In a 2025 exchange on X, Sam Altman challenged Elon Musk to sign an affidavit denying that he had directed changes to the platform’s algorithm to disadvantage competitors or benefit his companies. It was a pointed public retort, not evidence that Musk had manipulated X’s algorithm. The clash was one episode in a dispute over OpenAI’s structure and control that later moved to court and remained public after Musk’s lawsuit was dismissed on timing grounds.
What did Sam Altman say to Elon Musk?
Ars Technica reported that Musk responded to an Altman post about the relative reach of their posts, complaining that Altman had received millions of views despite Musk having many times more followers. Altman replied: “Will you sign an affidavit that you have never directed changes to the X algorithm in a way that has hurt your competitors or helped your own companies? I will apologize if so.”
The question implied a suspicion; it did not establish that Musk had changed the algorithm or directed anyone else to do so. The exchange drew attention because Altman had often not answered Musk’s earlier public jabs directly, according to Ars Technica. That outlet also described Musk using hostile language about OpenAI, including calling it “a house of cards” after filing suit. Those are reports of public rhetoric, not findings about the companies’ conduct.

Why were Musk and Altman feuding?
The conflict traces back to their work together on OpenAI, which began in 2015. Ars Technica described the initial project as an effort to compete with Google DeepMind while serving the public good. The two men later offered conflicting accounts of their relationship, OpenAI’s intended structure, and who sought what role.

Disagreement over OpenAI’s structure and control
Ars Technica’s account says Altman favored a nonprofit structure, while Musk initially viewed that approach as suboptimal before joining the organization. The founders later disagreed over how to fund and govern OpenAI. Ars Technica also described a dispute involving a Microsoft computing arrangement; that history is contested, rather than an independently resolved finding.
OpenAI’s court account, as summarized by Ars Technica, alleged that Musk wanted sole control and the CEO role when the organization considered a structure that could accept investment in 2017–2018. Musk’s account differed. The founders rejected his proposal, and he left OpenAI in 2018. Accounts also differ on whether Musk proposed folding OpenAI into Tesla or only briefly considered Tesla as a funding source.

From nonprofit mission dispute to competing AI companies
OpenAI established a capped-profit entity in 2019 to attract capital. Musk criticized the organization’s direction and later launched xAI in 2023, creating a direct competitor in AI. Musk sued OpenAI and its leaders in 2024, alleging they had abandoned the founding nonprofit mission. The parties disputed both the timeline and the motivation for the lawsuit, so those claims should be understood as competing accounts rather than settled facts.
What happened in Musk’s lawsuit against OpenAI?
At trial in May 2026, Altman testified that Musk’s emphasis on controlling the initial for-profit structure gave him pause. TechCrunch also reported Altman criticizing Musk’s management approach, quoting him as saying: “I don’t think Mr. Musk understood how to run a good research lab.” These were Altman’s statements in testimony, not independent findings about Musk.

On May 18, 2026, a jury found Musk’s claims untimely, and the judge dismissed them on statute-of-limitations grounds, according to The Washington Post. The decision resolved the case on timing; it should not be read as a jury determination of every underlying factual dispute or allegation. The Post reported that Musk criticized the ruling and said he would appeal. A Microsoft spokesperson welcomed the decision, saying: “The facts and the timeline in this case have long been clear, and we welcome the jury’s decision to dismiss these claims as untimely.”

No. Fortune reported another flare-up in July 2026, including an Altman post on X about Musk’s attention to OpenAI and competition between their AI companies. The reporting shows that the rivalry continued publicly after the dismissal; it does not change what the court decided or resolve the parties’ broader disagreements.
