If a cyberattack interrupts claims processing, treat it first as a HIPAA security incident—not merely an information-technology outage. Activate the incident-response plan, isolate affected systems when ransomware is suspected, preserve evidence, and establish a downtime process that keeps essential work moving while protecting electronic protected health information (ePHI). Then recover through tested, incident-aware restoration, assess whether PHI was breached, complete required notifications, and document corrective actions.
There is no single claims-downtime workflow that fits every provider, health plan, clearinghouse, or payer. Your process must fit your contracts, payer connections, clinical priorities, security controls, and recovery capabilities. The U.S. Department of Health and Human Services (HHS) Office for Civil Rights (OCR) guidance below provides the HIPAA response, continuity, breach-assessment, and documentation framework.
1. Activate incident response and contain the attack
Start with the organization’s security-incident procedures. Name one incident-response lead for technical decisions and a coordination lead for privacy, legal, clinical or operational leadership, revenue-cycle management, communications, and executive decisions. Keeping those responsibilities explicit prevents a claims backlog from driving unsafe technical choices.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsEstablish what is happening
Build an initial picture of the event before deciding what to restore. Determine which networks, servers, endpoints, applications, interfaces, and data stores are affected; when suspicious activity began; whether the attacker is still active; whether the incident has spread; and the likely entry and attack paths. Claims processing may depend on registration, eligibility, coding, electronic health-record, clearinghouse, payment, identity, and document systems, so an apparently narrow outage can have wider dependencies.

Isolate infected systems
When ransomware is believed to be underway, HHS OCR advises immediately activating the response plan, including measures to isolate infected systems and halt propagation. The exact technical action depends on the environment and evidence: responders may disconnect hosts, segment networks, disable compromised accounts, block malicious traffic, or suspend affected interfaces. Do not power down, wipe, rebuild, or reconnect systems without direction from the incident-response lead and investigators, because those actions can destroy evidence or spread the attack.
Preserve evidence and decision authority
Record alerts, timestamps, system states, communications, containment steps, and approvals. Preserve relevant logs, forensic images, malware samples, access records, and copies of messages where feasible. Emergency operations are important, but they do not replace incident command. The technical lead should approve changes that could affect evidence or reinfection risk, while privacy and legal leaders guide reporting and privilege decisions.
2. Protect continuity while claims systems are unavailable
Activate the contingency or business-continuity plan as soon as the outage threatens critical work. HIPAA contingency planning covers data backup, disaster recovery, emergency operations, application and data criticality analysis, and periodic testing. Use that plan to prioritize work rather than improvising a separate process for every department.
Set business and patient-care priorities
Classify applications and information by the harm caused if they are unavailable. Patient-care functions, emergency services, medication and treatment information, identity and access controls, and legally required communications may outrank claims submission. Within revenue cycle, distinguish work that must occur immediately from work that can be queued safely. Document who made the priority decision and when it will be revisited.
Design a downtime claims workflow that fits your arrangements
A workable process normally assigns owners for intake, charge capture, coding, claim preparation, submission, payment posting, reconciliation, and backlog release. Define how staff will identify encounters, preserve supporting documentation, track claim status, and hand records back to the restored system. Your payer contracts, clearinghouse agreements, electronic-data-interchange setup, and security policy determine whether a particular paper, offline, or alternate electronic method is permissible.

HHS OCR does not prescribe a universal paper form, clearinghouse route, payer deadline, or claims-submission sequence. Confirm requirements with each affected payer and business associate. Ask specifically how they want outage notices, late claims, corrected claims, attachments, eligibility checks, and duplicate prevention handled. Keep those instructions with the downtime procedure, not in an individual employee’s mailbox.
Maintain an auditable backlog
Give every downtime transaction a unique control number or other approved identifier. Track the source encounter, service date, responsible team, data needed for completion, submission status, payer response, and reconciliation result. Separate claims that were drafted from those actually transmitted. This prevents a later recovery team from assuming that a prepared claim was accepted or paid.
3. Protect ePHI during emergency operations
Downtime does not suspend HIPAA safeguards. Limit access to the minimum necessary information and to personnel who need it for assigned duties. Use approved storage, transmission, and authentication methods; do not move claim files to personal email, consumer file-sharing accounts, or unapproved removable media merely because normal systems are down.
Control temporary access
Use emergency accounts or elevated permissions only when documented, time-limited, and monitored. Maintain a list of people granted access, the systems or records available to them, the approving manager, and the expiration or review time. If paper records are used, secure them against unauthorized viewing, copying, loss, and disposal; account for every packet as it moves between departments.
Protect information shared with outside parties
Coordinate with clearinghouses, billing vendors, managed-service providers, and other business associates under the applicable business-associate agreement and incident clauses. Exchange only the information needed for the agreed task, through an approved channel. If a business associate reports that its system is affected, include that information in the incident scope and dependency assessment rather than treating the problem as an isolated vendor outage.

4. Recover systems and data deliberately
Recovery begins after containment and remediation have reduced the risk of reinfection. HHS describes recovery as restoring lost data and returning to normal operations, supported by backup and restoration capability in the contingency plan. Restoration is not simply switching systems back on.
Verify backups before using them
Assume backup systems or backup data could have been targeted until responders establish otherwise. Confirm the backup’s age, completeness, isolation, access history, and malware status. Identify which copies are suitable for recovery and who authorized their use. A backup that is available but contaminated, incomplete, or inaccessible is not a dependable recovery resource.
Test restoration and record the result
Restore representative systems or data in a controlled environment first. Check that applications start, interfaces authenticate, records are complete, files are readable, permissions are correct, and transactions can be processed. Retain the test date, scope, operator, expected result, observed result, defects, and approval to proceed. HIPAA contingency planning expects periodic testing; a test performed only after an attack is evidence of the immediate event, not a substitute for routine exercises.
Remediate the attack path
Address the vulnerabilities, exposed credentials, insecure remote access, unpatched software, excessive privileges, or configuration weaknesses that enabled the incident before reconnecting affected services. Apply heightened monitoring and alerting during the return to service. Bring applications back in an order that reflects dependency and criticality, not simply the order in which individual teams request them.
Reconcile downtime work
Compare the downtime register with restored records, clearinghouse acknowledgments, payer responses, and bank or remittance data. Resolve missing encounters, duplicate transmissions, incorrect patient identifiers, rejected claims, and claims that were submitted through more than one route. Obtain a named owner and completion date for every unresolved item. This reconciliation is operational guidance; OCR does not specify a particular claims-reconciliation method.

5. Assess whether PHI was breached
Ransomware or other malware presence is a HIPAA Security Rule security incident. That classification does not automatically answer whether a breach of PHI occurred. Conduct a separate, fact-specific assessment of whether PHI was impermissibly acquired, accessed, used, or disclosed.
Build the facts for the risk assessment
- Identify the PHI and the systems, files, databases, messages, or paper records involved.
- Determine whose PHI was present and the approximate number of individuals and records affected.
- Establish what the attacker or unauthorized user could access, for how long, and whether data was viewed, copied, exfiltrated, altered, encrypted, or deleted.
- Assess the likelihood that the PHI was retained or misused, using available forensic and threat information.
- Evaluate mitigation, such as containment, verified deletion, credential resets, or other documented measures.
OCR says the breach conclusion depends on the facts and circumstances. Encryption may affect the analysis, but it does not eliminate the need to document what happened and why the organization reached its conclusion. A claims-system outage alone does not prove a reportable breach, and a cyberattack does not have the same notification outcome in every case.
Coordinate notifications
Follow applicable HIPAA breach-notification requirements, contractual reporting clauses, and other laws that apply to your organization and jurisdiction. Coordinate with affected business associates and determine who is responsible for each notice. Privacy counsel or the designated privacy officer should approve the analysis and notification plan. Do not announce a number of affected people, a cause, or a data type until the organization has evidence supporting that statement.

Create a contemporaneous record of the incident scope, decisions, actions, evidence, system status, downtime controls, restoration checks, breach-risk analysis, notifications, and corrective actions. Include the name or role of the decision maker, the time, the information available at that point, and the reason for the decision.

Keep separate but connected records
- Incident record: alerts, timeline, affected assets, containment, investigation, and communications.
- Continuity record: activated plans, criticality decisions, temporary procedures, access grants, and backlog controls.
- Recovery record: backup selection, restoration tests, integrity checks, vulnerability remediation, and return-to-service approvals.
- Privacy record: PHI analysis, breach conclusion, notification decisions, and mitigation.
- Improvement record: root causes, lessons learned, assigned corrective actions, owners, and due dates.
HHS OCR audit materials indicate that reviewers may examine incident roles, timely response and reporting, documentation, application criticality, contingency-plan testing, data-restore test results, and coordination with business associates. A complete record helps demonstrate not only what the organization did, but how it knew the action was appropriate.

7. Assign clear responsibilities
| Function | During the outage | During recovery |
|---|---|---|
| Incident response and security | Scope the attack, contain propagation, preserve evidence, and approve technical changes. | Remove the attack path, monitor restored systems, and validate security controls. |
| Privacy and legal | Direct PHI analysis, privilege decisions, contractual review, and notification planning. | Approve final breach conclusions, notices, and regulatory or contractual submissions. |
| Clinical and operations | Prioritize patient-care and essential business functions and enforce downtime procedures. | Approve safe return to normal operations and close temporary workflows. |
| Revenue cycle | Register, prepare, track, and protect downtime claims and supporting documentation. | Reconcile submissions, acknowledgments, denials, payments, and backlog items. |
| Communications | Provide consistent internal and external updates approved by incident leadership. | Publish service-restoration and notification messages that match verified facts. |
| Business-associate management | Confirm vendor impact, reporting duties, alternate services, and secure data exchange. | Track vendor remediation, evidence, testing, and contractual follow-up. |
8. Use a practical decision framework for downtime options
When choosing between paper processing, an alternate electronic route, delayed batch submission, or a vendor-supported process, evaluate each option against the same questions:
- Criticality: Does it support a patient-care or legally time-sensitive process?
- ePHI protection: Can access, transmission, storage, and disposal be controlled and audited?
- Compatibility: Does the payer or clearinghouse accept the method and its file or claim format?
- Reconciliation: Can the organization prove what was prepared, sent, accepted, rejected, corrected, and paid?
- Recovery time: How quickly can the method reduce the backlog without creating duplicate or inaccurate claims?
- Testing: Has the organization exercised the process and verified restoration of the related data?
Choose the option that meets the organization’s security and contractual requirements, not merely the option that starts fastest. If no approved option is available, escalate to incident leadership, privacy, legal, and the affected payer or business associate rather than creating an informal workaround.
9. Review, test, and improve after operations stabilize
Conduct a post-incident review while the timeline and decisions are still fresh. Ask whether the organization detected the event promptly, isolated the right assets, preserved evidence, maintained essential work, protected ePHI, coordinated with business associates, restored trustworthy data, and reconciled claims accurately.
Convert findings into assigned corrective actions. Revisit application and data criticality, incident roles, contact lists, vendor dependencies, emergency access, backup isolation, restoration tests, downtime forms or tools, and staff training. Test the revised plan, retain the results, and schedule another exercise rather than treating the review as complete when the report is filed.
OCR Director Paula M. Stannard said in HHS’s June 18, 2026 ransomware settlement announcement: "Effective cybersecurity starts with Security Rule compliance, ensuring that Security Rule provisions are implemented before a cyberattack occurs." That statement is a useful planning standard: the quality of a claims-downtime response is largely determined by controls, roles, backups, and tested procedures established before an incident.
What HHS guidance does—and does not—decide
The HHS OCR materials establish general duties for security-incident response, ePHI continuity, contingency planning, recovery, breach assessment, documentation, and coordination. They do not establish state-specific reporting rules, payer contract terms, Medicare or Medicaid claim deadlines, or one standardized claims-downtime process. Those decisions require the organization’s privacy officer, counsel, incident-response lead, revenue-cycle leaders, relevant payers, and business associates.
