There is no universal data inventory for an AI teaching system. The information collected depends on the product, its settings, the district’s deployment and contract, and how teachers and students use it. A system may receive information that a student deliberately enters—such as a prompt, essay or answer—and may also generate records about activity, performance or account use. Districts should identify every data element and collection method in writing before approval, limit use to an educational purpose, and set enforceable rules for access, security, retention, deletion and family notice.

What student data do AI teaching systems collect?

The categories below are a verification checklist, not a claim that every AI product collects all of them. The U.S. Department of Education’s guidance on online educational services tells schools to ask what a provider collects, including information submitted through forms, technical logs, cookies and tracking pixels. Generative-AI features make it especially important to ask whether prompts, uploaded work and the system’s outputs are stored or reused.

Category to check Examples a district should look for Questions for the provider and contract
Identifiers and account data Student name or identifier, school or class, account credentials and contact details Which fields are mandatory, and can the district use a directory identifier instead of a full name?
Student inputs and work Prompts, chat messages, uploaded documents, answers, essays, code, images, audio or video Are inputs retained, reviewed by people, shared with subprocessors or used for model training or product improvement?
Technical logs and tracking Forms, event logs, cookies, tracking pixels, device or browser information, IP address and timestamps Which technologies run in the student interface, what do they record, and can optional tracking be disabled?
Records returned or created by the service Generated explanations, scores, feedback, recommendations, labels, reports and teacher dashboards Who owns these records, how can an authorized user correct them, and are they placed in an education record?
Usage and learning-performance data Activities attempted, time or frequency of use, completion, accuracy, progress and inferred skill levels What is measured, for what purpose, and how are inferences prevented from becoming unauthorized profiles?

Do not assume that a “free” or click-wrap service collects less information. The Department recommends routing every online service, including free tools, through school or district approval. A teacher considering an application should first check with school or district administration, as the Department’s Privacy Technical Assistance Center states in its online-tool FERPA FAQ.

Why prompts and AI outputs need special scrutiny

A student’s prompt can reveal a disability, family circumstance, disciplinary issue, political or religious belief, or other sensitive context even when the student did not intend to submit a formal school record. An uploaded draft may contain names or information about classmates. The service may then create a score, proficiency estimate or behavioral label that teachers can see. Those records can become part of the district’s education-record environment, while other telemetry may sit outside it. The contract and actual workflow must distinguish these situations instead of treating “AI data” as one undifferentiated category.

Product-specific answers about model training cannot be inferred from the word “AI.” Some services may retain inputs for operations, analytics, safety review or product improvement; others may offer a setting or contractual promise not to do so. Require the vendor to state, for each input and output, whether it is stored, for how long, where it is processed, who can access it, and whether it is used to train or tune any model. The available federal guidance does not establish those practices for an unnamed product.

When FERPA covers a vendor relationship

FERPA is not a blanket approval for educational software. Under the school-official exception, a vendor must perform a service the school or district would otherwise use its own employees to perform; remain under the school’s direct control regarding the use and maintenance of education-record personally identifiable information; follow the school’s annual rights notice; and avoid using or redisclosing the information for unauthorized purposes. The district must determine whether the particular institution, records and contract satisfy those conditions.

The Department explains privacy and data-sharing requirements in its Privacy and Data Sharing guidance. A district should document the FERPA basis before students use the system, identify the education-record fields involved and prohibit secondary uses that are not authorized. Private K–12 schools may not be covered in the same way as federally funded institutions, so they need a separate legal analysis rather than assuming the public-school framework applies.

A district approval workflow that works before classroom use

  1. Define the instructional need. Ask the requester what learning problem the system solves, who will use it, when it will be used and for how long. Identify the age groups, courses and staff roles.
  2. Require evidence of benefit. Collect the evidence the vendor provides and decide how the district will measure learning value. A polished demonstration is not evidence that the tool improves student learning.
  3. Inventory the service. Record the product name, version or edition, deployment date, schools, integrations, administrator and data flows. Add it to the district’s inventory of online educational services.
  4. Read all governing documents. Review the privacy policy, terms of service, data-processing addendum, security documentation and any click-wrap screen. Preserve the version approved by the district.
  5. Map each data element. List identifiers, prompts, work, outputs, logs, cookies, tracking pixels, usage metrics and inferences. Note whether each item is required, optional, student-entered or generated by the service.
  6. Set permitted purposes. State that data may be used only for the specified instructional and administrative functions. Address analytics, safety review, advertising, model training and product improvement explicitly rather than relying on a general “service operation” clause.
  7. Confirm the FERPA arrangement. If education-record PII is involved, document the school-official-exception conditions or another applicable basis, the district’s direct control and the prohibition on unauthorized use or redisclosure.
  8. Control access and sharing. Define district, teacher, student, parent, vendor-support and subprocessor access. Require a current list of subprocessors and notice before a material change.
  9. Specify lifecycle rules. Set retention periods for raw inputs, outputs, logs, backups and support tickets. Require return or secure deletion when the purpose ends, and require a process for deletion requests and legal holds.
  10. Plan for incidents. Assign who receives a breach notice, the deadline and contents of the notice, investigation duties, evidence preservation, remediation and cooperation with regulators and affected families.
  11. Explain the practice to families. Publish what is collected, why, with whom it is shared, how it is protected, how long it remains and how families can ask questions or exercise available rights.
  12. Review and renew deliberately. Recheck the tool’s actual learning value, data practices, subprocessors, settings and legal requirements at renewal or when the product changes. Suspend or discontinue it when the evidence or terms no longer support use.

Contract terms that protect student information

A contract should turn the district’s expectations into obligations that survive a product update. The Department’s Protecting Student Privacy While Using Online Educational Services guidance recommends addressing collection, access, disclosure, security, retention, archival and deletion. For an AI system, the schedule should also identify prompts, uploads, generated outputs and model-related uses.

  • Data definition: enumerate fields and collection mechanisms, including forms, logs, cookies and tracking pixels.
  • Purpose limitation: permit only named educational services and prohibit advertising, sale, profiling or unrelated model development unless the district has expressly authorized a lawful purpose.
  • District control: give the district control over education-record PII and require the provider to follow district instructions.
  • Disclosure: list subprocessors, locations and categories of recipients; require approval or notice for additions.
  • Individual rights: provide practical access, correction and export procedures for authorized students, parents and school officials.
  • Security: describe administrative, technical and physical safeguards, account management, encryption expectations and staff confidentiality duties.
  • Incident response: define rapid notification, cooperation, containment, investigation and cost responsibilities without promising a result the contract cannot deliver.
  • Retention and deletion: state time limits for live systems, backups and derived profiles, and require written deletion or return certification.
  • Change control: require notice and review before a new feature, tracking technology, subprocessor or data use becomes active.

Security controls and breach readiness

FERPA does not prescribe a particular security technology. The Department nevertheless warns that security threats pose a significant risk to student privacy and advises institutions to take appropriate steps to safeguard records in its Data Security: K–12 and Higher Education guidance. A district can translate that principle into least-privilege accounts, single sign-on with strong administrator controls, timely removal of departing staff, audit logs, secure configuration, vendor access reviews and tested incident procedures.

Minimize what reaches the service. Use a district identifier where a name is unnecessary; avoid pasting sensitive narratives into open-ended prompts; configure role-based visibility; and teach students not to enter health, financial, family or other private information unless the approved lesson requires it. These practices reduce exposure but do not replace contractual controls or a vendor’s security obligations.

Family transparency, COPPA and other laws

Families should be able to understand collection, sharing, safeguards and use even when a data element might not be covered by FERPA. Explain the service in plain language, identify the school contact, and provide the district’s process for questions, access and correction. Keep the notice aligned with the actual settings; a generic statement that the district “may use technology” is not enough for an AI feature that stores prompts or produces student profiles.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Department flags the Children’s Online Privacy Protection Act (COPPA) for online services used by children under 13. Whether a school may provide consent, what notice is required and which entity is responsible depends on the service and circumstances. State, tribal and local student-privacy, consumer-protection and breach-notification laws may add requirements. Check the law that applies to the actual students, institution and data flow; FERPA alone does not resolve every question.

How to compare two AI teaching systems

Use the same written questions for every candidate so a persuasive demonstration does not obscure a weaker privacy posture.

Common failure modes and practical fixes

A teacher signs up first and asks later

Fix: make approval a prerequisite, including for free tools. Provide a short intake form that captures instructional purpose, users, duration and the exact service URL, then block unapproved accounts where technically feasible.

A vendor changes a feature or adds a subprocessor

Fix: require advance notice, a district review window and the ability to disable or terminate the affected service before the new practice begins.

The tool is popular but does not improve learning

Fix: set a review date and success measures at approval. Reconsider the deployment when evidence, instructional need or screen-time costs do not justify continued collection.

A breach plan exists only on paper

Fix: assign named contacts, exercise the notification path, preserve logs and rehearse account shutdown, family communication and vendor cooperation.

Limits of a federal-guidance approach

Federal Department of Education guidance provides a practical framework, not product-specific legal advice. The 2014 online-services document predates widespread generative AI, so districts should apply its vendor-review principles to current features and verify current law, settings and contract language. The decisive facts remain the actual product, deployment, students, institution and agreement.
