Your iPhone photos do not automatically transfer to your family when you die. If you set up an Apple Legacy Contact, that person can request access to certain data in your Apple Account, which may include photos. They need the access key you created and the required death documentation. Without a Legacy Contact, family can ask Apple to consider access to or deletion of the account, but approval and document requirements depend on the country or region.
How your family may be able to get your photos
The key issue is whether the photos are stored in your Apple Account and whether someone can access that account through Apple’s process. Apple says Legacy Contact data may include photos, messages, notes, files and device backups; it does not make account data available to relatives automatically after the account holder dies. Legacy Contact: the route to prepare in advance
A Legacy Contact is someone you choose to request access to certain Apple Account data after your death. To make the request, the contact needs the access key you generated and required proof of death. Apple checks the request before granting access. The contact does not need an Apple Account or Apple device.
Apple’s process when no Legacy Contact was set up
Family can submit a request to access or delete a deceased person’s account. Apple generally requires a death certificate and may require a court order or other documents. Requirements differ by country or region, and Apple may be unable to provide some data protected by end-to-end encryption. What a Legacy Contact can—and cannot—access
Access is limited to certain account data. Apple excludes purchased movies, music and books, subscriptions, and iCloud Keychain information such as payment details, passwords and passkeys. Apple’s Platform Security explanation describes the access-key arrangement and says Apple issues a new account login after completing its checks.
How to add a Legacy Contact on iPhone or iPad

Open Settings and tap your name.

Tap Sign-In & Security, then Legacy Contact.

Tap Add Legacy Contact and follow the prompts to choose someone you trust.

Share the access key with that person through iMessage or print it and keep it with your estate-planning documents. Confirm they received it.
Apple also supports adding a Legacy Contact on Mac. The current setup screens and requirements are described in Apple’s setup guide.

Keep the access key and account details findable
A designation alone is not enough if the person cannot find the access key when it is needed. Keep a copy where your estate documents are stored, and tell your contact where to find it and the relevant death documentation and account details. Apple’s request process requires documentation, and local requirements can differ.

Recovering account data and setting up the physical phone for another person are separate tasks. After Apple approves a Legacy Contact or account-deletion request, Activation Lock is automatically removed, but the iPhone still has to be erased and restored before another Apple Account can use it. Apple cannot remove a forgotten device passcode without erasing the device. If photos may exist only on the phone, check for an access key and contact Apple about the deceased-account process before attempting a reset.
