As of October 4, 2026, the CLARITY Act has not become law: the Senate failed to advance it in a September 15 cloture vote. For crypto investors and businesses, that means the proposed federal market-structure framework remains unsettled—not that every token has a newly determined legal status or that existing agency action has stopped.

What happened to the CLARITY Act?

H.R. 3633, the Digital Asset Market Clarity Act of the 119th Congress, would establish a system for regulating digital-commodity offers and sales involving the Securities and Exchange Commission (SEC) and Commodity Futures Trading Commission (CFTC), among other provisions. That is the bill’s proposed design, not current law. GovInfo’s bill record lists a Senate-reported version and a last-action date of June 1, 2026; neither fact means the measure was enacted.

The Senate’s work produced multiple procedural milestones and text versions. The Senate Banking Committee announced text as the basis for a markup on May 12. Senator Cynthia Lummis later said the bill passed that committee 15–9 in May. On July 22, she announced updated text reflecting merged work products from the Banking and Agriculture committees. Those were developments in the legislative process, not final passage.

On September 15, the Senate voted 49–50 on cloture; 60 votes were needed to advance the measure. The Associated Press reported that ethics safeguards concerning President Trump’s crypto interests were a central Democratic objection. That is reported political context, not proof that it was the only reason senators opposed advancing the bill. The House Financial Services and Agriculture committee chairs said the vote did not remove the need for legislation and that they expected to work with federal regulators in the meantime. As of October 4, the appropriate description is that the bill stalled or failed to advance in that vote—not that it is dead.

What the stalled bill means for investors

No new statutory certainty from this bill

Because the proposed framework has not been enacted, the vote did not itself create a new federal classification system for crypto assets. Nor does the failed vote, by itself, establish that a particular token is a security or a commodity. Legal treatment can depend on the asset, the transaction, and its facts; a headline about the bill cannot resolve an individual investor’s position.

Agency action is separate from the bill

On March 17, 2026, the SEC announced an interpretation joined by the CFTC. It discusses a taxonomy covering digital commodities, collectibles, tools, stablecoins, and securities; when a crypto asset that is not itself a security may become, or cease to be, subject to an investment contract; and the treatment of airdrops, protocol mining, staking, and wrapping. The SEC said the interpretation complements Congress’s effort to codify a market-structure framework. It is an agency interpretation, not passage of the CLARITY Act.

That distinction matters when assessing news or making decisions: regulatory developments do not establish a predictable price response. The available public statements and reporting do not quantify the effect of the stalled vote on prices or establish a reliable forecast of passage. They are not a basis for predicting that a particular token or the broader market should rise or fall.

What the stall means for crypto businesses

Issuers, trading platforms, intermediaries, and other market participants should distinguish between statutory law, agency interpretations, and proposed rules. The House committee chairs said regulators could use existing authorities to develop rules and issue guidance until Congress provides statutory certainty. SEC Chair Paul Atkins has also argued that agency work cannot replace durable legislation.

In practical terms, a business should plan around requirements and guidance actually in force rather than treat the bill’s proposed framework as an authorization or exemption. The questions are especially relevant where a business’s obligations depend on asset classification, transaction structure, or the division of SEC and CFTC responsibilities. The SEC’s March release encourages innovators, issuers, and individual investors to review its interpretation. Neither the stalled bill nor the described agency actions support assuming that registration duties disappear, every jurisdictional boundary is settled, or a particular business model is authorized.

How to distinguish the bill from agency developments

Development Date and source What it means
H.R. 3633, the CLARITY Act 119th Congress; GovInfo lists a Senate-reported version and a last-action date of June 1, 2026 Proposed statutory framework for digital-commodity offers and sales involving the SEC and CFTC, among other provisions; not enacted.
Senate Banking Committee process May 12 text announcement; Senator Lummis reported a 15–9 committee vote in May; updated text announced July 22 Legislative and draft-text milestones, not final passage.
Senate cloture vote September 15, 2026; Associated Press reported 49–50, with 60 votes required to advance The bill failed to advance on that vote; it did not itself determine the legal status of individual assets.
SEC/CFTC interpretation SEC announcement, March 17, 2026 An agency interpretation addressing asset categories and transactions; separate from the statute Congress had not enacted.
SEC Chair’s proposed exemptions and safe harbor Atkins statement, August 18, 2026 Proposals described by the Chair, not enacted CLARITY Act provisions or operative entitlements.

What the SEC proposals do—and do not—establish

In an August 18 statement, SEC Chair Paul Atkins said legislation remained indispensable to durable, “future-proofed” rules. He also described proposed SEC rules that included a startup exemption for offerings up to $5 million during a four-year period, a fundraising exemption for up to $75 million each year, and an investment-contract safe harbor subject to conditions.

What to watch next

  • Legislative status: Check for subsequent Senate action and the current GovInfo record before relying on the October 4 status snapshot. A failed cloture vote is not enough to call the bill permanently dead.
  • Which text is being discussed: Identify whether a report refers to the House bill, Senate-reported text, a committee work product, or a later version. The May and July milestones involved different points in the process.
  • What kind of government action it is: Separate enacted statutes from agency interpretations, proposed rules, and final rules. Their legal status and effect are not interchangeable.
  • Specific facts and activities: Investors and businesses should avoid treating a general bill update as a conclusion about a particular asset, transaction, platform, or compliance obligation.
