The Income Tax Appellate Tribunal (ITAT) is India’s specialist appellate body for disputes under direct-tax laws. It usually hears an appeal after an order from the Joint Commissioner (Appeals) or Commissioner (Appeals). To work out whether you can appeal, which Income Tax Act applies, and how much time you have, start with the order, its communication date and the relevant tax year. Those details matter especially for proceedings around the Income Tax Act 2025 transition on 1 April 2026.
What is the Income Tax Appellate Tribunal?
The ITAT is a quasi-judicial tribunal that hears appeals in specified direct-tax matters. It is an appellate forum, not the authority that first makes an assessment. The Income Tax Department describes the appellate structure and the Tribunal’s role in its Appeals and Revisions guidance.
The Tribunal considers the dispute and the material properly before it under the applicable law. Its appellate powers can include confirming, reducing, enhancing or annulling an assessment. Depending on the case, it may also admit additional grounds, seek a remand report, rectify a mistake or grant a stay subject to conditions. These are powers the Tribunal may exercise where legally available; they do not guarantee a particular outcome or interim relief.
Where does an ITAT appeal fit in the tax appeal process?
The ordinary route places the ITAT after an appeal before the Joint Commissioner (Appeals) or Commissioner (Appeals). The particular order and statutory provision determine whether an ITAT appeal is available; not every tax dispute or decision necessarily follows the same route.
#1 Best Overall
| Stage | What it means |
|---|---|
| First appellate stage | An appeal is ordinarily heard by the Joint Commissioner (Appeals) or Commissioner (Appeals), depending on the applicable route and order. |
| ITAT | The Tribunal considers an eligible appeal from the preceding appellate stage under the governing tax law. |
| High Court | A further appeal may lie where a substantial question of law arises. The ITAT describes its orders as final within the Tribunal system, subject to this High Court route. |
Before taking a step, identify the authority that issued the decision you want to challenge. The appeal route depends on that decision, rather than simply on the fact that the dispute concerns income tax.
How do you file and track an appeal before the ITAT?
The broad workflow is to establish the applicable route and deadline, then use the Tribunal’s current filing instructions. The exact form, supporting documents, fee, verification and bench-specific requirements can depend on the case and current ITAT directions; check the official practice note and appeal checklist rather than relying on a generic list.

- Identify the order and case details. Note the issuing authority, the order you intend to challenge, the date and manner in which it was communicated, and the relevant tax year. These facts help determine whether an ITAT appeal is available, which Act governs, and how limitation is calculated.
- Check current ITAT instructions. Consult the ITAT e-filing portal’s help page, practice note and appeal checklist for the current workflow and requirements applicable to your matter.
- File through the appropriate e-filing workflow. Follow the portal’s current instructions, retain the acknowledgement and preserve your filing records. Do not assume that a form or attachment list used in another case is sufficient for yours.
- Monitor the appeal dashboard. The portal provides assessee login and a dashboard for e-filed matters. Use it to review filing details, address defects, and file documents or petitions as required.
- Review the Tribunal’s order before deciding what follows. If considering a High Court appeal, assess whether the statutory substantial-question-of-law threshold is met.
What is the time limit for an ITAT appeal?
There is no safe universal deadline to apply without identifying the order, governing provision and communication date. For appeals under section 253(3) of the Income Tax Act 1961, the provision was amended with effect from 1 October 2024; its current wording is generally framed as two months from the end of the month in which the order is communicated. Treat that as a rule to verify against the applicable statute and ITAT instructions, not as a stand-alone deadline calculator. The order type, the provision invoked, and how and when it was communicated can affect the calculation.

A delayed appeal may be admitted if sufficient cause for the delay is established, but condonation is not automatic. Keep evidence relevant to the communication date and any explanation for delay, and obtain case-specific advice promptly if the deadline may have passed.
Which Income Tax Act applies after 1 April 2026?
The Income Tax Act 2025 commenced on 1 April 2026, but that date does not mean every pending or earlier-year matter switches to the new Act. The Income Tax Department’s transition guidance says proceedings pending on that date generally continue under the Income Tax Act 1961. It also says proceedings initiated after that date for tax years beginning before 1 April 2026 are governed by the 1961 Act. The new Act does not, by itself, revive a limitation period that has already expired.
For a matter spanning the changeover, establish both the tax year and the proceeding’s status before using a section number, filing rule or deadline. Do not assume that a new section number applies simply because you are filing or checking the case after 1 April 2026.

The ITAT says its orders are final within the Tribunal system, but a further appeal may lie to the High Court if a substantial question of law arises for determination. That threshold is narrower than simply disagreeing with the Tribunal’s factual findings or result. Whether the issue qualifies, and the applicable procedure and time limit, require review of the particular order and governing law.
