Act in this order: stop further access, preserve evidence, assess what was exposed and who may be harmed, secure any compromised accounts or keys, then obtain jurisdiction-specific advice about notification. Do not wait for a complete forensic picture before disabling a public link or pausing a risky integration. At the same time, avoid destroying logs or other evidence. An AI exposure can be a provider-side incident, a compromised account, or an accidental disclosure by a user; the correct remedy depends on which happened.
This guide applies to consumer and workplace AI tools, including chatbots, document assistants, coding agents and connected integrations. It cannot determine your legal duties without your location, role (such as controller, processor or individual), the data involved and the facts of the incident.
First response: the sequence that limits damage
- Contain access. Turn off a public conversation or file link, remove an improperly posted output, restrict sharing permissions, revoke an exposed integration, or pause the connection that is sending data. Ask the provider to help block access. For a business, coordinate with the security or incident-response lead. The Federal Trade Commission (FTC) advises removing improperly posted information from the web and checking whether other sites saved copies; the Australian Information Commissioner (OAIC) likewise starts with containment and prompt assessment. FTC data-breach response guidance · OAIC four-step response
- Preserve evidence. Save the URL, screenshots, timestamps, relevant prompts and outputs, access-control settings, audit logs, provider notices and correspondence. Record every containment action and who approved it. The FTC’s instruction is direct: “Do not destroy evidence.”
- Assess scope and likely harm. Identify the data categories, approximate volume, affected people or organizations, exposure window, possible audience, evidence of access or copying, and whether caches or reposts still exist. Judge consequences, not merely whether a page was public.
- Secure accounts and credentials. Change an exposed or reused password, end active sessions, review security history, rotate API keys and follow the provider’s official incident process. These steps stop continuing access; they cannot retract information already viewed or copied.
- Escalate and decide on notifications. Businesses should involve incident-response, security, privacy, legal and communications owners as appropriate. Notification depends on jurisdiction, risk and organizational role; never treat one country’s deadline as universal.
Identify what kind of AI exposure occurred
Classifying the event prevents the wrong fix. A service-provider breach may affect many customers and require provider-led investigation. An account compromise means an attacker used your credentials, session or API key. Accidental sharing occurs when a person makes a prompt, file or link available to the wrong audience. More than one category can apply.

| Event type | Typical sign | Immediate focus |
|---|---|---|
| Provider incident | The vendor reports unauthorized access, or unrelated users can see your data without your sharing it. | Obtain the provider’s incident details, preserve notices and determine which records and dates are affected. |
| Account or credential compromise | Unknown logins, changed settings, unfamiliar sessions, or an API key used by someone else. | Reset credentials, revoke sessions and keys, inspect logs, and investigate persistence. |
| Accidental sharing | A public link, workspace permission, prompt, attachment or generated output was sent to the wrong people. | Disable access, remove the material, identify recipients and request deletion where practical. |
| Integration or automation leak | A connector, plug-in or workflow sends business or personal data to an unintended model or destination. | Pause the integration, revoke tokens, map data flows and correct permissions before restarting. |
Contain the exposure without losing the trail
Public links, files and outputs
Disable link sharing or change the item to private before investigating. Remove the file or output from the AI workspace and any destination to which it was automatically posted. Search the web and relevant repositories for copies, because deletion from the original page does not remove caches, screenshots, downloads or reposts. Ask site operators to remove copies and document each request. Do not promise that deleting a conversation removes provider logs, backups or other people’s copies; confirm retention and deletion behavior in the affected service’s official documentation.

Compromised integrations
Pause the connector or workflow, revoke its authorization token and stop scheduled jobs. Preserve configuration and access logs before changing settings where doing so is safe. List every system that received data during the exposure window, including ticketing, storage, messaging and analytics destinations. Re-enable only after least-privilege permissions and a tested data boundary are in place.
Provider coordination
Open a support or security case through the provider’s official channel. Give the incident time range, account or workspace identifier, affected links, data categories and actions already taken. Request confirmation of containment, affected tenants, access logs, retention status and whether the provider has found copies or onward disclosure. Keep the case number and all replies in the incident record.
Preserve evidence and create a factual incident record
Create a timeline as soon as the exposure is discovered. Include who noticed it, the exact date and time with time zone, the service and feature involved, the first and last known exposure time, affected files or conversation links, sharing settings, potential viewers, and every containment step. Preserve screenshots that show permissions and content, exported audit logs, identity-provider alerts, provider tickets, email headers and relevant code or configuration versions.

Limit editing of original evidence. Store copies with access controls and record who collected each item. If a business has an incident-response policy, follow its chain of custody and retention rules. A clean factual record supports technical investigation, regulator communications, insurance claims and explanations to affected people.
Assess data, audience and likely harm
Map what was exposed
- Classify the content: credentials and API keys, identity and contact details, financial or health information, confidential business plans, source code, customer records, intellectual property or ordinary public material.
- Estimate the number of records and people, and note whether data was linked to names or identifiers.
- Determine the exposure window, intended audience, actual access evidence, downloads, screenshots, indexing and reposts.
- Check whether the information is current, reversible, encrypted, protected by another control or already publicly known.
Evaluate consequences
Assess seriousness and likelihood for each affected group. The UK Information Commissioner’s Office (ICO) gives a useful contrast: a customer database that could enable identity fraud calls for a different response from a staff telephone list. Consider identity theft, account takeover, financial loss, physical safety, discrimination, blackmail, competitive harm, confidentiality obligations and operational disruption. Record assumptions and unknowns rather than presenting estimates as facts. ICO personal-data-breach guidance
Secure accounts, sessions and API keys
If an account, password, session cookie or API key may be exposed, use the service’s official security instructions immediately. For OpenAI accounts and API keys, current guidance says to contact support promptly, change an exposed or reused password, review security history, log out active sessions and rotate API keys. Apply the equivalent controls in other services, but verify their exact paths and recovery requirements in their support documentation. OpenAI account-security guidance

Business escalation and specialist help
Nominate one incident owner and bring in security, privacy, legal, communications, IT and the business owner of the affected data as needed. The FTC recommends forensic investigators to establish source and scope and privacy or data-security counsel to advise on applicable laws. Independent forensics can be valuable when logs conflict, an attacker may still have access or the exposure crosses several systems. Counsel can preserve legal privilege where appropriate and coordinate regulator or customer notices.

Separate confirmed facts from hypotheses in internal updates. Share sensitive incident details only with people who need them, and tell staff not to speculate publicly or delete messages. If a supplier operates the AI service, require its incident contact to explain its controller or processor role, affected systems, containment, evidence preservation and planned updates.
When notification may be required
There is no worldwide AI-breach deadline. The answer turns on the applicable law, the organization’s role, the data and people involved, and the likelihood and severity of harm. Obtain local advice before deciding that notice is unnecessary.

European Union GDPR
Under the European Commission’s GDPR overview, a controller must notify the supervisory authority without undue delay and, where feasible, within 72 hours of becoming aware of a personal-data breach when it is likely to pose a risk to individuals. Affected people must be informed when the breach is likely to result in a high risk, subject to exceptions. A processor must notify the controller without undue delay. The 72-hour period is an EU rule with a risk threshold, not a general deadline for every country or every AI exposure. European Commission GDPR obligations · GDPR text
Australia and other jurisdictions
OAIC describes a general response sequence as “contain, assess, notify and review.” Whether notification is required, to whom and by when depends on the applicable Australian scheme and facts. Other countries, states and sectors impose different triggers and deadlines. A multinational business should map each affected person’s jurisdiction and consult the relevant regulator or counsel rather than applying the EU rule by analogy. OAIC response steps
Communicate clearly if notice is appropriate
A useful notice states what happened, when it happened or was discovered, what information was involved, what has been contained, what the recipient can do now, and how to contact your organization. Avoid claiming that no one accessed the data unless logs support that conclusion. Explain uncertainty plainly and provide updates when facts change. Do not include exposed credentials, private records or technical details that would create a new risk.

For personal users notifying an employer, customer or colleague, describe the specific link, file or prompt, the access window and the steps already taken. Ask recipients not to forward or save the material and to confirm deletion where appropriate. Preserve their responses as part of the incident record.
Review controls and prevent a repeat
Find the route into the AI tool
Trace whether data entered through a prompt, upload, browser extension, plug-in, API, shared workspace, automated workflow or provider-side defect. Identify the owner and business purpose for each route. Remove unnecessary connectors and block unapproved tools from receiving regulated or confidential data.
Reduce permissions and retention
- Use private-by-default sharing and short-lived links.
- Apply least privilege to workspaces, service accounts, plug-ins and API scopes.
- Set retention and deletion controls that match contractual and legal requirements, then verify what remains in logs and backups.
- Require approval for exports, public publishing and training or feedback features that may reuse submitted content.
- Monitor access and alert on unusual downloads, sharing changes, token use or large prompts.
Improve people and process
Train staff to remove unnecessary personal and confidential details, use approved workspaces and verify recipients before sharing. Maintain an AI-specific incident playbook with provider contacts, evidence steps, decision owners and jurisdictional escalation paths. Test it with a tabletop exercise. After the incident, document root causes, corrective owners and due dates, and verify that fixes work before closing the case.
Practical checklists
For an individual
- Disable the public link or delete the shared item.
- Ask the service provider to investigate and confirm containment.
- Save screenshots, URLs, timestamps and provider correspondence.
- Change reused passwords; end sessions; rotate exposed keys.
- Search for cached or reposted copies and request removal.
- Tell affected people or your employer when safety, financial or confidentiality risks justify it.
For a business
- Activate the incident process and appoint an owner.
- Contain access while preserving logs and chain of custody.
- Map data, people, systems, jurisdictions, roles and likely harms.
- Engage forensics and privacy counsel when scope or legal exposure is uncertain.
- Document the notification analysis, including reasons for notifying or not notifying.
- Correct permissions, integrations, retention and training, then test the changes.
Common mistakes to avoid
- Waiting for certainty before containment: OAIC notes that containment, assessment and notification can happen simultaneously or in quick succession.
- Deleting everything: removal may reduce exposure but can destroy evidence needed to determine scope.
- Assuming deletion is universal: logs, backups, caches and recipient copies may persist; confirm service-specific behavior.
- Treating a provider announcement as your entire investigation: verify which of your records, users and time periods are affected.
- Applying the GDPR 72-hour period everywhere: legal duties vary by jurisdiction and risk threshold.
- Calling every event a “hack”: accidental sharing, credential compromise and provider incidents require different controls.
When to get urgent help
Contact your security team, provider incident channel and qualified legal adviser immediately when exposed data includes passwords, API keys, financial or health information, identity documents, children’s data, safety-sensitive location details, regulated records, trade secrets or a large customer population; when an attacker may still have access; or when the exposure spans countries. If someone faces immediate physical danger or fraud, use the appropriate emergency or financial-institution channel as well as the AI provider process.
