Sen. Bernie Sanders, Rep. Alexandria Ocasio-Cortez and Sen. Jeff Merkley announced the Ban Flock Act on October 2, 2026. In the sponsors’ summary, it would restrict federal agencies’ use of automatic license plate readers (ALPRs) and access to their data, limit federal grants to state and local governments that use or contract for the systems, and let people sue the federal government over rights violations involving ALPRs. The accessible announcement does not establish the bill’s formal number or legislative status, and its linked bill text was not available for review.

What the Ban Flock Act would do, according to its sponsors

The sponsors describe three federal policy mechanisms. These are summaries in Sen. Sanders’s announcement, not a verified reading of the statutory text.

  • Restrict federal use and access: Federal agencies would be prohibited from using ALPRs or accessing information collected by them.
  • Condition federal grants: Federal grant funding would be barred from going to state or local governments that use ALPRs or contract with ALPR companies.
  • Allow lawsuits: Americans would be able to sue the federal government for rights violations involving ALPR use.

That summary describes federal restrictions and a funding condition; it does not establish a direct, nationwide ban on every state or local camera system. The precise reach, definitions, exceptions and enforcement details cannot be confirmed without the bill text.

Has the bill been formally introduced?

The October 2 announcement links to a bill document, but the linked PDF was not retrievable. The reviewed sources do not establish the Ban Flock Act’s formal bill number, congressional referral or subsequent legislative action. Treat it as a proposal announced by its sponsors, rather than assuming a particular status from the announcement alone. The Flock-Off Act, H.R. 10221, is a separate measure: GovInfo identifies it as introduced on September 2, 2026, and referred to the House Committee on Oversight and Government Reform. Similar names do not make these the same bill.

What ALPRs do—and why the proposal is contested

Automatic license plate readers capture vehicle license plates and can make searches across collected records possible. The sponsors argue that networked cameras can enable pervasive movement tracking and raise risks of misuse. Sanders said in the announcement, “Going to the doctor? Flock knows. Dropping your kid off at school? Flock is tracking you. Flock is always watching.” Merkley argued that privacy includes “the freedom to move around your community without every move being monitored.” These are the sponsors’ advocacy statements, not independent findings about what a particular system knows or tracks.

The debate also includes law-enforcement arguments that ALPRs can help investigations and public safety. Associated Press coverage describes both privacy and misuse concerns and law-enforcement support for the tools; it does not resolve the policy dispute. The sponsors’ announcement also alleges that Flock shared state information with federal immigration officials and that officers used ALPR data to track personal contacts. Those allegations should be understood as claims in the announcement, not independently established here.

Flock’s announced policy changes

In August 2026, AP reported that Flock CEO Garrett Langley announced changes to address accountability concerns. AP reported the company said it would require law-enforcement customers to use an audit tool intended to flag abnormal searches, require a records-management case code before searches, and shorten its standard retention window from 30 days to seven days.

Slip-On Protective Cover Compatible with Flock Security Cameras
  • Tailored Design: The specialized rear-opening design ensures clearance for the camera's mounting bracket, tilt adjustment joint, and external cables, preventing pinching or obstruction
  • Supports Extension Pole Mounting: An integrated bottom socket accommodates standard 1-inch (25.4 mm) mounting poles, broom handles, or extension poles, allowing the unit to be easily slipped over the camera housing from the ground—eliminating the need for ladders or unstable climbing equipment
  • Tool-Free, Non-Permanent Installation: A slip-on design secured by friction and gravity allows for installation or removal in seconds, requiring no adhesives, screws, drilling, or physical modifications to the equipment
  • Durable: Constructed from high-quality materials to ensure longevity and withstand extended use
  • Low-Profile Appearance: Blends seamlessly with surveillance equipment

AP reported an implementation deadline of January 1 for required audit controls. Flock said data tied to a case could be kept longer and that customers could choose which offense categories outside agencies may search. These were company-announced changes, not verified results across every customer deployment; AP also reported civil-liberties criticism that the changes might still leave room for misuse.

  • Which federal agencies, state and local entities, vendors or types of data would be covered under the bill’s definitions.
  • Whether and how the funding condition would apply to particular grants or existing contracts.
  • Whether the bill would require warrants or other case-specific justification, and what retention, sharing, audit or oversight rules it would impose.
  • What conduct would support a lawsuit, who could bring one, and what remedies would be available.

Those specifics should not be inferred from the sponsors’ broad summary. They are also the key points to compare against any other ALPR proposal: covered jurisdictions, limits on camera operation versus data access or funding, justification rules, retention and sharing, oversight, and remedies.
