In the United States, parents’ federal rights concerning student privacy and school information mainly come from two laws: FERPA, which covers access to education records and many disclosures of personally identifiable information, and PPRA, which covers certain surveys, data collection, instructional materials, and examinations. Neither law gives parents a blanket right to every school communication or a veto over every classroom activity. The answer in a specific case can also depend on the student’s age and enrollment, the record or activity at issue, state law, district policy, and any relevant court order.

What parental rights laws cover

“Parental rights laws” is not the name of one federal statute. For school records and student privacy, the central federal framework is the Family Educational Rights and Privacy Act (FERPA) and the Protection of Pupil Rights Amendment (PPRA). They address different things: FERPA concerns education records and disclosure of identifiable information, while PPRA requires policies and protections for certain surveys and other specified practices.

These federal rules are a starting point, not a complete answer to every dispute. State law and local school policies may add requirements, and custody arrangements or court orders can matter. The federal sources summarized here do not resolve every state-specific question.

What FERPA lets parents do

For an educational entity covered by FERPA, the U.S. Department of Education says parents generally have the right to inspect and review their child’s education records, seek amendment of records they believe are inaccurate, and consent to disclosure of personally identifiable information from those records unless an exception permits disclosure without consent. The Department’s Legal Basics summary gives schools up to 45 days after a request to provide access.

Those rights apply to education records within FERPA’s scope; they do not mean that every document, conversation, or piece of information must be disclosed in every circumstance. FERPA includes exceptions, and whether particular information is a covered record or may be withheld or disclosed without consent depends on the facts and applicable rule.

Requesting access or challenging a record

For a practical starting point, make a written request that identifies the student and the records you want to inspect. Keep a copy and note when the school received it. If the school denies access or redacts material, ask it to explain the basis and any applicable review process. These are useful request practices, not additional statutory requirements described by the Department’s summary.

If the concern is that a record is inaccurate, distinguish that from a request to see it: FERPA provides a right to seek amendment, but the request to correct a record is not the same as the right to inspect records.

What PPRA covers

PPRA is not a general right to veto instruction or every question a school asks. It requires local educational agencies, in consultation with parents, to adopt policies in several specified areas. The Department of Education identifies areas that include:

  • Parent access, on request, to certain third-party surveys before they are administered.
  • Privacy protections when surveys ask about specified protected areas.
  • Access to instructional materials used as part of the curriculum.
  • Certain physical examinations or screenings.
  • Collection or use of personal information from students for marketing or sale.

When notice or an opt-out may apply

The Department’s March 2025 annual notice describes direct notice and an opportunity to opt a child out in specified survey situations, including surveys about protected areas when participation is required or in certain Department-administered programs. It also describes annual notice of local policies and notice of particular activities. The exact process depends on the survey or activity, its content, the relevant program or funding context, and whether participation is mandatory. PPRA should not be summarized as requiring parental consent for every survey or allowing an opt-out from any survey.

When rights transfer to the student

The transfer rule differs between the two laws. FERPA rights transfer from the parent to the student when the student turns 18 or enrolls in a postsecondary institution at any age. PPRA rights transfer when the student turns 18 or is emancipated under applicable state law. A parent’s continued financial support, by itself, does not change FERPA’s stated transfer rule.

How to tell what kind of request you have

Before assuming a school must provide information or let a student opt out, identify the issue. A request to inspect existing records is different from asking to be notified about events, requesting a new explanation, challenging a record’s accuracy, or objecting to a survey or other activity.

  • Existing school records: Consider whether the request is for education records maintained by the school and whether FERPA applies.
  • Record accuracy: Use the amendment process rather than treating a correction request as an access request.
  • Disclosure to another party: Ask what information was disclosed and whether an exception to consent applies.
  • Survey or student data collection: Check the activity’s subject matter, whether participation is required, and the district’s PPRA policy and notice.
  • Instructional material or examination: Identify the particular material or activity and consult the local policy that addresses it.

Student records involving gender identity: what federal announcements establish

Student names, pronouns, and gender identity in school records have become a prominent point of conflict between parental access claims, student privacy, and state or district policy. In a March 28, 2025 announcement, the Department of Education said its compliance direction concerned FERPA and PPRA and asserted that records related to gender identity fall within parents’ inspection rights. In January 2026, the Department announced that its Student Privacy Policy Office found California’s Department of Education in continued violation of FERPA over policies the federal office said pressured officials to conceal information about student gender identity. In August 2026, the Department again stated its view of agencies’ FERPA and PPRA obligations.

Those are Department announcements and an agency finding, not a final court judgment resolving the scope of student privacy rights in every state or family situation. In an individual case, the outcome can depend on whether a particular record exists, is maintained by the school, falls within FERPA, or is subject to an exception, as well as on applicable state and local rules.

What to check in a specific dispute

  1. Identify the jurisdiction and school context. Note the state, school type, student’s age, and whether the student attends a postsecondary institution.
  2. Define the request. Specify whether you seek existing records, a correction, information about a disclosure, notice about an activity, or an opportunity to opt out.
  3. Read the district’s current notices and policies. Check its annual FERPA and PPRA notices and the policy in effect when the event occurred.
  4. Consider state-specific facts. Review applicable state law, custody arrangements, and court orders; federal summaries alone do not settle every local question.
  5. Get appropriate help for a live dispute. Relevant state education agencies, official federal guidance, and a qualified lawyer can help address questions that turn on local law or an individual record.
