An open criminal case generally does not end automatically when a district attorney leaves office. A successor, other authorized prosecutor, or temporary appointee may handle it under the law that applies in that state and county. The specific answer depends on why the district attorney left, who has authority to take over, and what the court docket or an appointment order says.
Who takes over a pending case?
There is no single succession procedure for every state and county. Depending on local law and the circumstances, the case may remain with assistant prosecutors in the office, pass to an elected or appointed successor, or be assigned to a temporary or special prosecutor. The prosecutor’s departure, by itself, does not establish that the case has been dismissed, transferred to another court, or given a new outcome.
Texas illustrates how specific these rules can be. Its code assigns district attorneys duties in district-court criminal cases and appeals, provides county-attorney representation in specified circumstances when the district attorney is absent, and allows a judge to appoint an eligible attorney to perform prosecutorial duties during an absence, disqualification, inability to act, or when no attorney represents the state. These are Texas rules, not a nationwide procedure. Texas Code of Criminal Procedure, Article 2A.102; Article 2A.103; Article 2A.104.

A district attorney leaving at the end of a term with a successor ready to take office is different from a sudden vacancy, resignation, death, suspension, or removal. A prosecutor may also withdraw from one case because of a conflict or disqualification while remaining in office. Those situations can trigger different appointment or succession rules, and a case-specific order may determine who appears next.

North Carolina, for example, has a statutory judicial process addressing suspension or removal of a district attorney; that process does not create a rule for pending cases across the country. North Carolina General Statutes, Chapter 7A, Article 9.
What a replacement prosecutor may need to do
A new prosecutor or office may need to review the file, including discovery, witness preparation, deadlines, plea discussions, and disclosure obligations. The U.S. Department of Justice’s archived guidance for federal prosecuting offices says that a new requesting official should make an independent assessment of relevant potential impeachment information rather than simply rely on a former official’s decision. Review does not, on its own, mean the evidence or likely result has changed. Whether a hearing proceeds as scheduled, a continuance is requested, or a filing is required depends on the case and applicable rules.
Federal rules do not decide state or county succession
Federal criminal rules apply to federal cases and address different questions from local district-attorney succession. Federal Rule of Criminal Procedure 20 allows a limited transfer for plea and sentence when the defendant consents in writing and the U.S. attorneys in both districts approve in writing. It is not a general procedure for moving a case because a prosecutor leaves. Rule 18 concerns the district where a federal offense is prosecuted and trial location; it does not identify who succeeds a local elected prosecutor. How to find out what is happening in a particular case
- Identify the jurisdiction and court. Confirm the state, county, court, and whether the case is state or federal. The rules for one jurisdiction do not establish what happens in another.
- Check the official docket. Look for the next hearing date, a notice of appearance, a motion for continuance, or an order appointing a replacement prosecutor. A change in officeholder alone does not tell you whether the schedule has changed.
- Verify the appointment or succession authority. Check the current state statute, applicable local rules, and any court or appointing-authority order. Confirm whether the authority covers the whole office or only a particular case.
- Ask a lawyer familiar with the case. A case’s procedural stage and any pending motions can affect what happens next. Do not infer dismissal, delay, or a changed plea offer solely from the district attorney’s departure.
For a reliable case-specific answer, the relevant details include the reason and effective date of the departure, who has been authorized to take over, the current docket, and any recusal, appointment, or continuance order. The Texas code also states that the primary duty of an attorney representing the state, including a special prosecutor, is “not to convict but to see that justice is done”; that statement describes the duty, not an automatic case outcome.
