Do not assume that a casino “flag” is one specific kind of ban. Ask for the decision in writing, identify who issued it and what places or activities it covers, then use the review route for that particular decision in your jurisdiction. Until the issuer or relevant authority confirms otherwise, treat the restriction as active and do not try to enter or gamble.

First find out what decision was made

“Flagged as a problem gambler” is not a precise legal category. It could refer to a formal exclusion order, a casino’s withdrawal of your licence to enter, a self-exclusion arrangement, an account restriction or another venue ban. Those actions can have different issuers, scopes and review routes.

Contact the casino through an official channel and request a copy of the notice or order. Ask it to confirm in writing:

  • What kind of restriction was imposed, and who issued it?
  • What reason, facts or policy basis does the decision give?
  • When did it begin, how long does it last, and what venues, areas or activities does it cover?
  • How can you request review, what is the deadline, and does the restriction remain in force while it is reviewed?

These are practical questions to clarify the decision, not a claim that every jurisdiction gives patrons a universal right to each detail. New Zealand Department of Internal Affairs guidance for New Zealand exclusion orders says they should generally be clear and simple, and lists the date, venue, issuer, affected person, authorising legal provision and expiry date or duration as useful order details. That guidance is not a universal legal checklist.

Identify the correct review route

The issuer and type of action matter as much as the reason stated. For example, NSW distinguishes a formal exclusion order from a casino’s withdrawal of a licence to enter. The NSW Independent Casino Commission says an exclusion order may be issued by the casino operator, the Commission or the NSW Commissioner of Police; signs of problem gambling are among the possible grounds. A withdrawal of licence is a separate action and may be for a fixed term or indefinite.

New Zealand: exclusion order Check the order and the applicable local process; the Department of Internal Affairs guidance explains order details. The guidance does not establish a universal appeal route for other countries or every type of restriction.

These examples are jurisdiction-specific. If your notice does not explain the route, ask the issuer for it in writing and contact the relevant local gambling regulator or consumer complaint body to verify which authority handles that decision. Do not assume that a regulator can reconsider every action taken by a casino.

Prepare a focused challenge

  1. Preserve the records. Keep the notice, emails and messages, relevant account or membership details, and a dated note of calls, including names and what was said. Retain originals without alteration.
  2. Identify the specific error. Explain the factual point you dispute—for example, a possible mistaken identity or incorrect information—and attach records that directly address it. Avoid unsupported claims about why the casino acted.
  3. Use the stated process and deadline. Follow the written instructions. If they are missing or unclear, request clarification before relying on an assumed deadline or appeal route.
  4. Request a written outcome. Ask the reviewer to confirm receipt, tell you whether the restriction remains active during review, and provide the result and reasons in writing. You can also ask the casino to preserve records relevant to its decision.

Please send me a copy of the decision or order and the written review outcome.

Do not return while the restriction may still apply

A dispute or appeal does not by itself mean the restriction has been suspended. Wait for written confirmation from the issuer or relevant authority that it has ended or changed before returning. In NSW, entering or remaining in a casino while subject to an exclusion order is an offence for people under the order, except people who self-excluded. The consequences elsewhere depend on local law and the kind of restriction.
