A supersonic passenger jet needs more than permission to fly faster than sound. In the United States, its manufacturer must obtain FAA approval for the aircraft’s design and for repeatable production; the aircraft must meet its project-specific safety and other applicable certification requirements; and operators must comply with the rules governing where and how it may fly. Testing permission, a type certificate, and permission for scheduled passenger service are different things.

Certification is several approvals, not one

The FAA pathway covered here is the U.S. process. FAA approval alone does not authorize an aircraft to operate in every country; other jurisdictions may require their own approval or acceptance.

Approval or rule What it addresses
Type certification Whether the aircraft’s defined design meets its FAA certification basis.
Production approval Whether the manufacturer can consistently build aircraft that conform to that approved design.
Noise and emissions requirements Whether the aircraft and its applicable engines satisfy relevant environmental certification requirements.
Operational permission Whether and under what conditions an operator may conduct a particular kind of flight, including supersonic flight over land.
Special flight authorization Whether specified test flights may be conducted; it is not approval for scheduled passenger service.

These tracks answer different questions. A type certificate does not itself grant an operator permission to make every proposed flight, and production approval does not replace design approval.

How the FAA type-certification process works

The FAA’s April 23, 2026 explainer describes seven shared phases. They are a general process, not a universal checklist: the certification basis and accepted ways to show compliance are specific to each aircraft project.

  1. Start the project and establish the standards. The applicant briefs the FAA and applies for design and production approval. The FAA establishes the certification basis—the requirements that apply to this design. Depending on the project, the FAA may also issue special conditions, exemptions, or equivalent-safety findings.
  2. Define the airplane. The applicant and FAA develop the aircraft definition and determine how the proposed design will be assessed against the certification basis.
  3. Agree on compliance plans. They settle on acceptable means of compliance and plans identifying how each finding will be supported—for example, through tests, analysis, inspection, or simulation.
  4. Build the aircraft and check conformity. The applicant builds test aircraft and supplies evidence about its manufacturing system. The FAA conducts conformity inspections and assesses facility readiness and the quality system.
  5. Test and submit evidence. The applicant conducts ground and flight testing and provides engineering data and safety assessments. The FAA oversees type-inspection flight testing as part of its evaluation.
  6. Close findings and complete documents. The applicant addresses outstanding compliance findings and finalizes documents such as the Airplane Flight Manual.
  7. Receive the type certificate. The FAA issues it after the applicable requirements have been met.

The details cannot be safely inferred from the word “supersonic.” The exact airworthiness standards, any special conditions or exemptions, and accepted compliance methods must come from that aircraft’s FAA certification records; the FAA’s general process description does not establish them.

Why supersonic operation over land is a separate hurdle

In the United States, the general restriction on civil flight above Mach 1 over land dates to 1973, according to the FAA’s June 2026 operational notice of proposed rulemaking. As of October 4, 2026, the proposed change is not an effective permission for passenger flights.

The FAA proposal would allow civil supersonic flight without an operation-specific special flight authorization only if all three proposed conditions are met:

  • Surface sonic-boom overpressure stays at or below 0.11 pounds per square foot.
  • The FAA finds, after an operator demonstration using an accepted method, that primary and secondary boom overpressure at the surface comply with the standard.
  • The operator follows the conditions and limitations the FAA imposes.

The method used to demonstrate compliance—potentially measurements and procedures or modeling—would itself require FAA approval. This is a proposed performance standard, not a prescribed aircraft design or a final operating rule. An applicant should not treat it as an available route to routine commercial service until the rule is finalized and applicable requirements are met.

Takeoff noise, sonic booms, and aircraft certification are distinct

Noise certification for takeoff and landing is not the same question as whether an aircraft’s en-route sonic boom may reach the ground. Neither question is the same as whether the aircraft design meets its airworthiness certification basis.

A 2020 FAA notice of proposed rulemaking proposed extending Part 36’s noise-certification framework to new supersonic airplanes and proposed takeoff-and-landing standards for the specified SSL1 class: maximum takeoff weight no greater than 150,000 pounds and maximum operating cruise speed up to Mach 1.8. That proposal said it would not change the then-existing overland sonic-boom restriction. Do not treat its proposed limits as current law. The FAA’s July 9, 2026 overview describes the en-route operational proposal and a separate takeoff-and-landing noise rulemaking, and says the agency aims to finalize both rules by mid-2027.

Test-flight authorization is not passenger-aircraft approval

Companies seeking to conduct civil supersonic tests above Mach 1 over U.S. land need a special flight authorization under 14 CFR 91.818, according to the FAA. Issuing one entails FAA environmental review under the National Environmental Policy Act.

The FAA’s page, updated September 21, 2026, lists test authorizations for Boom Technology’s XB-1 and Hermeus Quarterhorse Mark 2.1 and Mark 2.2. Those examples concern test aircraft. A test authorization does not show that a passenger jet has a type certificate, that its manufacturer has production approval, or that an airline may use it for scheduled transport.

Engine emissions are another applicable certification stream

The FAA says 14 CFR Part 34 applies to civil airplanes with covered classes of gas-turbine engines. The EPA establishes aircraft emissions standards, while the FAA administers certification requirements; the FAA points to standards under 40 CFR Part 87 and Part 34 procedures. The precise requirements for a proposed supersonic aircraft depend on its engine classification and the rules applicable to it, so they should be checked rather than assumed.

What a passenger service would ultimately need

For a U.S. commercial passenger operation, the work therefore extends beyond demonstrating that a jet can fly supersonically. The aircraft needs design approval based on a project-specific compliance record, production approval for conforming aircraft, and compliance with applicable noise and emissions requirements. The operator also needs a lawful operating pathway for the intended routes and flight profiles. As of October 4, 2026, the FAA’s proposed overland boom standard had not yet become that operating permission.
