If a government loses the device or wallet interface but still has a valid recovery seed, backup, custodian, or alternate signing route, it may be able to restore access. If every usable path to the private key is irretrievably lost, the Bitcoin remains visible on the blockchain but cannot be transferred with that key. The available official sources document key loss mechanics and government seizures using obtained keys; they do not establish a confirmed government Bitcoin holding made inaccessible by irretrievable key loss.
What losing access actually means
Bitcoin is not stored inside a wallet as a recoverable file. The blockchain records transactions and balances; a private key provides the cryptographic authority to sign a transaction spending the associated Bitcoin. A wallet device or app manages access to key material, but losing that device alone does not prove that the key itself is gone.
The SEC-filed notice published in the Federal Register states: “If a private key is lost, the corresponding bitcoin is thereafter permanently non-transferable.” The public ledger has no password-reset function. If the key and every valid recovery or signing route are lost, the Bitcoin remains on the ledger but cannot be moved through that key. Conversely, someone who obtains a valid key may be able to transfer the Bitcoin, making key exposure a theft risk as well as key loss an access risk. Federal Register notice.
Can lost Bitcoin be recovered?
Recovery depends on whether usable key material or an authorized signing route still exists, not on whether the original device can be found. An intact recovery seed may restore a wallet on a replacement device; an institutional custodian or surviving key shard may provide another authorized route. A new hardware wallet by itself does not recreate a missing private key.

These conditions describe the general technical consequence; the sources do not establish how every government structures custody or whether a particular state could recover a particular holding.
How institutional custody can reduce—but not eliminate—risk
The Federal Register filing describes one trust arrangement using offline key generation, encrypted key shards stored in geographically distributed locations, cold storage, and transfer procedures involving multiple encrypted shards, usernames, passwords, and two-step verification. Such measures can avoid making one device or one person the sole point of failure, but they are an example of a specific arrangement, not a universal standard or evidence that governments use the same design. What documented government cases show
Publicized seizures demonstrate that authorities can take control when they obtain valid key material or cooperation and use legal process. They do not show that officials can bypass a missing private key.
- Bitfinex seizure: The U.S. Department of Justice said court-authorized searches of online accounts found files containing the private keys for the wallet holding the stolen funds. Agents recovered more than 94,000 bitcoin in 2022. The case involved obtaining key files, not recovering Bitcoin after the controlling keys were lost. U.S. Department of Justice.
- 1HQ3 / Silk Road-related forfeiture: A Supreme Court docket filing recounts that Individual X had the private key enabling transfers from the 1HQ3 wallet and consented to forfeiture. The government took custody of 69,370 bitcoin in November 2020. This account describes access through a key holder and legal process, not a cryptographic bypass. Supreme Court docket filing.
Government ownership, seizure power, and custody are different
A government’s authority to seize assets does not mean it owns Bitcoin, holds its keys, or can access coins without them. In a parliamentary answer dated 18 December 2024, the UK Home Office said, “The Government does not hold any Bitcoin,” and said independent law enforcement bodies and courts consider action to seize, recover, and manage cryptoassets. That answer describes the UK position on that date; it should not be generalized to other governments or treated as a current statement beyond that date. UK Parliament written answer.

UK Home Office guidance describes steps officers may take to recreate a wallet and transfer unhosted cryptoassets to a law-enforcement-controlled wallet. It notes that notebooks containing recovery seeds, hardware wallets, and computers or phones with relevant information may be useful cryptoasset-related items. The cited sources explain that irretrievable private-key loss can make Bitcoin permanently non-transferable, and they document seizures in which authorities obtained keys or relied on a key holder. They do not document a confirmed case of a government permanently losing access to its Bitcoin through irretrievable loss of all key material. Nor do they establish a reliable total for Bitcoin permanently lost by governments, or a complete picture of governments’ present holdings and custody arrangements.
