A health-data breach notice means an organization identified an incident involving health information that may have been improperly used or disclosed. It does not prove that your record was readable, that every listed detail was taken, or that anyone has stolen your identity. Read the notice to learn what information was involved and what the sender recommends, then check the records and bills most relevant to that information.
What does a health data breach mean for me?
The practical meaning depends on the incident, the information involved, and the organization that held it. A notice is a communication about a potential exposure—not a finding that a particular patient has suffered fraud.
For organizations covered by HIPAA, an impermissible use or disclosure of protected health information is generally presumed to be a breach unless the organization establishes a low probability that the information was compromised through a risk assessment. HHS says that assessment considers the type of information and identifiers involved, who received or could access it, whether it was actually acquired or viewed, and what steps were taken to mitigate the harm. Certain good-faith or inadvertent uses and disclosures are exceptions. HHS’s Breach Notification Rule explains the framework.

HHS describes information as unsecured when it has not been made unusable, unreadable, or indecipherable to unauthorized people using specified methods, including encryption or destruction. That does not mean every notice will tell you whether a particular file was encrypted or accessed; check the notice for the sender’s account of the incident.

Can someone steal my identity from my medical records?
Medical identity theft is possible, but exposure does not make it inevitable. HHS’s Office of Inspector General defines it as the appropriation or misuse of a patient’s or provider’s medical identifying information to fraudulently obtain or bill for care. A particular breach notice cannot, on its own, establish that this has happened or predict that it will.
Look for activity that does not match your care: unfamiliar appointments or procedures, claims, bills, or information in your medical records. A discrepancy is a reason to contact the provider or health plan and ask for an explanation; it is not automatically proof of identity theft.

Does HIPAA cover health apps?
Not necessarily. HIPAA covers specified entities, such as covered health-care providers and health plans, and their business associates. Many consumer health apps and services do not fall under HIPAA simply because they collect health information. Some may instead be covered by the FTC’s Health Breach Notification Rule, which applies to certain personal health record vendors, related entities, and service providers. HHS summarizes the distinction in its consumer health information guidance.

The FTC’s 2024 update clarified how its rule applies to health apps and similar technologies and expanded notice information required from covered organizations. It did not make every health app subject to the rule. The FTC explains the update and its scope in its April 2024 announcement and provides an overview of the Health Breach Notification Rule.

Substance-use-disorder treatment records
Records held by certain substance-use-disorder treatment programs may also be governed by 42 CFR Part 2, which has specific confidentiality protections and defined consent exceptions. HHS says programs must report breaches of unsecured Part 2 records and notify affected people, HHS, and, in some cases, the media. Because these protections and procedures are specialized, consult HHS’s current Part 2 information rather than assuming every case follows the same rules as a standard HIPAA notice.
What should I do if my medical information was exposed?
- Read the notice carefully. Identify the organization, incident and discovery dates, types of information involved, and any specific instructions or assistance offered. Notices from organizations covered by the FTC rule may include expanded details, such as information about third parties that acquired data in specified circumstances.
- Focus on the records connected to the exposed information. Review relevant insurance statements, claims, bills, and medical records for services or charges you do not recognize. A notice alone does not prove misuse, but it is a sensible prompt to pay attention to related activity.
- Contact the provider or health plan about anything unfamiliar. Ask what the item represents and how to dispute an error. FTC guidance says patients have a right to copies of records maintained by covered medical providers and health plans; see the FTC’s medical identity theft FAQs for provider and plan guidance.
- Use official identity-theft recovery steps if you find evidence of misuse. The FTC’s model health-breach notice directs affected people to IdentityTheft.gov for response guidance. Paid monitoring is not required to understand a notice or report a suspicious claim.
- Consider a privacy complaint if you suspect a rule was violated. HHS accepts complaints about suspected HIPAA or Part 2 noncompliance. Its complaint instructions call for a written submission identifying the organization and describing the suspected violation. The usual deadline is 180 days from when you knew of the issue, although HHS may extend it for good cause. A complaint is separate from an organization’s duty to report a breach.
Does a breach notice mean the organization has already told the government?
Not necessarily, and the deadlines for reporting to the government are not the same as an individual patient’s notice deadline. Under HIPAA, covered entities must notify affected individuals after discovering a breach of unsecured protected health information. For reporting to the HHS Secretary, breaches affecting 500 or more people must be reported without unreasonable delay and no later than 60 days after discovery. Breaches affecting fewer than 500 people may be reported within 60 days after the end of the calendar year in which they were discovered. HHS lists these reporting rules on its page for submitting breach notices to the Secretary.

HHS’s public portal lists reported breaches affecting 500 or more individuals; its entries change over time and are not a count of every breach or a measure of your personal risk. You can view the HHS breach reporting portal, but your own notice and the records you review are more relevant to determining whether your information may have been misused.
