If a video is being used against you, contact a lawyer qualified for your type of case and the jurisdiction as soon as possible. Preserve the exact version you received and its surrounding context, and do not assume that a video is authentic—or fake—just because it looks convincing or a detector flags it. The right response depends on what the video is offered to prove and the rules and deadlines in your proceeding.
What should you do first?
- Contact the right lawyer promptly. Speak with your current lawyer or find one experienced in the relevant type of proceeding in the jurisdiction where it is taking place. Tell them immediately if a hearing, filing, interview, disciplinary meeting, or other deadline is near. There is no universal response deadline or remedy established for every case.
- Preserve the file and how it reached you. Keep the exact video file as received, if possible, along with the email, message, platform post, or other source through which you obtained it. Note when and where you received or saw it, who sent or showed it, and any known transfers or sharing. Do not edit, trim, convert, or re-save your only copy, or submit that copy to a detector or conversion service.
- Let counsel define the issue before responding. Ask what the other side says the video proves, what foundation they offer for it, and how its source and handling can be tested. The concern may be synthetic generation, editing, compression, a misleading clip, mistaken identity, or genuine footage presented with false context.
- Identify material that could confirm or contradict it. Tell counsel about any earlier or original copies, the device or platform source, witnesses, surrounding recordings, available metadata, or other relevant material. Counsel can assess whether a qualified forensic review is appropriate; no single item or technique is guaranteed to settle authenticity.
What exactly is the video being offered to prove?
Separate the recording from the claims about it
Ask counsel to pin down each claim attached to the video: who it supposedly shows, what was said or done, when and where it supposedly happened, and whether the proponent says the file is an original or an accurate copy. These are distinct questions. Showing that a file is what its proponent claims does not by itself establish that every statement about its meaning, timing, or context is true.
Trace its source and handling
Useful questions include where the video came from, how and when it was obtained, who possessed it, where it was stored, and whether it was edited, converted, compressed, or otherwise processed. Counsel may also consider whether another source can corroborate it, what technical information supports the claim of authenticity, and whether a qualified expert can explain the methods and handling.
A filename, timestamp, metadata field, or hash may be relevant to an investigation, but none should be treated on its own as proof that a recording is genuine or unaltered. The U.S. Courts committee material raises source, acquisition, custody, storage, alteration, corroboration, forensic methods, metadata, and expert explanation as topics for evaluating a recording; it is not a binding checklist or a finding that any particular technique detects fabrication.

How do U.S. federal evidence rules address authenticity and experts?
Authentication under Rule 901
For most U.S. federal proceedings, Federal Rule of Evidence 901(a) requires the proponent to produce evidence sufficient to support a finding that an item is what the proponent claims it is. Rule 901(b) gives nonexclusive examples, including testimony from a knowledgeable witness, distinctive characteristics considered in context, and evidence describing a process or system that produces an accurate result. This does not mean every video requires a forensic expert, and authentication is not a ruling that every inference drawn from the video is correct.
Expert testimony under Rule 702
If expert testimony is offered in a federal proceeding, Rule 702 requires the proponent to show, among other things, that the expert’s specialized knowledge will help the factfinder, that the testimony rests on sufficient facts or data and reliable methods, and that the expert reliably applied those methods to the case. It does not guarantee that an expert can determine whether every video is fake, or that a detector can give a definitive answer.

Does a proposed deepfake rule change apply?
Do not treat discussion of a possible deepfake-specific change to Rule 901 as law in force. The U.S. Courts committee agenda material discusses possible approaches, including a proposed special provision; that discussion is not itself a binding rule. The official federal current-rules page states that the Federal Rules were last amended in 2024. The federal rules cited here describe most U.S. federal proceedings, not every state court or another country. Which rules, procedures, and deadlines apply depends on the forum, case type, and stage of the matter.
