If an online order is late, cancelled, or marked “delivered” but you cannot find it, save the order confirmation, promised dates, tracking details, payment record, and every message first. Then contact the seller with a specific request: a confirmed shipment date, a full refund, or an investigation into the delivery. If the seller does not resolve the problem, escalate promptly to the carrier and your payment provider. The exact legal protections below are for U.S. purchases; other countries have different consumer rules.
Start with a 10-minute evidence checklist
Before deleting emails or relying on a phone conversation, create a record of what happened. Download or screenshot:
- The order confirmation, item description, price, taxes, shipping fee and promised shipping or delivery date.
- The order number and tracking number, including the carrier’s complete status history.
- Your card or bank statement showing the charge, or the payment receipt from a digital wallet.
- Seller emails, chat transcripts, cancellation notices, delay notices and any promised refund date.
- Carrier notices, delivery photographs, signature records, pickup instructions and case numbers.
The Federal Trade Commission (FTC) recommends keeping order records and communications. They establish what the seller promised and support a payment dispute if the seller does not fix the problem.

These categories matter. A seller’s failure to ship is not the same as your request to cancel, and a delivery scan is not proof that you personally received the package.

If the order is delayed or has not shipped
Compare the promise with the current status
Read the order confirmation carefully. Separate the promised shipping date (when the merchant should hand it to the carrier) from the estimated delivery date (when the carrier is expected to deliver it). Check whether the status says “processing,” “label created,” “shipped,” or “in transit.” A label-only scan may mean the carrier has not received the parcel.
Ask for a definite remedy
Send the seller a written message containing the order number, the missed date and the outcome you want. For example: “Order 1234 was promised for shipment by June 10. Please confirm a firm ship date, or cancel the order and issue a full refund to my original payment method.” Keep the reply and the time you sent it.
Know the U.S. shipment-delay rule
For a covered U.S. transaction, the FTC says a seller must ship within the time it promised. If no shipping time was stated, the default is generally 30 days. When the seller cannot meet that deadline, it must send a delay notice and give you a choice to accept the delay or cancel for a full refund. A seller cannot simply replace that required refund with store credit when it has not shipped the order.

For a definite delay of up to 30 days, an FTC business guide says silence may count as agreement when the notice satisfies the rule. The safer consumer action is to respond explicitly: accept the revised date in writing or cancel in writing. For an indefinite or longer delay, and for a second or later delay, the seller must obtain your consent rather than treating silence as acceptance.

Escalate when the notice or refund is missing
If the seller does not respond, keeps moving the date, or refuses the cancellation, send one concise follow-up identifying the promised date and the remedy requested. Do not wait indefinitely if a payment-dispute deadline could expire. Preserve the delay notice, your cancellation request and any refund confirmation while you contact the payment provider.
If the seller cancels your order
Save the cancellation email or account notification and check your statement. A pending authorization may disappear automatically, while a completed charge requires an actual reversal. When a seller cancels because it cannot fill an order promptly, FTC guidance says it must notify you and promptly refund the payment.
If the charge remains, write to the seller with the cancellation reference and ask when the original payment will be reversed. Request confirmation of the refund amount and destination, not merely a promise of “store credit.” If the seller does not correct the charge, contact the card issuer or bank promptly and provide the cancellation notice and payment record. The available remedy depends on the payment method.
If you want to cancel an order
A customer-requested cancellation is different from a seller’s failure to ship. Review the merchant’s cancellation window, made-to-order terms and return policy, then submit the request through the seller’s stated channel as soon as possible. Include the order number and ask for written confirmation.

Do not assume that every order can be cancelled after checkout or that the FTC shipment rule guarantees a cancellation for any reason. If the seller has already shipped, the issue may become a return or refusal-of-delivery question governed by the seller’s terms. Keep the cancellation request even if the seller says it is too late.
If tracking says “delivered” but the package is missing
Inspect the official tracking record
Open the carrier’s own tracking page rather than relying only on a retailer status. Record the delivery date and time, stated location, photograph, signature name and any note such as “left in locker” or “available for pickup.” A scan can be attached to the wrong address, posted before the actual drop-off, or accompanied by a safe-location instruction.
Search likely delivery locations
Check the porch, side and rear entrances, garage, parcel locker, reception desk, mailroom and any location where drivers normally leave packages. Ask household members, neighbors, building staff and a nearby leasing or security office. USPS says a carrier may place an item in a safer location; its tracking guidance also directs customers to look for a notice identifying a post office or hold.
Follow a carrier notice or hold instruction
If the carrier left a notice, follow its pickup or redelivery instructions exactly. For USPS, use the tracking and missing-mail guidance associated with the service. USPS says an item missing for at least seven days may qualify for a Missing Mail search request, but eligibility and claim procedures depend on the mail class and service used. That seven-day condition is specific to the USPS guidance; do not apply it automatically to another carrier.

Contact the carrier and seller together
Open a carrier inquiry when the tracking details do not explain the delivery. Then contact the seller promptly, even if the carrier says the scan is complete. Give the order number, delivery scan, address and carrier case number, and state plainly that you did not receive the parcel. Ask the seller to investigate with its shipping account or provide the remedy required by its terms. Keep every response.
A delivered scan does not by itself settle your consumer rights. Responsibility can depend on the seller’s contract, delivery instructions, the carrier’s evidence, the payment method and the law where you bought the item.

Credit-card timing and procedure
For a qualifying credit-card billing error, send the dispute in writing to the address designated for billing inquiries or disputes, not merely to the merchant’s customer-service address. The FTC says the issuer generally acknowledges the dispute within 30 days and resolves it within two billing cycles, and no more than 90 days, unless it resolves sooner. Pay the undisputed portion of your bill while the investigation is pending.

Do not call every merchant refund request a “chargeback,” and do not assume the issuer will decide in your favor.

Debit-card timing
A debit-card transaction draws directly from a bank account, so the protections and deadlines differ from credit-card billing-error procedures. The FTC cautions that a refund for non-delivery may not be available under the same statutory protections. Contact the bank promptly; waiting for a seller’s promised response can reduce your options under the bank’s agreement.
A practical escalation sequence
- Document: Save the confirmation, dates, tracking, payment record and communications.
- Ask the seller: State the problem and request a firm shipment date, full refund, replacement investigation or other specific remedy.
- Open a carrier case when appropriate: Use the official tracking or missing-mail process and record the case number.
- Set your own deadline: Give the seller a reasonable, clearly stated response date, without allowing a payment-dispute deadline to pass.
- Contact the payment provider: Ask which written dispute route and deadline apply to your card, bank account or wallet.
- Organize the file: Keep a timeline with dates, names, reference numbers, promised actions and refund amounts.
Common mistakes that make resolution harder
- Relying on a retailer’s status page without opening the carrier’s complete tracking record.
- Accepting a vague “wait a few more days” answer instead of requesting a definite date or refund.
- Deleting the order confirmation or cancellation notice after a phone call.
- Assuming a seller cancellation, a buyer cancellation and a carrier loss have identical rules.
- Waiting for the seller while a credit-card dispute deadline approaches.
- Disputing the entire statement instead of continuing to pay amounts unrelated to the missing order.
- Treating a delivered scan as conclusive without checking safe locations, lockers, notices and neighbors.
What the available scam statistic does—and does not—show
The FTC reported that online shopping scams were the second-most-reported scam type in 2022, in a 2023 publication. That is a count of scam reports, not a delivery-failure rate and not the percentage of ecommerce orders that arrive late or go missing. It should not be used to estimate how common a particular carrier or seller problem is.
When the problem is resolved
Confirm that the refund has actually posted to the original payment method, not merely that the seller marked it “processed.” For a replacement, verify the new tracking number and promised date. Close carrier and payment cases only after the credit, delivery or other agreed remedy appears in your records. Keep the complete file with your statements in case the same charge reappears.
