When the rule of law appears to be under pressure, citizens can identify the principle at stake, raise concerns peacefully, seek reliable legal information and pursue available remedies or independent oversight. The right path depends on local law, institutions and personal circumstances; this international overview is not legal advice for a particular country.
Start by identifying what is at stake
The United Nations describes the rule of law as a principle under which everyone—including the state—is accountable to public laws that are equally enforced, independently adjudicated and consistent with international human rights norms. Its elements include equality before the law, accountability, fairness, separation of powers, participation in decision-making, legal certainty, protection against arbitrariness and transparency. Pinpointing the concern can help you choose a useful response. Is the issue unequal treatment, a decision made without a fair process, a lack of transparency, or the absence of an independent way to challenge official action? Describe the specific act or decision and the principle it may affect, rather than relying only on a broad label.
Use peaceful civic channels
Participation in public decision-making and efforts that build civic awareness are consistent with the rule-of-law principle of participation. The UN Special Rapporteur’s recommendations also emphasize dialogue and cooperation. Depending on what is available locally, people can raise concerns in public consultations, communicate with representatives or relevant public bodies, and take part in civic education and community discussion. Peaceful assembly is another way to express views collectively. The UN Human Rights Committee states that it enables people to express themselves collectively and participate in shaping their societies. States should facilitate this right; restrictions must satisfy legal requirements, including necessity in a democratic society. Domestic rules and procedures vary, so international principles alone do not establish whether a particular event requires notice or permission, or whether a specific restriction is lawful. Keep actions peaceful and check local requirements
A 2013 recommendation by the UN Special Rapporteur on Belarus says: “Ensure all protests and assemblies are peaceful. Citizens should not perpetrate violence and need to act within the provisions of the law while carrying out their activities.” This is general guidance in that report, not a substitute for current local legal advice. Check the rules that apply where you are, and consider your circumstances and safety before taking part. UN report A/HRC/22/47/Add.2, paragraph 104(c)

Find legal information, advice and possible aid
Look for reliable information about the relevant local procedure and ask whether legal advice or legal aid is available. The UN describes access to justice as a way for people to exercise their rights, challenge discrimination and hold decision-makers accountable. It also identifies the cost of advice and representation as an obstacle that legal aid can help address. Availability and eligibility depend on the country and the issue. UN: Access to Justice

Consider remedies and independent oversight
Where an available legal process fits the problem, a judicial remedy may provide a way to challenge a decision or seek redress. Depending on the country and the issue, an appropriate national human rights institution may also be able to receive or review concerns. The Human Rights Committee’s guidance on peaceful assembly calls for independent, transparent oversight and timely access to effective remedies in that context. There is no universal ranking of civic action, legal advice, assembly or formal remedies. Consider which option is peaceful and consistent with applicable local law, addresses the specific right or institution involved, and is actually available where you live. Your own circumstances and safety also matter; assessing those risks requires local, current information.
