Updated August 9, 2026: Netflix is no longer buying Warner Bros. Discovery. Netflix withdrew from the bidding on February 26, 2026, and Warner Bros. Discovery terminated its agreement with Netflix on February 27. Paramount Skydance is now the proposed buyer, but that transaction has not closed.

HBO Max is still operating as a separate streaming service. You do not need a Netflix subscription to use it, Netflix subscribers do not automatically receive HBO Max, and there is no current Netflix-driven account migration, price change, or app merger.

The pending Paramount Skydance transaction could eventually change HBO Max’s ownership, pricing, app, or subscription structure. However, no final consumer migration plan has been announced, and litigation has delayed the deal. For now, choose whether to keep or cancel HBO Max based on its current catalog and price—not on the abandoned Netflix announcement.

The short answer

Question Current answer
Is Netflix still buying Warner Bros.? No. Netflix declined to raise its offer on February 26, 2026.
Did Netflix buy HBO Max? No. The proposed transaction never closed.
Is HBO Max shutting down? There is no verified shutdown announcement. HBO Max remains an active service.
Do HBO Max subscribers need Netflix? No. HBO Max and Netflix remain separate subscriptions.
Who is the proposed buyer now? Paramount Skydance. Its proposed deal is still pending and faces legal and regulatory challenges.

Netflix’s original announcement is now historical context. The practical question for subscribers is what happens while Warner Bros. Discovery remains independent and what a possible Paramount Skydance acquisition might mean later.

What happened to the Netflix deal?

Netflix announced a planned acquisition of Warner Bros.’ film and television studios, HBO, and HBO Max on December 5, 2025. The proposed deal was valued at approximately $72 billion in equity value and $82.7 billion in enterprise value, based on a proposed price of $27.75 per Warner Bros. Discovery share. The transaction was designed to follow a planned separation of Discovery Global, so it was not originally a purchase of every Warner Bros. Discovery business.

Netflix later amended the proposed transaction to an all-cash structure on January 20, 2026. That still did not make the purchase final. After Paramount Skydance made a higher offer, Netflix announced on February 26 that matching the price was no longer financially attractive. Warner Bros. Discovery terminated the Netflix agreement the following day. The company’s filing with the Securities and Exchange Commission records that Paramount Skydance paid the $2.8 billion Netflix termination fee on Warner Bros. Discovery’s behalf under the transaction terms.

These details are documented in Netflix’s original acquisition announcement, its all-cash amendment announcement, Netflix’s withdrawal announcement, and Warner Bros. Discovery’s 2025 Form 10-K.

  • 2026: The Paramount-Warner Bros. Discovery transaction remains pending amid lawsuits from a coalition of state attorneys general and the Writers Guild of America. Recent Associated Press reporting says closing has been delayed into 2027 or until the relevant litigation is resolved.

Did Netflix buy HBO Max?

No. Netflix proposed buying the Warner Bros. businesses that included HBO and HBO Max, but the agreement was terminated before closing. HBO Max therefore did not become a Netflix service, and Netflix did not acquire ownership of HBO Max or the Warner Bros. Discovery catalog through that announcement.

Warner Bros. Discovery’s 2025 Form 10-K explicitly records the termination of the Netflix merger agreement. Warner Bros. Discovery remains the company operating HBO Max while the Paramount Skydance transaction is pending.

What Netflix originally planned for HBO Max

It is useful to separate Netflix’s former intentions from its current plans. Netflix’s filed subscriber FAQ said that existing Netflix and HBO Max memberships would not change immediately, that HBO Max would continue separately, and that the two companies would remain separate until the transaction closed. In other words, even if the deal had proceeded, subscribers were not supposed to be moved into a new combined account on day one.

In a transcript filed with the SEC, Netflix co-CEO Ted Sarandos described a possible future in which HBO Max remained available as a standalone product while Netflix explored ways to offer HBO Max together with a Netflix subscription. He also indicated that HBO programming would remain with HBO and that existing pay-television and international output arrangements would continue to be honored. However, he did not definitively guarantee that the HBO Max name would remain forever.

Those statements describe a proposed transition strategy that was never implemented. They do not mean that Netflix currently offers HBO Max, that HBO Max subscribers receive Netflix, or that the old standalone-product plan governs the pending Paramount transaction. The relevant documents are Netflix’s subscriber FAQ and the SEC-filed Sarandos interview transcript.

Is HBO Max shutting down?

Not based on any verified current announcement. HBO Max continues to operate with its own app, plans, billing arrangements, profiles, and catalog. Warner Bros. Discovery’s first-quarter 2026 materials continued to describe HBO Max as an active business and listed scaling HBO Max globally among the company’s priorities. The company also reported international expansion into markets including the United Kingdom and Ireland.

That means the accurate statement is HBO Max is not shutting down now because of the abandoned Netflix deal. It would be too strong to promise that the service will never change or never be replaced. Its long-term future may depend on whether Paramount Skydance completes its proposed acquisition and what terms or regulatory remedies apply.

What HBO Max costs today

For customers billed directly in the United States, HBO Max currently lists these plans:

Plan Monthly price Annual price
Basic with Ads $10.99 $109.99
Standard $18.49 $184.99
Premium $22.99 $229.99

These are U.S. direct-billed prices listed by HBO Max’s plan and pricing help page. Taxes are additional, and the amount or terms can differ for customers billed through Apple, Google, Amazon, Roku, cable companies, wireless providers, other distributors, promotional offers, bundles, or legacy arrangements. Do not apply these U.S. prices automatically to other countries, where availability, catalogs, sports rights, taxes, and billing partners vary.

There is currently no Netflix-related price increase to account for. Any later change would come from Warner Bros. Discovery’s own pricing decisions or from a completed Paramount transaction—not from the canceled Netflix proposal.

What does Paramount Skydance plan to do with HBO Max?

Paramount Skydance announced a separate proposed acquisition of Warner Bros. Discovery on February 27, 2026. Its announcement describes a larger direct-to-consumer business combining Paramount+, HBO Max, and Pluto. Paramount’s announced offer was $31 per Warner Bros. Discovery share in cash, with an enterprise value of approximately $110 billion.

That is an announced corporate and streaming strategy, not a finished consumer product plan. Paramount has not published final details answering the questions most subscribers care about.

Officially stated

  • Paramount Skydance wants to combine Paramount+, HBO Max, and Pluto into a larger direct-to-consumer business.
  • The proposed acquisition would bring Warner Bros. Discovery’s assets under Paramount Skydance if it closes.
  • The transaction has not closed and remains subject to legal, regulatory, and other closing conditions.

Still unknown

  • Whether the HBO Max app will remain, disappear, or become part of Paramount+.
  • Whether Paramount+ will remain a separate service.
  • Whether HBO Max content will become a premium tier, a bundle, or a separate subscription.
  • Whether subscribers will be migrated automatically or asked to create new accounts.
  • Whether prices, advertising tiers, annual plans, or sports add-ons will change.
  • Whether profiles, watch history, downloads, parental controls, and saved lists will transfer.
  • How HBO’s brand and editorial identity will be organized within the combined company.
  • How sports, news, children’s programming, Discovery content, and advertising will be arranged.
  • When any consumer-facing changes would happen.

Do not treat claims that HBO Max will definitely become Paramount+, that the app will definitely disappear, or that subscribers will definitely receive a discounted bundle as confirmed facts. The Paramount-Warner Bros. Discovery announcement establishes the proposed combination, but not the final app architecture or subscription terms.

Why the legal status matters

The Paramount proposal is not simply waiting for a routine app update. A coalition of state attorneys general and the Writers Guild of America has brought legal challenges seeking to block the transaction. The WGA’s announcement explains its lawsuit, while recent AP reporting describes the resulting delay.

Until those issues are resolved and the deal closes, Warner Bros. Discovery continues operating HBO Max. Even if the transaction is eventually approved, regulators could impose conditions or require remedies that affect the combined company’s structure. A closing date in 2026 should not be treated as certain; current reporting points to 2027 or a later date if litigation continues.

Will Netflix get Warner Bros. movies and HBO shows?

Not automatically. The abandoned acquisition did not transfer Warner Bros. Discovery’s catalog to Netflix.

Some Warner Bros. films or television programs may already appear on Netflix under separate licensing agreements. Other titles may become available there in the future if the companies negotiate ordinary licensing deals. But the former acquisition announcement does not guarantee that Netflix will receive Harry Potter, Game of Thrones, DC films, Friends, or every other Warner Bros. title.

Availability depends on ownership, existing output agreements, territorial rights, theatrical and television windows, and separate licensing decisions. HBO programming continues to be distributed through HBO Max and existing television or platform arrangements while Warner Bros. Discovery remains independent.

What happened to the rest of Warner Bros. Discovery?

The scope of the two proposals is easy to confuse. Netflix’s original plan focused on Warner Bros.’ film and television studios, HBO, and HBO Max after a planned separation of Discovery Global. It was not a simple purchase of the entire Warner Bros. Discovery company. That distinction matters for assets associated with CNN, Discovery networks, cable channels, sports, Discovery+, and other operations.

Paramount Skydance’s later proposal is for the broader Warner Bros. Discovery company. If it closes, its consequences could therefore extend well beyond the HBO Max app. The exact treatment of those businesses remains subject to the final transaction terms and any regulatory requirements.

Should you cancel HBO Max?

No cancellation is required because of the old Netflix headline. Make the decision based on whether HBO Max’s current programming and price are worthwhile for you.

Your situation Practical action
You currently subscribe to HBO Max Keep it if you use HBO, Warner Bros. films, DC programming, sports, downloads, or current originals enough to justify the plan. Cancel only if the current value is poor.
You have Netflix but not HBO Max A Netflix subscription does not currently include HBO Max. Subscribe separately only if you want HBO Max’s catalog.
You have HBO Max through a cable, wireless, or streaming provider Check that provider for billing, plan, promotion, and access details. A future corporate change may affect provider bundles differently from direct subscriptions.
You have an annual HBO Max plan Check your renewal date and account terms before canceling. The immediate issue is renewal timing, not a Netflix migration.
You are outside the United States Check your local HBO Max site or provider. U.S. prices, catalogs, sports rights, and availability do not necessarily apply in your country.

If you decide to cancel

  1. Find out who bills you: HBO Max directly, an app store, a device platform, a cable company, a wireless carrier, or another partner.
  2. Cancel through that billing provider’s account controls. The relevant HBO Max cancellation guidance explains that the cancellation route depends on how you subscribed.
  3. Check the effective end date and renewal status. Annual subscribers should pay particular attention to the next renewal date.
  4. Do not assume that deleting the HBO Max app cancels the subscription. Account cancellation and app removal are separate actions.

What could improve or worsen if Paramount eventually closes?

These are possible consequences, not confirmed outcomes:

Potential benefits

  • A larger catalog spanning Paramount, HBO, Warner Bros., and Discovery brands.
  • Fewer separate subscriptions if the services are consolidated effectively.
  • More negotiating power for sports rights and international distribution.
  • A larger competitor to Netflix, Disney+, Amazon, and other major streaming platforms.

Potential drawbacks

  • Higher prices or more expensive premium tiers.
  • Less consumer choice if two services become one.
  • Catalog removals or temporary gaps during integration.
  • Complicated migration of profiles, watch history, parental controls, downloads, and saved lists.
  • More advertising, sports upselling, or separate add-on charges.
  • Uncertainty about whether HBO’s prestige brand remains operationally distinct.
  • Content cuts, layoffs, or reduced production as the combined company seeks savings.
  • Regulatory remedies that could require asset sales or operational restrictions.

None of these possibilities is a reason to change your account today. They are the kinds of issues to evaluate only after Paramount’s deal is approved, closed, and accompanied by specific subscriber policies.

What to watch for next

The announcements that would create a real HBO Max subscriber decision are not another recycled headline about Netflix. Look for official information about:

  • Regulatory or court decisions involving the Paramount transaction.
  • A confirmed closing date.
  • Whether HBO Max remains a standalone service.
  • New U.S. and international pricing or plan names.
  • Bundle, billing, and automatic-migration rules.
  • Profile, watch-history, download, and parental-control transfer policies.
  • Catalog and sports-rights changes.
  • Any change to HBO Max’s name, app, or login process.

Frequently Asked Questions

Did Netflix buy HBO Max?

No. Netflix proposed acquiring Warner Bros.’ film and television studios, HBO, and HBO Max, but Netflix withdrew on February 26, 2026, and Warner Bros. Discovery terminated the agreement on February 27. The transaction never closed.

Is HBO Max becoming part of Netflix?

Not under any current deal. Netflix no longer owns or operates HBO Max, and Netflix subscribers do not automatically receive HBO Max. The former Netflix proposal discussed keeping HBO Max standalone initially and possibly offering it alongside Netflix, but that plan was never implemented.

Will HBO Max shut down?

There is no verified announcement that HBO Max is shutting down now. It remains an active, separate service. Its longer-term future could depend on the pending Paramount Skydance acquisition, but no permanent outcome has been announced.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do I need both Netflix and HBO Max?

If you want both services, you currently need separate subscriptions unless a third-party provider offers a specific bundle. Netflix does not currently include HBO Max, and HBO Max does not automatically include Netflix.

Will Netflix get Harry Potter, Game of Thrones, or DC titles?

There is no automatic catalog transfer. Individual Warner Bros. titles may be licensed to Netflix in some territories, but the canceled acquisition does not guarantee that these franchises or the full Warner Bros. catalog will move to Netflix.

Will HBO Max prices increase?

There is no Netflix-related price increase to apply today. HBO Max’s current U.S. direct-billed prices are $10.99 monthly for Basic with Ads, $18.49 for Standard, and $22.99 for Premium, with annual options also available. Third-party and international prices can differ. A future Paramount-related change is possible but has not been announced.

What happens if Paramount Skydance buys Warner Bros. Discovery?

Paramount has described a combined direct-to-consumer business involving Paramount+, HBO Max, and Pluto. It has not yet confirmed whether the HBO Max app, name, pricing, profiles, watch history, or standalone subscription will remain. The transaction is still pending and faces litigation.

Will my HBO Max profile or watch history move to Paramount+?

There is no current migration, and no official transfer policy has been announced. Claims that profiles or watch history will definitely be preserved—or definitely lost—are speculation until Paramount publishes implementation details.

Does this affect HBO through cable or another TV provider?

HBO programming continues through HBO Max and existing television or platform arrangements while Warner Bros. Discovery remains independent. If you receive HBO through a cable, wireless, or other provider, that provider controls your billing and current package terms.

Are the current U.S. HBO Max prices valid everywhere?

No. The listed prices are for U.S. direct-billed plans. International availability, catalogs, sports rights, taxes, currencies, and distribution partners vary by territory. Customers billed through third parties may also have different prices or plan terms.

The Bottom Line

Netflix’s Warner Bros. deal is over, and HBO Max is not becoming a Netflix service. HBO Max remains separate and available today, with no Netflix-required login, migration, or cancellation.
