For a federal Clean Air Act Title V operating permit, a facility can generally continue operating under its existing permit while a timely, complete renewal application is pending with the permitting authority. Without that qualifying application, expiration ends the right to operate under that permit. The result can differ if the application was late or incomplete, the facility missed a deadline to provide requested information, or the authorization is not a Title V permit.

“Air permit” covers several kinds of authorization, and their deadlines and expiration rules are not interchangeable. For a real facility, check the permit itself and the rules of the state, local, tribal, or federal authority that issued it.

What happens when a Title V air permit expires?

Title V operating permits are generally issued for terms of no more than five years, according to the U.S. Environmental Protection Agency’s 2024 Title V FAQ. The permit states its own expiration date. A renewal application does not automatically extend every permit: under the federal Title V framework, continued operation during agency review depends on a timely and complete application and on the permitting authority not yet having issued or denied the renewal.

Renewal status General Title V consequence
Timely and complete application; authority has not issued or denied it The existing permit generally remains effective while the authority acts.
No qualifying application, including a late or incomplete filing Expiration can terminate the right to operate under that permit.
Authority has issued or denied the renewal The pending-application continuation no longer applies; follow the final action and applicable permit terms.
Written request for more information was not answered by its deadline Continuation protection may be lost under the applicable rule or permit. Check the specific request and governing provisions.

This table describes the Title V baseline, not every air authorization. A construction permit, state-only operating permit, registration, or other authorization may follow different rules. EPA issues some Title V permits under Part 71; states and other authorities administer most Part 70 programs.

When should a facility file its renewal?

Use the deadline in the facility’s permit and the applicable approved program rule, rather than assuming one date applies everywhere. EPA’s 2024 Title V FAQ describes a timely renewal as one submitted six to 18 months before expiration. EPA’s April 2026 renewal guidance says applicants must apply at least six months before expiration. An EPA-hosted Oklahoma Part 70 rule, effective December 27, 2010, requires an application at least 180 days before expiration. These examples illustrate why the local rule and permit control the facility-specific deadline.

Start by confirming the permit category, issuing authority, expiration date, and stated renewal window. Then determine whether the relevant authority has received the application and regards it as complete. A filing receipt alone may not establish that the application meets the continuation conditions.

What makes a renewal application complete?

The application must provide enough information for the permitting authority to process it and determine whether the facility meets applicable requirements. EPA’s April 2026 guidance identifies information such as regulated pollutant emissions, emission points, emission rates, and limits. The authority may request supplemental information it needs to assess applicability or assure compliance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If permit terms and underlying requirements have not changed, the authority may allow the applicant to reuse or incorporate unchanged information from the prior application. That flexibility does not eliminate the duty to answer a written information request by its specified deadline. Any documents incorporated by reference must also be available for public review.

Can a plant keep operating while renewal is pending?

Under the Title V baseline, a qualifying timely and complete renewal generally keeps the existing permit effective until the authority issues or denies the renewal. EPA’s Part 71 permit example also explains that the permittee’s failure to have a Part 71 permit is not a violation of that part before EPA takes final action, subject to the stated conditions. In that example, failing to provide information EPA requests in writing by its deadline ends the described protection.

Those details are specific to Part 71 and its governing provisions. Do not assume the same language or result applies to a state-only, construction, or other permit. For an operating decision, confirm the application’s status and any outstanding requests directly with the issuing authority; obtain qualified permitting or legal advice if the facility’s right to operate is uncertain.

What if the renewal is late or the permit has expired?

Do not assume a late application restores authority to operate, or that an application still under review is enough to continue. If no applicable continuation rule protects the facility, operating after expiration may amount to operating without the required authorization. The enforcement outcome depends on the permit type, governing law, permit terms, jurisdiction, and facts.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

EPA materials recognize permit noncompliance as a potential basis for enforcement, but they do not establish one penalty amount, shutdown outcome, or enforcement response for every expired permit. A facility should promptly verify the permit’s status and the applicable rule with the issuing authority rather than rely on a general Title V summary.

How can the public find an air permit or renewal application?

Begin with the facility name and permit number, if known, and identify the state, local, tribal, or EPA authority that issued the permit. Search that authority’s permit records or ask it how to access the file. EPA lists draft and final permits, applications, and other permit materials for participating jurisdictions and actions, but electronic availability is not uniform for every agency or older record.

For a useful record set, look for or request:

  • The current permit and prior permit;
  • The renewal application and any correspondence about completeness or additional information;
  • A draft permit, public comments, and the authority’s final action; and
  • Compliance certifications or reports relevant to the concern.

The exact public-records procedure depends on the issuing authority. A missing online document does not by itself show that the agency has no record; ask the agency about its records process.

How can the public comment on or challenge a renewal?

Title V renewals follow the same procedural requirements as initial permit issuance, including public participation, according to EPA’s April 2026 guidance. During the public-comment period, a person can comment on a draft permit and may request a public hearing. EPA describes state-court appeal routes for Part 70 permits and a process to petition EPA to object to certain state-issued permits.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a Title V petition, EPA generally requires the petitioner to have raised the issue with the permitting authority during the notice-and-comment period, unless doing so was impracticable. EPA’s petition information describes a 45-day EPA review of a proposed state permit, followed—if EPA does not object during that review—by a 60-day public petition period. Those are petition-process periods, not renewal deadlines; check EPA’s current action-specific instructions and deadline. EPA notes that the CDX submission timestamp is used to determine timeliness.

How do you report a suspected air-permit violation?

A concern that a facility is violating permit terms is different from a challenge to whether the permit itself is legally adequate. EPA directs the public to report suspected compliance problems through its ECHO system. A Title V petition, by contrast, addresses permit content or legality and is subject to its own procedural requirements.
