For ordinary job placement in the United States, a legitimate recruiter or placement firm typically gets paid by the hiring company—not by you. Be especially wary of an advance fee or any payment tied to a promised interview, job offer, or employment. A separate career service you choose to buy, such as résumé writing, is a different transaction; its scope, price, and terms should be clear in writing.
What should you pay a recruiter?
Usually, nothing for the placement itself. The Federal Trade Commission (FTC) says hiring companies typically pay placement firms to find qualified candidates, and advises job seekers to walk away if a placement firm asks them for a fee—especially one due in advance. The FTC’s guidance is consumer advice, not a universal statement of law for every location or worker category.
In particular, do not pay to be considered for a job, receive a referral or interview, or secure a promised position. The FTC’s guidance is direct: “Don’t pay for a job or the promise of employment.” Read the FTC’s employment-scam advice.
When might a job seeker pay for a separate service?
You may choose to hire a provider for career help that is not placement, such as résumé writing, executive counseling, or access to job listings. The FTC has described these as services that some legitimate firms have charged for, but that historical observation does not establish that a particular current offer is trustworthy. Nor does a service fee make a promise of a job legitimate.

Before agreeing, make sure you are buying a specific service you want—not paying a disguised placement fee. Ask for the terms in writing and check:
- What concrete service or deliverable is included?
- What is the total price, and when is payment due?
- Who is responsible for paying: you or the hiring company?
- Is payment contingent on an interview, offer, or placement?
- What is the refund policy, and are all verbal promises included in the contract?
North Carolina’s Department of Justice recommends checking the service, cost, contract, and refund terms, and being wary of upfront fees and job guarantees. That is consumer guidance, not a statement of fee law for every state. The FTC also advises people who choose to hire their own headhunter to check the firm before paying. Warning signs and how to check an unexpected offer
A request for money in exchange for a job, interview, or guaranteed employment is a serious warning sign. The FTC cautions that some firms charge for supposed services while promoting outdated or fake openings. Be skeptical if a recruiter pressures you to pay quickly, will not explain what the fee buys, or will not put the terms in writing.

Look up the employer’s official contact information yourself and ask whether the role and recruiter are real. Do not rely only on phone numbers, links, or email addresses supplied by the person who contacted you. The FTC explains how to verify an employment offer.
- Do not send sensitive information before verification. Requests for your Social Security number or bank details before you have confirmed the employer and position deserve caution; fake onboarding portals can be used to collect such information.
- Get any paid-service terms in writing. Read the contract, fee schedule, and refund policy before paying. Do not treat a verbal guarantee as protection if it is missing from the written agreement.
Why the answer can depend on your location and work category
Recruitment-fee rules are not identical everywhere. The ordinary U.S. consumer guidance that employers typically pay placement firms should not be mistaken for a complete account of state law or of rules for particular worker programs. Check the law where the agency operates and where the work is performed, and identify any relevant visa or labor-certification program.

Massachusetts
Massachusetts law says an employment agency generally may not charge or accept an applicant’s fee unless there is a written contract and the agency’s referral results in the applicant’s employment. The statute also addresses registration fees, maximum-fee schedules, and exceptions, including certain applicants hired above an annual wage threshold and agencies paid solely by employer clients. These are state-specific rules, not a national standard. Read Massachusetts General Laws, Chapter 140, Section 46L.
Illinois
The Illinois Department of Labor says an agency may not receive a placement fee until the applicant has accepted a position offered by the employer; it also says the agency’s filed fee schedule determines the placement fee. See the Illinois Department of Labor’s private employment agency FAQ.

Covered temporary labor-certification work
The U.S. Department of Labor describes a separate recruitment-fee rule for certain covered temporary labor-certification contexts. It says recruitment fees are illegal in that context, workers may be entitled to recover fees paid in their home country, and the employer must reimburse the entirety in the first paycheck. Applicability depends on the job and program; do not extend this rule to every recruiter or worker. The Department of Labor directs workers to its Wage and Hour Division at 1-866-487-9243 and suggests contacting their country’s embassy or consulate. Check the Department of Labor’s recruitment-fee information.

What to do if you are asked to pay
- If the money is demanded for access to a job, an interview, or a promise of employment, do not pay.
- If it is a separate service you want, obtain the full written terms and verify the provider before deciding.
- If you have already paid or the situation involves a specific state or worker program, contact the relevant state labor or employment-agency regulator or the federal agency administering that program. The rules depend on the facts and location.
