Do not assume that either the date printed on a GST notice or order, or the date displayed on the GST portal, automatically controls. The printed date, portal availability, legally relevant communication or service, and the date you discovered the document can be different facts. Because section 169 of the CGST Act includes making a communication available on the common portal as a method of service, portal availability may matter; the first appeal period under section 107(1), meanwhile, runs from communication of the decision or order. Courts have reached different conclusions about portal-only service in particular cases. Preserve the evidence, identify the exact document and proceeding, and act promptly while getting advice based on your jurisdiction and records.

First, separate the dates instead of choosing one

A date mismatch can involve more than one document and more than one event. A notice may carry a date on its face, have a separately dated electronic summary, appear on the GST common portal later, and reach you through an alert or another communication at a still later time. Those dates should not be collapsed into a single “notice date.” Which date matters depends on what action is at issue—such as replying to a show-cause notice (SCN), attending a hearing, appealing an order, or responding to a demand—and on the applicable service rules and evidence.

Date or record What it may tell you What it does not establish by itself
Date printed on the SCN or order When the document says it was made or issued. When it was uploaded, became accessible, or was legally communicated.
Date on a summary, such as Form GST DRC-01 or DRC-07 The date associated with a prescribed electronic summary for a specified notice or order. That the summary and the full SCN or adjudication order are the same document, or that the detailed document was available at the same time.
Portal upload, issue, or availability date What the portal record says about when an item was placed or made available there. That the record is complete, that you could actually view or download the underlying document then, or that every court will treat that event identically.
Email, SMS, post, or other delivery date Evidence of a separate communication or alert and when it was sent or received. That it is the only legally relevant method of service.
Date you or your representative discovered the entry When you became aware of it, which may be relevant to explaining the chronology. That actual discovery necessarily starts or resets a statutory period.

Section 169 of the CGST Act lists methods of serving decisions, orders, notices and other communications. These include making them available on the common portal, as well as other modes; the provision also contains deemed-service language for specified modes. Section 107(1) measures the ordinary first-appeal period from communication of the decision or order, rather than simply naming the date printed on its face. The practical question is therefore not just “Which date is later?” but “What was communicated, by what method, for which proceeding, and what evidence supports that chronology?”

Identify what was issued: SCN, summary, detailed order, or demand entry

Before working out any deadline, establish exactly what each portal entry represents. GST Rules rule 142 provides for electronic summaries in prescribed forms for specified demand notices and orders. A summary can be important, but it should be examined alongside the underlying notice or order and its attachments rather than assumed to replace them.

  • SCN: the show-cause notice that sets out the proposed action and may call for a reply by a stated date.
  • Notice summary: for specified notices, the portal may contain an electronic summary such as Form GST DRC-01.
  • Detailed adjudication order: the order itself, which may contain reasons, findings, and directions relevant to a challenge.
  • Order summary: for specified orders, an electronic summary such as Form GST DRC-07 may appear separately.

Download every item separately, including attachments. Note whether an item appears in a notice/order listing or a separate additional-notices area, and capture the portal location shown in the record. Portal placement may become relevant evidence in a dispute, but it does not establish a universal rule for every tab, type of proceeding, or case.

Rule 142 is set out in the CBIC appeal rules. The distinction between a summary and a detailed order is not merely cosmetic: a notice reply, an appeal against an adjudication, and a challenge to whether the detailed order was communicated are different procedural questions. Preserve both the summary and the underlying document so the record shows what was, and was not, available.

Build a chronology you can prove

Create one timeline for the case and record each event separately. Use the displayed time zone and time where shown; do not silently convert a portal timestamp into a different date. If a document could not be opened, record that separately from the date on which the portal first displayed an entry.

  1. Save the documents. Download the full SCN or order, every summary, each attachment, and any later version. Keep the original files intact and note when and from where you downloaded them.
  2. Capture the portal record. Save screenshots showing the relevant portal area, document title or reference, and timestamp. If the portal has separate locations for notices, orders, or additional notices, record which one contained the item.
  3. Record all external communications. Keep emails with their headers where available, SMS details, postal envelopes or delivery information, and correspondence with the tax office. Record both sending and receipt information if you have it.
  4. Write down actual access and discovery. Note when you first could view or download the document, when you or your representative first found it, and any access problem. Distinguish what you personally observed from what the portal record displays.
  5. List every deadline separately. Record the reply date stated in the SCN, any hearing date, a payment date, and any appeal deadline shown in a portal field or communication. Identify what action each date appears to govern.
  6. Ask for clarification in writing if records conflict. Request confirmation of the issue, upload, availability, and communication dates, along with the complete order or notice and relied-upon documents. Keep the request and response with the timeline.

A chronology helps an adviser or authority assess the facts; it does not decide which date a court will accept as legally controlling. A clarification request also does not, by itself, stop or extend a statutory deadline.

Work out which deadline is involved

Reply to an SCN

Start with the response period and any hearing date stated in the notice, but compare those details with the actual documents and portal record. If the notice appears late, incomplete, or inconsistent, consider responding within the stated period while expressly identifying the date discrepancy and preserving the objection, after taking advice suited to the case. Waiting for the authority to answer a clarification request can leave a reply or hearing deadline unresolved.

First appeal against a decision or order

Under section 107(1) of the CGST Act, the ordinary period for an aggrieved person to appeal an adjudicating authority’s decision or order is three months from communication. The GST Portal appeal FAQ says the Appellate Authority may condone delay by up to one further month where sufficient cause prevented filing within the three-month period. That extra month is not automatic and should not be treated as a safe extension to wait for. The precise start date and computation depend on the record and applicable law.

The portal FAQ also explains the APL-01 filing path and addresses the self-certified-copy issue when an order is not uploaded. Check its current instructions against the documents available in your own case; do not assume that a portal summary alone answers what must accompany a particular appeal. If an appealable order has issued and time may be running, promptly assess filing rather than waiting for a service dispute or a clarification response to be resolved.

Further appeal to the Appellate Tribunal

A Tribunal appeal is a separate route under section 112, with its own limitation framework and amendments. Commencement provisions and notified dates can affect the calculation. Do not carry the first-appeal timeline over to a Tribunal matter: verify the provisions and notifications in force for the particular proceeding and date, and obtain advice on the applicable deadline.

Why a portal date may matter—and why it may not settle the dispute

Section 169 expressly includes making a communication available on the common portal as one service method. That means portal availability cannot safely be dismissed as irrelevant simply because a taxpayer says no separate email or letter arrived. At the same time, the existence of a portal entry does not resolve every factual or legal issue: the item may be a summary rather than the detailed order, the record may show an upload date different from when the document was accessible, and courts have treated portal-only service differently in particular cases.

The decisions below illustrate the differing approaches identified in the cited judgments. They are not a nationwide rulebook. A High Court decision must be assessed in light of its jurisdiction, facts, later rulings, and any appellate development; a decision from another state does not automatically determine a reader’s case.

Decision Issue reflected in the reported decision Practical significance
Radhe Enterprise v. Assistant Commissioner of State Tax, Gujarat High Court, June 20, 2025 The reported judgment discussed portal-generated, electronically authenticated documents and treated portal availability as service under section 169(1)(d) in the circumstances before it. Read the reported decision. Portal upload can be legally significant; do not assume that the absence of separate delivery defeats service.
Sharp Tanks and Structurals Private Limited v. Deputy Commissioner (GST), Madras High Court, reported September 17, 2025 The reported passage discussed whether uploading an order summary communicated the detailed order in the circumstances before the court. Read the reported decision. Identify whether the portal held a summary, the detailed order, or both, and when each became available.
Ganga Jamuna Steel Private Limited v. State of Haryana, Punjab and Haryana High Court, July 27, 2026 The reported decision took a contrary position on whether portal-only upload established service in the cases before that court. Read the reported decision. Local precedent and the facts of the particular proceeding may alter how a portal-only service argument is assessed; check the decision’s full reasoning and current status.

These decisions address particular records, proceedings, and legal arguments. Their dates and outcomes do not show that every upload is valid service, that no upload can be service, or that a summary always does or does not communicate the underlying order. Confirm whether any subsequent decision or appeal has changed the position relevant to your jurisdiction before relying on a case.

Choose a protective next step based on the document and risk

If the document is an SCN and a reply date is near

Do not leave a requested response unanswered while waiting for a date discrepancy to be resolved. With appropriate advice, consider filing a response within the stated period, identify the conflicting dates and missing or inaccessible items, and state the service objection without assuming that doing so concedes the legal issue. Preserve proof of filing and any request for the complete record.

If the document is an appealable order

Ask an adviser to assess the appeal period promptly using the order, portal records, communications, applicable statutory provisions, and the law in the relevant jurisdiction. If filing is appropriate, do not delay solely because the authority has not clarified its timestamps or because you expect a court to accept a later date. The portal FAQ discusses APL-01 and the copy issue when the order is not uploaded, but a live filing decision requires the actual case record.

If the portal shows only a summary or an incomplete file

Save what is visible, document any inability to access the detailed document, and request the complete notice or order and attachments from the issuing authority. Compare the item’s title, form, and content with the underlying proceeding. A missing document may be relevant to the service dispute, but the effect depends on the facts and governing law.

If multiple deadlines appear

Do not assume a payment, hearing, reply, and appeal date are interchangeable. Match each date to the action it governs and obtain advice on which statutory clock applies. If the earliest plausible deadline is close, the safer practical course is to act promptly while preserving the argument about service or communication rather than relying on a hoped-for later date.

  1. What document is dated? Is it the SCN, a prescribed summary, the detailed order, or a portal entry?
  2. What action is at stake? Is the deadline for a reply, hearing, first appeal, payment, or a Tribunal appeal?
  3. What service evidence exists? Compare the portal timestamp and accessibility, email or SMS, physical delivery, and any other communication. Section 169 recognizes multiple modes.
  4. What law and precedent apply? Check the statutory provision and decisions relevant to the state, proceeding, and specific distinction between summary and full document.
  5. How urgent is the risk? If a deadline may be close, take advice and assess protective action now; do not wait for a clarification request to be answered on the assumption that time has paused.

There is no single date-selection shortcut that fits every GST notice or order. The strongest assessment is one that ties the correct document and statutory purpose to a documented chronology, the applicable service method, and current jurisdiction-specific law.

What to give a GST adviser

For a focused review, assemble the full SCN or order, each DRC summary and attachment, screenshots of the portal entry and timestamp, original downloadable files, emails and headers, SMS or postal evidence, your chronology, and all stated deadlines. Include any clarification request and reply. Ask specifically which proceeding is involved, what communication date may govern the limitation calculation, whether the local High Court has relevant authority, and what step should be taken before the nearest plausible deadline.

This is general procedural information, not a determination of the controlling date in an individual dispute. The statute, the actual record, the relevant jurisdiction, and the current status of applicable decisions all matter.
