Automated license plate readers (ALPRs) can record more than a plate number: depending on the system, a reading may include a plate or vehicle image, recognized plate text, vehicle characteristics, and the time and place the vehicle was seen. How long the record is kept and who may search or receive it depend on the agency’s policy and the law that applies. There is no single retention period or access rule established across the examples below.
What information does an ALPR collect?
An ALPR combines cameras with software that identifies license plates in images and converts the results into searchable data. Florida’s statutory definition, for example, describes mobile or fixed high-speed cameras used with algorithms to convert plate images into computer-readable data. The specific fields and images kept depend on the system and the agency’s configuration and policy.
Commonly described records include a plate image or recognized plate text, a date and time, and a location. Some systems also retain a vehicle image or characteristics. Illinois State Police describes its system as collecting an image of the vehicle and an image of the plate, with a date-stamped time and geographic location. Palo Alto lists date, time, location, plate information, vehicle characteristics, and a rear vehicle photo.

That does not mean every system collects the same fields or that every agency uses every available search function.

Does the camera photograph people in the car?
Not necessarily. Illinois State Police says its described ALPR system does not collect driver or passenger images or personally identifiable information. Palo Alto says its fixed cameras are positioned to capture rear plates, not vehicle occupants, and are not used for facial recognition. Those statements describe those agencies’ programs; they are not guarantees about every camera, installation, or ALPR deployment.
To understand a local system, check both the agency’s stated policy and its description of camera placement and retained imagery. A statement about what a particular program collects should not be treated as proof of what all ALPR equipment can capture.
How long is ALPR data kept?
Retention varies by jurisdiction, agency policy, and record type. An ordinary reading may have a routine purge deadline, while a record tied to a criminal investigation or another exception may be kept under different rules. Also distinguish a deadline for searching active data from a deadline for deleting data: they are not necessarily the same.

| Jurisdiction or source | What the rule or policy says | How to interpret it |
|---|---|---|
| Palo Alto city information page, accessed October 7, 2026 | Ordinary ALPR data is automatically purged after 30 days, unless a specific record is identified as relevant to a specific criminal investigation. | This is Palo Alto’s stated routine purge rule, with an investigation exception; it is not a general U.S. retention period. |
| Florida statute | Retention may not exceed the maximum period in the applicable records retention schedule. | The cited statutory provision does not set one universal number of days; the applicable schedule matters. |
| Vermont statute, 23 V.S.A. § 1607, effective July 1, 2025 | Designated personnel may access active data collected within the past seven days. | Seven days is an active-data access window, not necessarily the system’s deletion deadline. The statute also refers to a state storage system containing historical readings and reporting on the age of requested data. |
Palo Alto also states that other law-enforcement agencies may retain data for up to a year or longer. That is the city’s description of other agencies’ practices, not an independently established national statistic. For a particular reading, ask whether it was treated as ordinary data or retained under an investigation or other exception.
Who can look up my plate?
Access rules determine who may search a database and for what purpose; they do not follow automatically from the camera’s ability to collect a reading. Some policies limit access to trained personnel with an authorized law-enforcement need. For example, Palo Alto says properly trained staff with a legitimate law-enforcement need may access its data, and Vermont’s statute limits access to active data to personnel designated by each department.
Florida treats identifying ALPR information as confidential but permits disclosure by or to criminal justice agencies performing official duties. It also allows disclosure to the person whose plate is involved, unless the record is active criminal intelligence or investigative information. These are jurisdiction-specific examples, not a common access rule for every state.

Can another agency search the data?
Sometimes, but the arrangement depends on the agencies, platform, applicable law, and sharing policy. Access might mean a second agency can continuously search a shared system, or it might mean that it can request a particular record for a case. Those arrangements have different privacy and oversight implications.
Virginia’s 2025 survey, reported by the Virginia State Crime Commission in 2026, asked agencies about continuous access and individualized data requests and found both types of practice among responding agencies. Of 361 agencies surveyed, 251 responded (70%); 159 of those 251 respondents (63%) reported using ALPR. These are findings from Virginia’s survey, not estimates of national use or proof of how sharing works in another state.
When asking about external access, find out whether the agency shares a login or database, responds only to case-specific requests, or uses a vendor-hosted platform; whether there are limits on the purpose of a search; and whether outside users’ searches are logged and reviewed.

What oversight limits misuse?
Rules can govern permitted purposes, query records, audits, reporting, and consequences for improper use. Virginia law provides one detailed example of an audit trail: records include the date and time of access, query terms, the stated purpose (including the offense type for a criminal investigation), an associated call-for-service or case number, and the user’s name.
Permitted uses can also be narrowed by agency policy. The Los Angeles County Sheriff’s Department policy updated April 22, 2026, lists public-safety uses such as criminal investigations, locating wanted or missing people, crime analysis, and lifesaving efforts, and says ALPR data may not be used for civil immigration enforcement. That restriction is specific to the LASD policy; it is not a nationwide rule.

A DOJ-hosted policy guide identifies collection, retention, access, sharing, security, accountability, and sanctions as matters a comprehensive ALPR policy should address. The guide is a research report and says its views do not necessarily reflect official U.S. Department of Justice policy. When evaluating a local program, look for written answers on each of those points rather than relying only on a general statement that data is restricted.
How to check the rules for a specific agency
- Identify the operator. Determine which police department or other agency controls the cameras and the database. A camera’s location alone may not identify the agency that controls access or retention.
- Find the written policy and current law. Look for the agency’s ALPR policy, the applicable statute, and the records retention schedule. Check the policy’s revision date and whether the law distinguishes routine readings from investigation-related records.
- Check what is captured and stored. Look for the listed fields, image types, camera orientation, and whether vehicle characteristics or peripheral images are retained. Do not assume that a claim about one system applies to another.
- Ask who may search or receive records. Check which employees are authorized, what purposes qualify, and whether other agencies have continuous access or must make individual requests.
- Look for accountability measures. Find out whether queries record the user, time, search terms, purpose, and case number; how often access is audited; whether the agency reports on use or sharing; and what happens after misuse.
Policies and laws can change, and a public-facing program description is evidence of that agency’s stated practice, not independent verification of every technical capability or user configuration. For a reliable answer about a particular reading, use the current policy and governing records schedule for the agency involved.
