Yes—an AI-assisted story can be protected by U.S. copyright when a person contributes original expressive authorship. The U.S. Copyright Office’s January 29, 2025 report says AI may assist the creative process without eliminating protection. Copyright does not cover purely AI-generated passages or output controlled only by prompts, however. The decisive question is how much original human expression, selection, arrangement, editing, and other creative control shaped the finished story.

The rule in one sentence

U.S. copyright protects the human-authored expression in an AI-assisted story, not text produced without sufficient human control over its expressive elements. The Copyright Office’s Copyright and Artificial Intelligence, Part 2: Copyrightability report, issued January 29, 2025, distinguishes between AI used as an assistive tool and AI standing in for the author.

That means a manuscript can contain AI-generated material and still qualify for protection as a larger human-authored work. Protection is evaluated component by component and then in relation to the work as a whole. A writer’s original passages, creative revisions, and sufficiently creative choices about what AI material to keep and where to place it may be protected even when some included wording is not.

What part of an AI-assisted story is protected?

Original text you wrote yourself

Text that you independently compose and fix in a tangible form—such as typing it into a document—is the clearest category of human authorship. Copyright attaches when an original work is fixed; registration is a separate process that creates important enforcement advantages.

Your human-authored contribution can include narration, dialogue, scene description, character development, sequencing, and other expressive wording. The work still has to be original: copyright protects your expression, not an underlying idea, premise, historical fact, or generic literary convention.

Creative editing and transformation

Substantial, creative changes to an AI draft can be protected. Examples include rewriting sentences for a distinctive voice, replacing generic scenes with original descriptions, restructuring chapters, changing a character’s motivations, and integrating new human-written passages so the story’s meaning or effect changes.

Mechanical proofreading, correcting spelling, or accepting every suggested sentence without creative judgment may provide little or no independently protectable authorship. The Copyright Office’s standard is fact-specific; there is no published universal word-count, percentage, or edit-count threshold.

Selection, coordination, and arrangement

You may contribute authorship by deciding which generated elements to use, how to combine them, and how to arrange them in the finished story. A creative sequence of scenes, a distinctive pattern of alternating viewpoints, or an original relationship among selected passages can qualify even if individual selected passages remain unprotected.

Selection and arrangement must involve more than routine sorting. The stronger the expressive relationship among the chosen elements—and the more clearly your decisions shape the reader’s experience—the stronger the human-authorship argument.

AI-generated wording with no meaningful human authorship

Purely AI-generated material is outside copyright protection under the Office’s January 2025 analysis. If a passage reaches the manuscript essentially as generated and no human author contributes sufficient expressive control, that passage cannot be claimed as human-authored merely because a person pressed a button, requested a genre, or supplied a topic.

Unprotected material can appear inside a protectable story. The presence of an unprotected paragraph does not automatically eliminate protection for the writer’s original paragraphs or for a human-created arrangement. A registration claim should identify the human-authored portions rather than treating all text as exclusively human-created.

Are prompts enough to claim copyright?

Generally, no. The Copyright Office states that, based on the functioning of current generally available technology, prompts alone do not provide sufficient control over the expressive elements of the output. A detailed prompt can communicate a concept, mood, plot situation, or desired style, but communicating instructions is different from authoring the resulting wording.

This does not make prompts irrelevant. Prompting can be part of a broader creative workflow in which you write surrounding text, select among alternatives, direct revisions, and make expressive changes. The legal question is whether your contribution is perceptible in the final expression and sufficiently creative—not how many words your prompt contains.

How human control is evaluated

The Office describes several ways human authorship may appear in an AI-assisted work. These are not automatic safe harbors; each situation is evaluated case by case.

Human contribution What it can establish What to document
Expression authored before or outside the AI generation Protectable human text that remains perceptible in the final story Drafts, notes, version history, and dated files
Creative selection of generated material Authorship in choosing particular expressive elements from alternatives Candidate outputs, rejected options, and reasons for selection
Creative coordination or arrangement Authorship in the original structure or relationship among components Outlines, chapter plans, scene maps, and structural revisions
Creative modifications Authorship in original rewriting, transformation, or adaptation Before-and-after drafts showing substantive changes
Prompting alone Usually insufficient control over the final expressive wording Prompts may provide workflow context but do not replace human-authorship evidence

Keep the evidence in proportion to the project. A simple dated folder may be enough for a short story; a long novel may benefit from version-controlled drafts, an editorial log, and a record of which passages were generated, retained, rewritten, or removed.

Do you own the copyright if AI wrote part of your novel?

You can claim copyright in the human-authored parts of a novel that includes AI-generated material. You should not describe purely AI-generated passages as exclusively human-created. The scope of your rights therefore may be narrower than ownership of every word in the file.

For example, suppose you write the plot outline, all character biographies, half the scenes, and the final chapter; an AI system supplies draft language for several middle scenes; and you substantially rewrite those scenes to match your voice. Your original writing and sufficiently creative rewrites are candidates for protection. The untouched generated wording may not be protected, while your creative arrangement of scenes may be.

Registration: what to disclose and how to file

The Copyright Office’s March 16, 2023 guidance requires applicants to disclose AI-generated content in a work submitted for registration and to identify the human-authored contribution. A story is a literary work, and the Office’s writer guidance says one published or unpublished story may be registered using the Standard Application.

  1. Identify the work. Assemble the final manuscript and determine whether it is published or unpublished for the application’s purposes.
  2. Separate human and AI contributions. Mark passages generated by an AI system, passages you wrote, and passages you substantially revised or transformed. Use your actual workflow rather than assuming that all final text is human-authored.
  3. Prepare an authorship description. Describe the original text, editing, structure, selection, arrangement, and other expressive contributions you made. State what material was generated by AI and should be excluded or disclaimed from the claim, following the Office’s current application instructions.
  4. Choose the Standard Application. The Office identifies this application for a single published or unpublished story. Supply the requested deposit copy and application information.
  5. Review the certification carefully. Inaccurate authorship information can create problems later. If the work or workflow is unusually complex, obtain advice from a qualified U.S. copyright attorney before filing.

Registration does not create the copyright in the first place; fixation of an original human work does. Registration provides important enforcement benefits, so accurate disclosure matters even when the story already exists as a copyrighted work.

What happens if you omit the AI disclosure?

The Office’s guidance makes disclosure part of the registration process. If an application presents AI-generated material as entirely human-authored, the applicant may need to correct the record or amend the claim. The practical risk is avoidable: identify the AI material and describe the human contribution at filing instead of waiting for a dispute.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not use a blanket statement such as “AI assisted” without explaining what you authored. The Office asks applicants to identify the human-authored contribution, so a useful record distinguishes generated text from your writing, revisions, and creative structure.

Current court position and what may change

In March 2025, the U.S. Court of Appeals for the District of Columbia Circuit affirmed the human-authorship requirement in Thaler v. Perlmutter for a work created wholly by generative AI. That decision supports the distinction between entirely machine-generated output and a work containing human expression.

A petition for Supreme Court review was filed on October 9, 2025, according to the Supreme Court docket. The filing itself does not change the existing rule. Check the docket and later Copyright Office guidance for developments before relying on this article for a new registration or litigation decision.

A practical decision framework for your manuscript

Use these questions to assess the strength and scope of a potential claim:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What did you write? Identify passages and expressive elements authored without AI.
  • What did the system generate? Mark wording that entered the manuscript substantially unchanged.
  • What did you change? Distinguish creative rewriting from mechanical correction.
  • How did you choose and arrange material? Explain why particular outputs were selected and how your structure gives the story its expressive form.
  • Could a reader perceive your contribution? Your authorship should be present in the final text, not only in private intentions or prompts.
  • What will you disclose? Prepare a precise registration description that excludes or disclaims unprotected AI-generated portions.
  • Where and when will you rely on the claim? Publication status, filing facts, and the jurisdiction are relevant. This framework addresses U.S. law, not foreign registration systems.

Preserve drafts and output histories where possible. They cannot guarantee protection, but they make your account of human control clearer if the scope of the claim is questioned.

Common scenarios

Workflow Likely treatment under current U.S. guidance
You ask for a story and publish the response unchanged. The generated wording is unlikely to receive copyright protection because prompting alone generally does not supply sufficient control.
You write a story and use AI for spelling suggestions or brainstorming, then make the final expressive choices. Your original story and human-authored revisions can remain protected; incidental assistance does not by itself remove protection.
You request several scene drafts, select particular passages, and build a distinctive structure around them. Selection and arrangement may be protected when sufficiently creative, although untouched generated wording may remain outside protection.
You substantially rewrite generated scenes in your own voice. Your creative modifications may be protected; the scope depends on the resulting expression and the degree of transformation.
You register the whole manuscript without mentioning AI-generated passages. The application does not follow the Office’s disclosure guidance and should be corrected to identify the human-authored contribution.

Limits of what is known

The Copyright Office has not published a universal percentage of human text, minimum number of edits, word count, or prompt count that guarantees protection. No reliable official statistic establishes how often AI-assisted stories receive registration. Treat any online formula promising a fixed threshold as unsupported.

This article addresses current U.S. guidance and the court record identified above. Other countries may apply different authorship standards, and later decisions may refine the analysis.
