There is no single U.S. deadline for prosecuting rape or sexual assault. State rules vary, and the applicable limit may depend on the offense, the victim’s age, the date and location of the conduct, and circumstances such as DNA evidence. Federal cases have separate rules. A specific answer requires the jurisdiction and facts of the case.

What does a statute of limitations mean in a sexual assault case?

A criminal statute of limitations sets the period in which prosecutors may bring a case. It is not the same as a deadline to report an assault, and it does not determine whether conduct meets the legal definition of a particular crime.

RAINN’s explainer, Understanding Statutes of Limitations for Sexual Violence Cases, updated May 31, 2026, says: “Survivors can report sexual violence to the police at any time—there is no deadline for coming forward.” Whether prosecutors can still bring charges is a separate question governed by the law that applies to the case.

Why is there no one nationwide deadline?

Most sexual assault cases are governed by the law of the state or territory where the conduct occurred. Those laws are not uniform. Also, “rape” and “sexual assault” are broad public terms; statutes may define several offenses or degrees, each with a different limitation rule.

Depending on the jurisdiction and offense, the deadline may also be affected by the victim’s age, DNA evidence, delayed discovery, tolling, or another statutory exception. A rule that applies to one offense or circumstance should not be assumed to apply to another. RAINN provides a state-law database with a criminal-statutes-of-limitations section; check the entry for the relevant state or territory and the law applicable to the offense date.

What is the federal statute of limitations?

Federal limitation periods apply to federal prosecutions, not automatically to every assault that happens in the United States. The federal offense charged and whether federal jurisdiction applies matter; the federal rule alone cannot establish that a local incident is a federal case.

Federal provision Rule Scope
18 U.S.C. § 3282 Five years after the offense is committed, unless another law expressly provides otherwise. General limitation period for noncapital federal offenses.
18 U.S.C. § 3283 For a covered offense, prosecution is not barred during the child’s life or for 10 years after the offense, whichever is longer. Covered offenses involving sexual or physical abuse, or kidnapping, of a child under 18.

These are federal statutory rules. They do not supply a deadline for state cases, and the child-victim provision applies only to offenses within its scope.

How can you check the deadline for a particular case?

A reliable answer usually requires more than the label “sexual assault.” To look up the applicable rule, establish:

  1. Jurisdiction: Identify the state or territory where the conduct occurred, and whether federal or military jurisdiction could apply.
  2. Conduct and possible offense: The facts may correspond to a specific offense or degree under that jurisdiction’s law.
  3. Dates: Determine the date or date range of the conduct. The law in effect on that date, including historical versions, may matter.
  4. Age: Establish the victim’s age at the time, since some rules provide different periods for offenses against children.
  5. Potential exceptions: Check whether the relevant law includes a DNA provision, delayed-discovery rule, tolling rule, or other applicable exception.
  6. Type of case: Confirm whether the question concerns criminal prosecution or a civil lawsuit for damages.

RAINN’s national explainer and state-law database are useful starting points, but a national summary cannot verify every state’s current or historical rule. For an individual matter, a lawyer licensed in the relevant jurisdiction can assess the applicable law and facts.

Is the deadline for a civil lawsuit the same?

No. A civil claim for damages has its own limitation period, which may differ from the criminal prosecution deadline. Do not use a criminal statute of limitations to decide whether a civil claim can be filed.
