In the U.S., crypto held by an exchange is not protected by FDIC deposit insurance just because the company uses a bank. If an insured bank fails, eligible deposits may be transferred to another bank or paid out up to the applicable insurance limit. If a crypto company fails, access to assets may be frozen and what customers recover depends on the company’s agreements, records, remaining assets, and the insolvency process. The key distinction is what you own a claim to—and which institution holds it.

Bank failure and exchange failure are different

FDIC insurance applies to eligible deposits at FDIC-insured banks, not to crypto assets or a nonbank crypto company’s failure. The FDIC says crypto assets are not insured financial products and that its insurance does not cover a nonbank’s default, insolvency, or bankruptcy. See the FDIC’s crypto fact sheet.

Where the asset or claim is What failure may mean What protection to check
Eligible cash deposit at an FDIC-insured bank If the bank fails, the FDIC may arrange a transfer to a healthy bank or pay depositors directly, subject to applicable coverage rules. Confirm the insured bank, account ownership and beneficiary structure, and applicable limits. FDIC bank-failure guidance.
Crypto or a claim against a nonbank exchange or custodian The FDIC does not insure the crypto or protect customers against the company’s insolvency. Withdrawals or account access may be interrupted while claims are handled. Read the platform agreement and determine how it treats custody, lending, segregation, title, and insolvency. FDIC crypto fact sheet.
Eligible securities claim at a SIPC-member broker-dealer A SIPA proceeding may seek to transfer customer accounts to another brokerage; liquidation may follow if a transfer cannot be arranged. Check that the firm is a SIPC member and that the particular asset and claim qualify. U.S. Courts overview of SIPA.
Crypto in self-custody You are less dependent on an exchange’s continued operation, but access depends on keeping control of the necessary keys and recovery information. Plan for secure key storage and recovery; self-custody is not insurance. SEC staff custody statement.

A platform’s relationship with a bank does not automatically turn your crypto or your claim against the platform into a bank deposit. If a service says “FDIC insured,” check whether it means only cash held at a partner bank, whose name is on that account, and whether the representation applies to your specific balance. The FDIC’s bank-failure process concerns the insured bank and eligible deposits—not crypto held by a separate company.

Does FDIC insurance cover crypto or an exchange account?

No. The FDIC’s stated coverage is for eligible deposits at insured banks, not for crypto assets. It also does not guarantee that customers of a nonbank exchange will get their assets back if that company fails. The answer can differ for cash associated with a platform: if the cash is actually held as an eligible deposit at an insured bank, bank-deposit coverage may be relevant if that bank itself fails. The bank, account structure, and ownership category matter, so verify them rather than assuming an advertised connection means your whole platform balance is insured.

Would SIPC protect crypto if a brokerage or exchange fails?

Not automatically. SIPC protection relates to eligible customer claims at SIPC-member broker-dealers under a special liquidation process; it is distinct from FDIC insurance. A crypto exchange is not necessarily a SIPC member, and an asset being described as “crypto” does not establish that it is a covered security.

SEC Trading and Markets staff says SIPC does not protect custodial claims for non-security crypto assets held for customers by a SIPC-member broker-dealer. It also notes that a broker-dealer might agree to treat non-security crypto as a “financial asset” carried in a “securities account” under Article 8 of the Uniform Commercial Code. That kind of arrangement could help keep assets out of the broker-dealer’s estate, but it is not a universal guarantee or a general insurance promise. The staff FAQ warns: “Non-security crypto assets are not protected by SIPA and may not be protected by any other specific insolvency regime, and customers may be exposed to loss of such assets in the event of an insolvency.” Read the SEC staff FAQ and the U.S. Courts’ SIPA overview.

The SEC’s March 17, 2026 interpretation clarifies how federal securities laws apply to categories of crypto assets, including digital commodities, collectibles, tools, stablecoins, and digital securities. Classification can affect which securities rules apply, but the interpretation does not create deposit insurance or by itself promise recovery in an insolvency. See the SEC announcement.

What can happen to customers when an exchange fails?

A failure can mean an immediate loss of access even before the final treatment of customer claims is known. The provider may stop withdrawals, and customers may need to rely on court, receiver, trustee, or other official processes. There is no universal payout percentage or timetable for customers of failed crypto platforms.

The Federal Trade Commission’s October 12, 2023 Voyager enforcement release described customers being locked out of cash accounts for more than a month and alleged that consumers lost more than $1 billion in crypto assets after Voyager’s collapse. Those are allegations and circumstances from that specific case, not a general measure of exchange failures. The FTC said Voyager was not a bank and that its customers’ crypto was not protected by FDIC insurance; it distinguished the crypto from cash held in an account at a traditional bank, which would have been protected only if that bank failed and the deposit qualified. The release also described a $1.65 billion judgment, suspended to permit Voyager to return remaining assets; that judgment figure is not a customer recovery total. See the FTC’s Voyager release.

Why recovery depends on the account and legal structure

Customers at the same failed company may not necessarily have identical claims. Relevant details include the product selected, the agreement’s custody and lending terms, whether assets were segregated or commingled, who held title, the platform’s records and remaining assets, and the governing insolvency law and jurisdiction. A simple custody account may have different terms from a lending or rewards product. The SEC staff discussion of possible Article 8 treatment and the U.S. Courts’ description of SIPA proceedings show why account structure can matter; neither establishes a universal result for crypto customers.

How to check your exposure before a failure

  1. Identify what you hold. Separate crypto, cash held by the platform, and any cash deposit at a bank. For a claimed bank deposit, identify the actual bank and check whose name is on the account and how ownership is recorded.
  2. Read the terms for the specific product. Look for custody, lending, reuse, segregation, withdrawal, title, and insolvency provisions. Do not assume a rewards or yield account has the same terms as ordinary custody.
  3. Check the legal entities and protections. Determine whether the provider is a bank, a nonbank platform, or a SIPC-member broker-dealer, and whether the particular deposit or asset could qualify for the protection being described.
  4. Keep your own records. Save statements, transaction histories, wallet addresses, and important communications somewhere you can access if the platform interface is unavailable.
  5. Decide whether self-custody fits your skills and recovery plan. The SEC explains that private keys are needed to access and transfer crypto securities. A hardware wallet can be a physical tool for managing keys, but it is not insurance or a recovery guarantee. See the SEC staff statement on broker-dealer custody.

The SEC’s December 17, 2025 custody statement discusses broker-dealer procedures for protecting private keys, handling disruptions, and transferring crypto asset securities in bankruptcy, receivership, liquidation, or similar proceedings. It represents staff views and expressly has no legal force or effect; it is not a binding rule for every crypto company.

What to do if a provider fails

  • Follow official notices from the FDIC, court, bankruptcy trustee, receiver, or platform, as applicable, and use the contact channels named in those notices.
  • Preserve account statements, transaction records, wallet addresses, and communications that support your claim.
  • Be cautious of unsolicited “recovery agents” promising guaranteed retrieval. Do not provide keys, passwords, or recovery phrases to someone who contacts you with that promise.
  • If you need advice about a specific claim, consult a qualified professional in the relevant jurisdiction; the outcome depends on the facts and governing law.
