If police stop you because a license plate reader flagged your car, prioritize safety at the roadside; once you are safe, document what happened and ask the agency what alert or record prompted the stop. A reader can misread a plate, and the information behind an alert can also be incorrect or out of date. What officers verify, what records you can obtain, and how to challenge an error depend on the agency and local law.
During the stop, put safety ahead of resolving the alert
- Pull over when it is safe. Keep your hands visible, avoid sudden movements, and follow lawful directions. Do not turn a disagreement about the camera or its alert into a roadside confrontation.
- Speak calmly and avoid guessing about the record. You can ask what prompted the stop, but you may not get a full explanation at the roadside. The ACLU’s general guidance discusses the right to remain silent about matters such as where you are going; the rules and circumstances can vary, so this is not a guarantee about how a particular encounter will proceed. Calm conduct cannot ensure that an officer will respect asserted rights or that the encounter will be safe. Read the ACLU’s general guidance for police stops.
- Do not reach for your phone just to record. ACLU guidance says people may record events plainly visible in public spaces if they do not interfere or obstruct. That general guidance is not a guarantee that every recording action or device is lawful in every setting. If recording could distract from instructions or create a safety risk, leave it alone.
Why an alert can be wrong
A license plate reader (also called an automated license plate reader, or ALPR) captures an image and uses software to read the plate. Errors can originate in the image-reading process or in the records checked against the read. For example, the software may confuse characters; a read may be associated with the wrong vehicle description; a hot-list entry may be stale; or a person may have entered incorrect information. A secondary catalog lists reported incidents described as camera misreads, stale hot-list entries, and incorrect officer data entry, but those examples do not establish how often any error occurs. See the case catalog.
Local procedures are not national rules. Murrieta, California, says its program checks plates against hot lists, sends matches to dispatch and patrol officers, and requires officers to verify hits through CLETS and visually confirm the plate before enforcement. That describes Murrieta’s stated process, not what every agency does. Its page also says an unmatched image is deleted after 30 days unless it becomes evidence. See Murrieta’s ALPR program description.

After you are safe, make a record of the encounter
As soon as practical, write down what you remember while details are fresh. Separate what you personally saw or heard from what you later learned.

Ask the agency what alert or record prompted the stop
Use the agency’s published non-emergency or records contact channel after the encounter, rather than trying to settle a dispute in traffic. Identify the date, time, location, and incident or citation number if you have one. You can ask for:

- The incident report and any dispatch record associated with the stop.
- Whether an ALPR image, alert, query log, or relevant body-camera footage exists and is retained.
- What plate and vehicle details officers checked before acting on the alert.
- Which underlying record or reporting agency caused the match, and how to ask that source to correct it if it was wrong.
- How to submit a records request or complaint under that agency’s process.
Access and retention rules differ by jurisdiction, and an agency may not release every record. Murrieta says its ALPR data is generally confidential and public-record requests are reviewed case by case; that is one local policy, not a nationwide disclosure rule. An inquiry also does not guarantee that a record will be corrected or that a future stop will be prevented. Murrieta’s page explains its local records approach.
Get local legal help when the consequences are serious
Consider speaking with a lawyer licensed where the stop occurred if it led to an arrest, citation, search, injury, property damage, extended detention, or an ongoing investigation. A lawyer can assess the actual facts, local rules, and any deadlines that apply. Complaint channels, records remedies, and filing deadlines vary; there is no universal process or remedy established here.

The available sources do not establish a national ALPR error rate or settle whether a particular alert can justify a stop. Treat claims about error frequency cautiously: the ACLU campaign page displays a “1-in-10” figure for Flock readers but links it to a secondary article, and the underlying study scope was not verified here. It should not be read as a general error rate for all plate readers. See the ACLU campaign page.
