Consent to create or send an intimate image is not automatically consent to share it. Taking, recording, copying, threatening to disclose, and distributing an image can be separate legal questions. The answer depends on where the conduct occurred, the people’s ages and capacity, the image and technology involved, what the accused knew or intended, and any statutory exception. The comparison below covers selected official rules in the United States, United Kingdom, Canada and Australia; it is not a complete statement of any country’s law. For a live case, identify the relevant state, province, territory or devolved jurisdiction and obtain local legal advice.
What does consent cover?
Consent is specific to an act, audience and time. Agreeing to pose, recording yourself, or sending a photograph to one person does not ordinarily authorize that person to post it, forward it, sell it, use it to threaten you, or upload it to an image-generation service. The U.S. Department of Justice puts the point plainly: “Even if you agreed to have your image taken or you took an intimate image of yourself and sent it to someone, it does not mean that you agreed to the images or videos being shared with others.”
Courts and statutes may ask different questions: Did the person agree to the taking or recording? Did they agree to a particular recipient? Did they later withdraw permission? Did the distributor know there was no permission, act recklessly, or honestly and reasonably believe permission existed? A message such as “keep this between us” can be important evidence, but the legal effect depends on the jurisdiction and the facts.

Taking, copying, threatening and sharing are different conduct
Do not treat “non-consensual intimate-image abuse” as one universal offence. A law may prohibit a secret photograph but not every later disclosure under the same section, or it may create a civil claim for disclosure while leaving criminal offences to state or provincial law.

- Taking or recording: capturing a private area, making a hidden video, or recording a video call can require proof that the person expected privacy and did not consent.
- Copying or saving: downloading a disappearing image, taking a screenshot, or duplicating a file may be covered separately, especially where legislation targets temporary-view content.
- Sharing or publishing: sending the file to one friend, posting it publicly, placing it in a group, or uploading it to a service can each satisfy a disclosure element, depending on the law.
- Threatening: a demand such as “pay me or I will post this” may be an offence even if no image is ultimately released. Extortion, harassment or coercive-control laws may also apply.
- Manipulating: a digitally altered or synthetic image can fall within a statute if the definition covers realistic or doctored depictions; that coverage is jurisdiction-specific.
An image can be “intimate” under a law even when it was made in a private setting, and definitions differ over nudity, sexual activity, exposed body parts, sexualized poses, and images that reveal someone’s identity. Privacy expectations, age, capacity and the way the file was obtained all matter.
United States: a federal civil claim and a narrow federal capture offence
Federal civil remedy for qualifying disclosures
Under 15 U.S.C. § 6851, an identifiable person may sue when an intimate visual depiction is disclosed without consent in or affecting interstate or foreign commerce, or through a facility of that commerce. The discloser must know that consent was absent or recklessly disregard that fact. The statute expressly says that agreeing to create an image, or voluntarily showing it to someone, does not by itself establish consent to distribute or disclose it further.
This is a private civil action, not a federal criminal prosecution. A successful plaintiff may seek actual damages or statutory liquidated damages stated in the statute as $150,000, plus costs and reasonable attorney fees; injunctive relief may also be available. A court can protect the plaintiff’s anonymity. The statute contains exceptions, including specified good-faith disclosures, matters of public concern or interest, and disclosures reasonably intended to assist the depicted individual. The commerce requirement and those exceptions mean it is not a universal federal takedown rule and does not replace state law.

The U.S. Department of Justice explains that government agencies do not represent a person bringing this lawsuit and points readers toward legal-aid, victim-support and hotline resources. State and territorial criminal laws may provide a different route, often with their own definitions, intent standards, defenses, deadlines and removal procedures. A lawyer must check the law where the capture or disclosure occurred and where the parties are located.
Federal criminal voyeurism law
18 U.S.C. § 1801 criminalizes specified intentional capture of a person’s private area without consent when the person reasonably expects privacy, but only within the statute’s special maritime and territorial jurisdiction. It is not a general federal ban on every non-consensual photograph in the United States. A state law may be more relevant for a bathroom recording, hidden camera or other conduct on ordinary land.
United Kingdom: sharing and threats, with newer measures requiring a commencement check
Section 66B of the Sexual Offences Act 2003
Section 66B addresses intentional sharing, and threats to share, an intimate photograph or film without consent. The offence structure includes questions about whether the person had a reasonable belief in consent and, for some routes, what purpose or intention accompanied the disclosure. Exact elements and territorial application must be checked against the current legislation for England and Wales or the relevant UK jurisdiction; Scotland and Northern Ireland have their own legal frameworks.

“Sharing” can include sending a file privately, posting it online, showing it to another person, or making it available through a service. A threat can be actionable even before publication. Preserve the wording, account identifiers, dates and links rather than negotiating or forwarding the image.

A GOV.UK factsheet updated 30 September 2026 describes measures concerning taking or recording intimate images, copying temporarily shared images, supplying image-generator tools and platform duties after valid reports. It describes a 48-hour outer limit for relevant platform takedowns under those measures. The factsheet also uses future-facing language about when some measures “become law.” Do not assume that an offence, deadline or platform duty is operative until the enacted text, commencement date and applicable territory have been checked. A platform’s voluntary policy may operate differently from a statutory duty.
Canada: Criminal Code disclosure offence
The official Criminal Code provision identified for this topic covers publishing, distributing, transmitting, selling, making available or advertising an intimate image without the depicted person’s consent, and refers to threats to publish. The precise definition, mental element, available defences, procedure and penalty must be read in the current consolidated provision and applied to the province or territory involved. Do not assume that a rule about disclosure automatically answers whether the original recording, screenshot or account compromise was lawful; other Criminal Code or provincial offences may be relevant.

For a Canadian incident, save the original messages and file metadata, report the account to the service, and ask a local lawyer, police service or victim-support organization which provision and limitation period apply. Avoid reposting the image to prove what happened.
Australia: national principles, not one national offence
The Australian Attorney-General’s Department says its national principles are non-binding. States and territories remain responsible for criminal justice, so the applicable offence is the law of the place connected to the conduct. The principles identify consensually made images later shared without consent, secretly obtained images, threats and doctored images as conduct that legal frameworks may address. They recommend that local laws account for broad forms of sharing, changing technology, consent and threats.
The principles also caution that a criminal framework should not capture conduct that does not warrant criminal sanctions, such as sharing intimate images between consenting adults or the depicted person’s initial taking or sharing of their own image. That policy statement is not a defence in a particular prosecution. Check the current statute, definitions, exceptions and reporting route in the relevant state or territory.

How jurisdictions differ

If an image was shared without your permission
- Address immediate danger. If there is violence, stalking, blackmail, a minor involved, or a threat to meet you, contact emergency services or local police. Use a safer device if the other person monitors your accounts.
- Preserve evidence without redistributing the image. Keep the threatening message, sender details, profile URL, timestamps, email headers and a screenshot showing the page or post. Store copies securely and tell your lawyer or police how they were obtained. Do not forward the intimate file to friends or public groups.
- Use the platform’s reporting process. Report the post or account as non-consensual intimate imagery, request removal and record the report number and response. A platform policy or a statutory deadline may apply, but neither is identical worldwide.
- Secure accounts. Change reused passwords, enable multifactor authentication, review logged-in sessions and cloud-sharing settings, and check whether a compromised email or phone account exposed the file.
- Get local advice. Legal aid, a specialist victim-service organization, a privacy regulator, police or a lawyer can identify the right criminal, civil, family-law or protection-order route. Tell them where the image was taken, where it was posted and where each person is located.
- Protect your privacy while seeking help. Ask whether a report can use a pseudonym or sealed filing. In the United States, § 6851 expressly allows a court to preserve a plaintiff’s anonymity, but other jurisdictions have different rules.
Special cautions involving children and teenagers
Do not download, forward or “collect evidence” by circulating an image of anyone under 18. Child sexual-abuse-image laws can apply even when a young person created the image or sent it voluntarily, and the rules differ by age, jurisdiction and circumstances. Tell police, a child-protection service, a lawyer or a specialist hotline what happened without sending the file unless an official instructs you to do so. A platform’s adult-image reporting form may not be the correct route for a child-safety incident.
Questions to take to a lawyer or investigator
- Where was the camera, sender, recipient and server or platform located?
- What exactly was agreed: making, sending to one person, private viewing, or public posting?
- Was consent withdrawn, or was there deception, coercion, intoxication or incapacity?
- Was the file copied from a disappearing message, obtained by hacking, or altered by software?
- Was there a threat, demand for money, harassment, stalking or workplace or school impact?
- What are the reporting deadlines, limitation periods, removal mechanisms and anonymity options?
Those facts determine whether the best route is a police report, a civil claim, a protection order, a platform complaint, or several routes at once. Keep the original evidence private and let local professionals match it to the current law.
