Assuming you mean India: your rights and obligations depend on whether the interaction is a GST summons, a Customs assessment request, a search or seizure, or an arrest. A GST summons can require you to attend, give evidence, or produce documents; it is not the same as permission to search your premises. Identify the statute and section cited, keep the communication, and get advice from an India-qualified lawyer if you are involved in an active inquiry.

First identify what kind of questioning this is

“Customs or GST questioning” is not one procedure. India has central and state GST laws, and the applicable process depends on the authority, statute, and purpose of the inquiry. Customs assessment requests also rest on provisions separate from the GST summons rules.

  • GST summons: a formal requirement to attend, give evidence, or produce records under section 70 of the Central Goods and Services Tax Act, 2017 (CGST Act).
  • Customs assessment request: a request for information or documents relevant to assessing or verifying an import or export under section 17 of the Customs Act.
  • Search or seizure: a separate statutory procedure; a summons alone does not authorize a premises search.
  • Arrest: a distinct action subject to statutory offence conditions and procedures. Being questioned or receiving a summons does not itself mean you are under arrest.

Read the notice or ask the officer which law and section apply, what you must provide, and whether your attendance is required. Do not assume that rules for a GST inquiry apply identically to a Customs investigation.

Do you have to attend or answer a GST summons?

What section 70 allows

Under CGST Act section 70, a proper officer may summon someone whose attendance is considered necessary to give evidence or produce documents or another thing in an inquiry. The section treats the inquiry as a judicial proceeding. CBIC’s Instruction No. 03/2022-23 (GST-Investigation), dated 17 August 2022, says people summoned are generally bound to appear, subject to stated exceptions.

Do not casually ignore a summons or conclude that you can refuse to attend. If the date is impossible, the request is unclear, or you believe an exception applies, promptly ask a lawyer how to respond and whether to request an accommodation. The instruction is guidance to officers; it does not give everyone a blanket right to disregard a summons.

What CBIC tells officers about summons

The same 2022 instruction calls for judicious use of summons and says officers should consider whether a letter requesting information would suffice in some cases. That is officer-facing guidance, not permission for a recipient to substitute a letter for a required appearance. The instruction also sets out internal permission and record-keeping expectations for certain summons issued by Superintendents, with an operational exception; asks that appearance or non-appearance and statements be recorded; and says the person under investigation should normally be identified unless disclosure could harm the investigation.

Can you take a lawyer, refuse an answer, or decline to sign?

The official materials described here do not establish a blanket right to have a lawyer physically present at every interview, or a general privilege to refuse every question. Nor do they establish a universal right to refuse to sign any statement in every circumstance. The answer can depend on the statute, the kind of proceeding, and the question or document at issue.

Before giving a statement or signing a record, read it carefully and ask for corrections if it does not accurately reflect what you said. Do not guess when you do not know an answer. If you are uncertain about the legal effect of a question, statement, or requested signature, ask to consult an India-qualified lawyer familiar with Customs or indirect-tax investigations. Do not treat these general points as a substitute for advice on your specific matter.

Are GST officers allowed to search premises or seize documents?

GST inspection, search, and seizure have a separate basis under CGST Act section 67, which sets out statutory conditions and authorization requirements. A summons to attend or produce records does not, by itself, authorize officers to search business premises.

If documents are seized, the CGST Act provides a qualified opportunity to make copies or extracts in the officer’s presence, subject to an exception where providing access could prejudice the investigation. The Act also contains rules concerning retention and return. Ask what has been taken and request the written record or receipt that applies to the action. Have a lawyer assess any dispute about authorization, access to copies, or retention.

Does questioning mean you can be arrested?

No. Under CGST Act sections 69 and 132, arrest depends on the authority and offence conditions set out in the statute; it is not an automatic consequence of being questioned or summoned. CBIC Instruction No. 02/2022-23 (GST-Investigation), dated 17 August 2022, says arrest should not be routine or mechanical and discusses factors including the needs of the investigation, possible evidence tampering or witness influence, and ensuring a person’s presence.

The statute and CBIC guidance describe arrest procedures that include communicating the grounds, preparing an arrest memo, notifying a nominated person, and producing the arrested person before a Magistrate within the applicable time limit. If an officer tells you that you are under arrest, ask for the grounds and contact a lawyer immediately; the applicable procedure depends on the circumstances and current law.

What can Customs request during an assessment?

For Customs assessment or verification, section 17 of the Customs Act permits the proper officer to require documents or information relevant to assessment from an importer, exporter, or another person. That provision does not resolve every situation involving airport questioning or a separate Customs enforcement investigation. Check the notice for the specific Customs provision and purpose rather than assuming the GST summons framework applies.

What to do if you receive a notice or are questioned

  1. Keep the communication. Save the notice, summons, letter, or other document and note when and how it was received.
  2. Identify the authority and legal basis. Check whether it names a GST or Customs officer, the statute and section, the inquiry’s stated purpose, and whether it requires attendance, information, or documents.
  3. Note deadlines and preserve relevant records. Do not alter, destroy, or casually hand over records. Ask a lawyer how to handle documents you are required to produce and what written record to obtain when records are taken.
  4. Respond through appropriate advice. If you cannot attend, do not understand the demand, or have concerns about a statement or search, promptly contact an India-qualified lawyer familiar with the relevant investigation. Do not simply ignore an official summons.

This is general information, not legal advice for an individual case. The applicable rules can change, and Customs and GST procedures are not interchangeable; have counsel check the current law and instructions for your specific notice or encounter.
