If you file an Indian GST return late, a late fee may apply; if tax remains unpaid, interest may also be due. If a filed return contains an error, you generally correct it through a permitted amendment or a later return—not by editing the filed form at will. The consequences and fix depend on the return, tax period, error, and current rules.
What happens when an Indian GST return is filed late?
A delayed return can attract a late fee under the applicable provision and notifications. Separately, interest may apply if tax was not paid by its prescribed due date. A late return does not, by itself, establish that interest is due: the tax liability and applicable calculation must be checked.
Late fee depends on the return and applicable relief
Section 47(1) of the Central Goods and Services Tax Act, 2017 states a late fee of ₹100 for each day of delay, subject to a maximum of ₹5,000, for the specified delayed statements or returns. This is the statutory provision, not a universal amount for every GST return. Amendments, notifications or relief, return type, and taxpayer category can change what is payable; check the current portal liability for the specific period.

Interest concerns unpaid tax, not simply a late filing
Section 50 of the Act provides for interest on tax that remains unpaid within the prescribed period. The applicable notified rate and calculation rules matter. Establish whether tax was unpaid, which period it relates to, and the relevant calculation method before treating interest as due.

Missed returns can block later filing and prompt a notice
Section 39(10) says a registered person generally cannot furnish a return for a tax period if a previous-period return has not been furnished. In its own words: “A registered person shall not be allowed to furnish a return for a tax period if the return for any of the previous tax periods has not been furnished by him.” The GST Portal also has sequencing constraints for GSTR-1 and GSTR-3B, so check the portal for the affected return type.
Under section 46, when a registered person fails to furnish a return under section 39, 44, or 45, a notice is to be issued requiring the return within 15 days in the prescribed form and manner. The notice process and any further consequences depend on the circumstances.

What to do if a filed GST return contains a mistake
First identify the exact form, tax period, and error—such as a missed invoice, incorrect invoice detail, or tax shortfall. The correction route is not the same for every GST form, and the timing can determine which option remains available.
GSTR-1: use GSTR-1A when the same-period window is open
The GST Portal GSTR-1 guide describes GSTR-1A as an optional facility to add or amend records in a filed GSTR-1 for the same period. It becomes available after GSTR-1 is filed or after its due date, whichever is later, and can be used before filing GSTR-3B for that period. Changes flow into that period’s GSTR-3B. The recipient’s input tax credit for a supply added or amended through GSTR-1A is reflected in the recipient’s next-period GSTR-2B. It is not an always-available edit after GSTR-3B has been filed.

Other eligible errors: section 39(9) provides a later-return route
For returns covered by section 39(9), an omission or incorrect particular may generally be rectified in the return for the month or quarter in which it is noticed, subject to the statutory cutoff and any interest due under the Act. This route does not cover corrections arising from scrutiny, audit, inspection, or enforcement activity. Confirm that the form and error fit this provision rather than assuming it applies to every GST filing.
How much time is available to correct an error?
Two relevant deadlines are expressed differently and should not be collapsed into one rule.

- Section 39(9) corrections: the Act frames its cutoff around the due date for the September return or the second-quarter return following the end of the relevant financial year, or the date the annual return is filed, whichever is earlier.
The GSTR-1 guide’s date is specific to that portal process; section 39(9) is a statutory correction rule. Which deadline applies depends on the form and correction involved. Check current law, notifications, and portal guidance for the relevant period, especially if a deadline may have passed.
Check the portal’s interest amount rather than relying on it blindly
GSTN’s January 2026 advisory on interest collection and GSTR-3B enhancements says an enhancement applies from the January 2026 tax period and accounts for the minimum electronic cash-ledger balance under Rule 88B(1). GSTN describes the system-calculated interest as a minimum; taxpayers remain responsible for self-assessing the correct amount and increasing it where necessary.

GSTN’s 6 March 2026 advisory on re-computation of GSTR-3B interest addresses a possible technical discrepancy in some February 2026 interest amounts displayed in March 2026. If a taxpayer observed a discrepancy in that situation, the advisory describes using “RE-COMPUTE INTEREST.” These advisories concern the stated periods and portal behavior; verify current portal guidance before relying on a calculation.
Quick Recap
What to check before filing or correcting
- Identify the GST form and tax period, and whether the return is still pending or has already been filed.
- Check whether tax was unpaid by its due date; assess any interest separately from the late fee.
- If a prior return is pending, check the portal’s filing sequence and address the earlier return before attempting later periods.
- For an error in GSTR-1, check whether same-period GSTR-1A is available before filing GSTR-3B.
- For a prior-period correction, verify the applicable statutory or form-specific cutoff and current notifications.
- For a material tax shortfall, potentially expired window, or disputed interpretation, consult a qualified GST practitioner.
