A pipeline easement gives an operator defined rights to use part of a property for specified purposes. It does not give every pipeline company unrestricted access, and a survey request is not itself a permanent easement. For a particular parcel, the recorded instrument and any applicable order control the location, width, permitted work, access, duration, restoration duties, and compensation.
What a pipeline easement allows
An easement is a property interest, not ownership of the entire parcel. For a qualifying natural-gas pipeline, Massachusetts General Laws Chapter 164, Section 75C describes interests needed for construction, operation, maintenance, alteration, and removal. The exact rights depend on the instrument or order affecting the land; those statutory categories do not mean every easement grants every right in the same way.
The practical effect can be significant: the owner may retain title while having to accommodate specified pipeline uses and restrictions within a defined area. A general description cannot establish the footprint or terms on a particular property. Start with the recorded easement, its referenced plan and amendments, and any related agency or court orders.

No. Survey access and acquisition of a permanent property interest are separate stages. Massachusetts Department of Public Utilities (DPU) guidance says a company typically first asks an owner for permission to survey. An owner may deny that initial request; the company can then petition the DPU for survey authorization. The agency’s review is a public proceeding with notice and an opportunity for landowners to comment.

What survey work may involve
Route investigations can include work to locate a potential centerline, geotechnical investigation, archaeological and cultural-resource review, wetlands and waterbody boundary work, and surveys for endangered or rare species. The precise activities depend on the project.
Authorization to conduct a survey should not be treated as a conveyance of a permanent easement. If a company seeks enduring property rights, that requires a separate agreement or applicable legal process.
How do Massachusetts taking procedures differ by pipeline type?
Massachusetts has distinct statutory procedures for natural-gas and oil pipelines. The provisions below apply within their respective statutory scopes, not automatically to every pipeline project.

The General Court’s current Section 75C states: “A natural gas pipeline company may petition the energy facilities siting board for the right to exercise the power of eminent domain under chapter 79.” This describes a petition for authority; it does not mean every petition results in a taking.
What should you check in an easement or proposed agreement?
For an existing easement
Obtain the recorded instrument, any referenced plan or amendments, and relevant orders. Compare the documents with the particular survey, maintenance, or construction request. These are review prompts based on statutory categories, not terms that every easement necessarily contains.
- Footprint: Check the legal description, mapped location, and width of the property interest.
- Permitted uses: Identify the activities allowed, such as construction, operation, maintenance, alteration, or removal.
- Access: Look for permitted routes, notice provisions, and conditions on entry.
- Duration and restoration: Check how long rights last and what the document says about restoring disturbed land.
- Owner use: Look for restrictions on buildings, excavation, landscaping, or other future uses within the affected area.
For a proposed agreement
Compare the rights and footprint sought with the planned work. Review duration, access, restoration commitments, and the proposed compensation, as well as what process may follow if no agreement is reached. State materials describe survey comments and formal proceedings, but do not establish one deadline or procedure that applies to every docket.

What remedies and oversight may still apply?
A taking does not eliminate every remedy. Section 75C says the rights granted do not affect a remedy for injury to persons or property caused by the company’s acts. Whether a particular loss supports a claim depends on the facts and applicable law; the statutory language is not a guaranteed award or a valuation formula.
Safety oversight also depends on the pipeline. Massachusetts guidance says DPU safety jurisdiction is limited to natural-gas facilities located solely within the state. The federal Pipeline and Hazardous Materials Safety Administration (PHMSA) has primary safety oversight for interstate natural-gas pipelines. Do not assume the same regulator or jurisdiction applies to every pipeline.
Where to get parcel-specific answers
If you receive an easement offer, survey petition notice, taking-related notice, damage claim, or are selling affected property, gather the recorded documents and current project docket materials. A Massachusetts attorney experienced in real-estate or eminent-domain matters can assess the rights and procedures that apply to your parcel. A licensed land surveyor can help with a boundary or route-mapping question, but a survey by itself does not determine legal rights.
