets counsel assess the request.

- Officer or investigator’s full name, rank, agency, telephone number, and email address.
- Case, incident, or project number.
- The camera, tracker, account, vehicle, building, or other property involved.
- The precise location, date range, and time zone requested.
- Whether they want an existing file, a system search, live viewing, account credentials, physical equipment, or installation/use of a tracking device.
- Whether they say the request is voluntary or rely on a warrant, subpoena, court order, consent form, or another legal instrument.
For a telephone or online contact, request a copy of any document and verify the agency through a phone number you locate independently, rather than relying only on a number in an unsolicited message. Keep a contemporaneous note of what was asked, what you said, and when each contact occurred. Do not speculate about events, identify a suspect, or promise that records do or do not exist until you understand your role and have obtained advice.

Voluntary request versus compulsory legal process
The first decision is whether officers are asking for cooperation or exercising legal authority. A voluntary request may be declined or negotiated in some circumstances, but a subpoena, warrant, or court order can create enforceable duties and deadlines. The document, the issuing court, the jurisdiction, and the type of data all matter.

An older U.S. Department of Justice practical guide says a private camera owner is not required to provide footage to detectives unless subpoenaed. That statement is limited guidance, not a nationwide answer for every camera, account, provider, state, or type of demand. Have a lawyer review the actual request and local law before relying on it.
Preserve the camera, tracker, and related records
Once you learn that an investigation or request may involve your system, preserve potentially responsive information. Do not guess at a retention period: the available guidance does not establish one universal period for every camera, cloud service, vehicle tracker, or project.

Preserve more than the obvious video file
- Original video and audio files, including the native format and any associated metadata.
- Device logs, event lists, motion alerts, access logs, and export histories.
- Cloud-account notices, provider messages, and changes to sharing or access permissions.
- Installation plans, project specifications, maintenance records, and device serial numbers.
- Emails, text messages, tickets, contracts, and notes about the camera or tracking work.
- A copy of the police request, warrant, subpoena, order, inventory, or receipt.
Do not edit footage, change timestamps, reformat a drive, reset a device, or alter settings in a way that could overwrite data. If the system automatically overwrites old recordings, stop routine deletion only in a technically safe way and ask counsel or a qualified technician how to preserve the relevant period without changing the original. Record what was preserved, the source device or account, and the date and time of each preservation step. Keep working copies separate from originals and limit access to people who need it.
If police ask for security-camera footage
Ask the investigator to identify the exact camera, address or scene, date and time range, and file format sought. Clarify whether police want a copy, permission to inspect the system, access to a cloud account, or the physical recorder. Those are different disclosures with different privacy and security consequences.
- Request the demand in writing. Ask whether the request is voluntary and, if not, what process is being served.
- Define the scope. Confirm camera number, time zone, start and end times, audio, and whether related metadata or logs are included.
- Check for third-party material. Note whether the recording includes homes, bedrooms, bathrooms, employees, customers, children, bystanders, or neighboring property.
- Do not hand over account credentials. Ask counsel whether a controlled export or supervised access can satisfy a lawful demand without revealing unrelated data.
- Document the transfer. Keep a copy of what was provided, the export method, file names, hash or other integrity record if counsel or a forensic professional recommends one, and the recipient’s acknowledgment.
Never crop, enhance, annotate, or convert the only copy before preserving the original. If a format conversion is necessary for viewing, retain the native file and document the software and settings used for the viewing copy.

If officers arrive with a warrant or execute a search
Do not obstruct, hide equipment, destroy data, or physically resist. Ask to see the warrant and request a copy. If it is safe and practical, read the places, devices, accounts, and categories of information listed. Ask for an inventory, receipt, or other record of equipment or media taken or copied. Contact counsel as soon as possible and avoid volunteering explanations beyond basic logistical assistance.

It does not automatically govern a state or local search. For a federal tracking-device warrant, Rule 41(c)(2)(C) states: “A warrant for a tracking device must identify the person or property to be tracked, designate the magistrate judge to whom it must be returned, and specify a reasonable length of time that the device may be used.” A warrant’s presence does not authorize officers to search every unrelated account or device; the permitted scope is determined by the document and applicable law. State rules may use different forms, procedures, or standards.
Do not sign a consent form, statement, inventory acknowledgment that adds factual admissions, or agreement to provide passwords without understanding it. You can be courteous while saying that you want counsel before answering substantive questions. If equipment is seized, write down what is missing and any damage or access changes as soon as officers leave.

Live access, tracking, and account-held data
Live viewing and tracking raise different issues from producing a recording already stored on your system. Ask whether officers want temporary live access, historical location records, installation or activation of a tracker, or the device itself. Clarify who operates the system and whether a third-party service provider stores the data.
The Stored Communications Act provisions in the U.S. Code concern specified provider-held records and disclosures under particular forms of legal process. They do not establish one rule for every camera owner, device operator, employer, or service provider. The provider, type of record, account relationship, and issuing jurisdiction can change the analysis. Do not assume that because a vendor hosts footage, police can obtain it without process, or that a private owner can release another person’s account information without limits.

Audio, private spaces, and third-party privacy
A camera that records sound may implicate interception and consent laws that do not apply to silent video. The Bureau of Justice Assistance overview of Title III and related guidance directs readers to state law for interception authorization and standards. Do not assert that audio recording is always lawful or always unlawful; the result can depend on where people were, what they reasonably expected, the recording configuration, and the state involved.
Video of a public-facing area is not automatically free of privacy concerns, and a camera inside a home, workplace, hotel room, medical setting, or other private space can raise additional constitutional and statutory questions. Archived DOJ CCTV guidance discusses the Fourth Amendment where a person has a reasonable expectation of privacy, but it is older manual material rather than a complete current statement of law. Tell counsel if footage captures private interiors, neighboring property, employees, customers, children, or unrelated people. Counsel can assess whether notice, redaction, a protective order, or narrower production is appropriate.
Your role changes the response

A practical script for the first conversation
You can keep the first response short and factual:
- “Please give me your name, agency, case number, and a callback number.”
- “Which device, location, dates, and records are you requesting?”
- “Is this a voluntary request, or are you serving a warrant, subpoena, court order, or other process?”
- “Please send or provide a copy so my lawyer can review the scope and deadline.”
- “I will preserve potentially relevant records. I am not consenting to additional access while I seek legal advice.”
Use the last sentence only if it accurately reflects your position and no document already commands a different action. Do not lie, destroy evidence, evade service, or make a blanket claim that police have no authority. A lawyer can help you state an objection, negotiate a narrower production, or comply in a documented way.
Common mistakes and safer alternatives
- Deleting “irrelevant” clips: Relevance is a legal question. Preserve first and let counsel define the collection.
- Giving a phone password or cloud login: Credentials can expose unrelated accounts and permit changes. Ask for a controlled, documented method.
- Assuming a warrant is either unlimited or invalid: Read its listed places, devices, and items; ask counsel about any overbreadth or execution issue.
- Turning off a recorder without documenting it: An unexplained settings change can create confusion. Obtain technical and legal advice before altering operation.
- Forwarding footage through an ordinary messaging app: Use a secure transfer method specified by counsel or the receiving agency and retain your own copy.
- Discussing the request publicly: Social posts and group messages can become evidence. Limit communications to counsel and necessary custodians.
When to obtain a lawyer immediately
Contact qualified local counsel promptly when officers seek live access, physical equipment, account credentials, audio recordings, footage from private spaces, or information about other people; when a warrant, subpoena, or court order is served; when the requested period is broad or unclear; or when you may be a subject rather than a neutral custodian. Ask counsel to identify the governing state and federal rules, verify deadlines and service, preserve evidence, and communicate with investigators where appropriate.
Because surveillance and recording law varies by state and facts, a lawyer should check current statutes and decisions rather than relying on an old federal summary. Federal Rule 41, provider-record provisions, and DOJ or BJA guidance are useful starting points, not a universal answer to every camera or tracking project.
