After a data breach, a company must stop ongoing exposure, preserve evidence, determine what happened and who is at risk, assess every applicable notification law, communicate accurately, and fix the cause. There is no universal deadline: European Union and United Kingdom rules commonly use a 72-hour regulator window when their risk tests are met, while United States duties depend on state, federal, sector and contractual requirements. The facts, the data involved and the company’s legal role determine what it must do.

1. Activate the response team and contain the breach

Start an incident process immediately. Assign an incident lead and bring in the people needed to make decisions: security and IT staff, operations, legal counsel, communications, senior leadership and, when appropriate, privacy, human-resources or facilities personnel. Give one person authority to coordinate technical work and maintain a decision log.

Stop further loss without destroying evidence

Containment depends on the incident. Isolate affected servers, endpoints, cloud workloads or network segments; disable compromised accounts and tokens; block malicious access; and secure physical areas if a device was stolen. If personal information was posted publicly, remove the exposure while preserving a copy and recording where it appeared. The Federal Trade Commission (FTC) advises taking affected equipment offline, but cautions against turning machines off before forensic specialists can assess them because powering down can destroy volatile evidence. Follow the containment plan agreed with forensic responders. See the FTC’s Data Breach Response guide.

Keep operations safe

Do not reconnect isolated systems merely to restore convenience. Use known-clean systems for emergency administration, rotate credentials through a controlled process and preserve business continuity records. If law enforcement is involved, coordinate containment and communications so that a public statement does not compromise an investigation.

2. Preserve evidence and establish what happened

Create a factual record from the first alert onward. Record discovery time, systems and accounts involved, containment actions, people who approved them, outside advisers, and every material decision. Preserve logs, memory captures, disk images, email, physical-access records, cloud audit trails, malware samples and relevant backups under a documented chain of custody. Do not alter or delete files simply because they look suspicious.

Interview witnesses and map the intrusion

Interview the person who found the incident and others who saw unusual messages, access, transfers or device behavior. Record interview dates and distinguish observed facts from assumptions. Determine the initial access method, attacker activity, persistence, lateral movement, data access or exfiltration, and whether the attacker still has a foothold. The UK government’s model action plan similarly calls for isolating systems, disabling compromised accounts, preserving evidence, identifying the source and documenting decisions.

Use independent forensic expertise when needed

An independent forensic investigator can capture and analyze evidence, scope the compromise and recommend remediation. Independence may help when internal staff are implicated, when systems are complex, or when the company may later need to demonstrate that its conclusions were reliable. Counsel should define the investigator’s engagement and coordinate legal, privacy and regulatory advice; technical findings do not by themselves decide whether notice is legally required.

  • What information was accessed, acquired, altered or made unavailable?
  • Was it encrypted, tokenized or otherwise protected, and were the keys exposed?
  • Which systems, records, dates and data subjects are involved?
  • How many people may be affected, in which countries, U.S. states or territories?
  • Does the company have accurate contact details for those people?
  • Was the company acting as a data controller, processor, service provider, covered financial institution or another regulated entity?
  • Could the incident cause identity theft, fraud, financial loss, discrimination, safety harm, reputational damage or other harm?

Keep updating this inventory as evidence improves. An initial estimate can support an urgent notice, but later findings may require supplemental notices, additional jurisdictions or a revised risk assessment.

4. Assess notification duties before choosing whom to notify

Ask counsel to map every potentially applicable rule, contract and regulator. The analysis should cover the affected person’s location, the company’s location, the location where processing occurred, the type of information, the risk threshold, the date the company became aware, and any exception for effective safeguards. A processor may have to notify its controller even when the processor does not notify individuals directly.

There is no single worldwide breach-notification checklist. In the United States, the FTC says every state, the District of Columbia, Puerto Rico and the U.S. Virgin Islands has a notification law for certain personal-information breaches, but definitions, deadlines, notice recipients and exemptions differ. Federal sector rules can add separate obligations. The FTC’s business guide therefore directs companies to examine the specific state and federal requirements rather than rely on a generic timetable.

5. Compare the main notification frameworks

Framework Regulator notice Notice to affected people Key qualifications
EU GDPR When a breach is likely to pose a risk to individuals’ rights and freedoms, the controller notifies the supervisory authority without undue delay and, where feasible, within 72 hours after becoming aware. Generally required without undue delay when the breach is likely to result in a high risk, subject to exceptions such as effective protective measures that make the risk unlikely to materialize. A processor must notify its controller of every personal-data breach. See the European Commission overview.
UK GDPR Notify the Information Commissioner’s Office within 72 hours of awareness when notification is required. The ICO says to submit within the period even if every detail is not yet available. Inform affected people without undue delay when the breach is likely to create a high risk to their rights and freedoms. Record the breach and the organization’s assessment, including decisions not to notify. See ICO personal-data-breach guidance.
United States, general business No single federal deadline covers every incident. State and federal rules must be checked individually. State and sector laws determine whether, when and how individuals must be contacted. All states, D.C., Puerto Rico and the U.S. Virgin Islands have breach-notification legislation, but coverage and timing differ.
FTC Health Breach Notification Rule Covered vendors of personal health records and related entities notify the FTC under the rule. Covered entities notify affected people; media notice may be required when at least 500 residents in a jurisdiction are affected. The FTC describes an outside limit of 60 calendar days after discovery, alongside acting without unreasonable delay. Confirm that the entity and incident are covered. See FTC health-rule guidance.
FTC Safeguards Rule A covered financial institution reports a defined notification event to the FTC as soon as possible and no later than 30 days after discovery. Individual notices may also be required by other laws or rules. Coverage and the definition of a notification event must be assessed for the particular institution and incident. See FTC Safeguards Rule guidance.

6. Meet the earliest applicable deadline and document uncertainty

Use the strictest applicable clock as an operational target, not as permission to wait. Under the EU GDPR and UK GDPR, the relevant 72-hour period starts when the organization becomes aware of a qualifying breach, not when the investigation is complete. The UK ICO says a submission should be made within 72 hours even if some details are still missing; provide the missing information later. A regulator can receive an initial, accurate account followed by updates.

For U.S. incidents, calculate each state or territorial deadline separately and check whether notice must also go to a state attorney general, consumer-protection authority, sector regulator, credit-reporting agencies or law enforcement. Contracts may require a processor or vendor to notify the customer sooner than the law requires. Record the legal basis for every decision, including a conclusion that no regulator or individual notice is required, and schedule a reassessment if facts change.

7. Notify regulators, customers and business partners

Coordinate the sequence with counsel, regulators and law enforcement. A controller may need to notify a supervisory authority while a processor first notifies its controller. A company may also have contractual duties to customers, insurers, payment networks, lenders or other partners. Do not assume that notifying one recipient satisfies another recipient’s rule.

Make the regulator report usable

Include the incident date or estimated period, discovery date, categories and approximate numbers of people and records, data types, likely consequences, containment and mitigation, a contact person and the plan for follow-up. If facts are provisional, label estimates clearly and update the report instead of filling gaps with speculation.

8. Write a clear notice to affected people

The exact required elements vary, but a useful notice answers five questions in plain language:

  1. What happened? Give a concise description, including relevant dates, without exposing attack details that would create additional risk.
  2. What information was involved? Name the categories, such as email addresses, account credentials, financial information or health data. Say when a category was not involved if that clarification prevents confusion.
  3. What could happen next? Explain realistic consequences, such as phishing, account takeover or fraud, without overstating certainty.
  4. What has the company done? Describe containment, investigation, password resets, vulnerability fixes and cooperation with authorities.
  5. What should the recipient do and how can they get help? Provide specific steps, a staffed contact method, and instructions for recognizing legitimate company communications.

UK ICO guidance calls for a plain-language description, a data protection officer or other contact, likely consequences, and response or mitigation measures, with specific advice where possible. FTC guidance similarly recommends explaining what happened, what information was taken, remediation, protective support and relevant contacts. Avoid misleading reassurance, unexplained legal jargon and links that ask recipients to enter credentials. Explain how future updates will be delivered.

9. Provide proportionate help to affected people

Match assistance to the exposed data. Password or token resets, multifactor-authentication enrollment, bank or payment-card monitoring, tax-account protection, medical-identity guidance and fraud-reporting instructions address different risks. The FTC suggests considering at least one year of credit monitoring or other identity support when financial information or Social Security numbers were exposed; that is guidance, not a universal legal requirement. Do not promise a service, duration or reimbursement that the company cannot deliver.

Use a dedicated webpage or telephone channel that does not require the potentially compromised credentials. Train support staff with a fact sheet, escalation path and approved answers. Monitor inbound reports for signs that the breach is being exploited and feed credible new information back into the investigation.

10. Remediate the cause and verify the fix

Turn forensic findings into tracked corrective actions. Patch the exploited software, remove persistence, rotate credentials and keys, close unused accounts, correct access permissions, segment networks, improve logging and test restored systems. If a supplier or processor was involved, require evidence of its corrective work and review contractual controls. Do not declare the incident closed merely because attackers are no longer visible; verify that detection, backup recovery and access controls work under realistic conditions.

Review the response plan

After urgent work, conduct a documented post-incident review with technical, legal, operational and communications participants. Identify which alert was missed, which authority was unclear, which records were unavailable and which decisions took too long. Update contact lists, escalation thresholds, forensic-retention procedures, notification templates, tabletop exercises and staff training. Test the revised plan.

11. Common mistakes that increase risk

  • Shutting down or wiping devices before volatile evidence is captured.
  • Waiting for a perfect forensic report before meeting a statutory deadline.
  • Counting only customers while overlooking employees, applicants, patients, students or other data subjects.
  • Assuming encryption automatically removes every notification duty without checking whether keys or credentials were exposed.
  • Sending one generic notice worldwide even though recipients, deadlines and required content differ.
  • Making absolute claims such as “no data was taken” when the investigation only shows that access has not yet been confirmed.
  • Publishing technical details that help attackers or create a second exposure.
  • Failing to record why a regulator or affected person was not notified.

12. A practical incident timeline

  1. First hours: activate the team, secure people and systems, stop active exfiltration, preserve volatile evidence and open the decision log.
  2. First day: engage forensic and legal advisers, identify affected systems and data, disable compromised access, protect backups and begin a jurisdiction map.
  3. Before the earliest deadline: complete a documented risk assessment, submit required regulator reports with clearly labeled estimates, and prepare accurate individual notices.
  4. Following days and weeks: issue updates, provide protective support, complete eradication and recovery, and monitor for additional affected records.
  5. After recovery: verify remediation, finish the post-incident review, retain required records and test the improved response plan.

The central obligation is disciplined, evidence-based action: contain what is still exposed, learn what actually happened, apply the law that fits each affected person and entity, communicate honestly, and leave the organization more resilient than it was before the incident.
