An AI company’s sale or IPO does not automatically change your subscription, contract, or data rights. What happens depends on how the transaction is structured, what your agreement says, applicable privacy law, and what the provider decides to change afterward. A public listing changes who can buy and sell the company’s shares; it does not, by itself, rewrite a customer contract.

What changes—and what does not—when ownership changes?

Start by distinguishing a change in the company’s shareholders from a transfer of the business. In a share sale, the company that provides the service may remain the same legal entity and contracting party. In an asset sale or divestiture, contracts or data may be transferred to another entity. The transaction documents and your agreement determine the significance for customers; these are useful distinctions, not categories that describe every deal.

An IPO is a public listing of shares, not necessarily a change in the identity of the company that owes you service under your contract. Neither an IPO nor a change of control alone establishes that prices, features, support, model access, or data practices will change. Check for an actual announcement or contractual notice rather than assuming continuity or disruption.

Will your subscription or business contract continue?

Read the service agreement for provisions on assignment, change of control, termination, renewal, price changes, and service changes. An agreement may treat a share sale differently from transferring the contract to a buyer. Do not assume that every agreement requires customer approval, or that every agreement permits transfer without it.

For a divestiture required as part of an FTC merger remedy, the FTC’s Negotiating Merger Remedies guidance says required third-party consents and approvals must be obtained before the FTC Bureau recommends approval. It specifically addresses customer consent when contracts cannot be transferred without it. That guidance concerns regulator-reviewed divestitures; it is not a blanket rule requiring customer consent for every acquisition or ownership change.

If you are a business customer with negotiated terms, review the signed agreement and any amendments, not just the provider’s general terms page. Where a transfer, termination, or service change could materially affect your operations, obtain advice specific to your contract and jurisdiction.

Can a new owner use your prompts, files, or other data differently?

Separate the question of whether data may be transferred in a transaction from whether the new owner may use it differently afterward. A deal document or privacy notice may address data transfer, but that alone does not establish what uses are permitted under your specific provider’s promises or applicable law.

FTC staff guidance in a 2010 report on a proposed privacy framework said companies should honor promises already made about consumer data. It also said that using data in a materially different way from what was represented calls for prominent disclosure and opt-in consent. This is historical FTC staff guidance, not a complete statement of current law in every jurisdiction or a universal rule for all AI services.

Transaction terms can address data transfer explicitly. For example, a 2013 merger agreement filed with the SEC represented that the parties’ privacy policies contemplated user-data transfer in a merger, acquisition, reorganization, or asset sale, and that the transaction would not violate those policies or applicable privacy law. That is an example of deal-specific drafting—not evidence that another provider’s terms allow the same transfer.

For covered financial institutions and nonpublic personal information, the FTC’s Gramm-Leach-Bliley Act privacy guidance describes notice and opt-out duties for certain information sharing. It does not apply to every AI company or every commercial customer.

What to check after a sale, merger, or IPO announcement

  1. Save the announcement and any customer-specific notice. Record what the provider says is changing, when it takes effect, and whether the message applies to your plan or account.
  2. Review the current agreement and privacy notice. Look for assignment and change-of-control clauses, renewal and termination rights, price-change terms, and promises about data use.
  3. Check for specific service or data changes. Look for stated changes to availability, support, model access, data retention, training use, or subprocessors. Do not treat an ownership announcement alone as proof that any of these have changed.
  4. Identify options the actual terms provide. Check whether you can terminate, decline renewal, export or delete data, or object to a change, and note any deadlines or conditions. These options are not guaranteed to exist in every provider’s terms.
  5. Ask about a proposed new data use. Compare it with the promises made when your data was collected and ask what notice, choice, or consent applies to your account and jurisdiction.

The available authorities do not establish what will happen to customers of any particular AI provider. For a real transaction, use that provider’s agreement, customer notice, privacy notice, and transaction filings to determine the effect on your account.
