A GST demand notice is a formal proceeding in which the proper officer asks a company to explain why specified tax, interest or penalty should not be paid or determined. It is not automatically a final order. Your first task is to identify the document’s procedural stage, legal provision, tax period and response date; then reconcile the officer’s figures with your returns and records before replying, paying or appealing.
What a GST demand notice means
Under India’s Central Goods and Services Tax (CGST) framework, a demand proceeding begins when the proper officer communicates an alleged short payment, non-payment, erroneous refund, wrongly availed or utilised input tax credit, or another liability covered by the applicable demand provision. The notice asks the person chargeable under the relevant enactment to show cause. State GST and integrated GST provisions can apply alongside the CGST Act.
The notice should be read as a legal and factual case file, not as a bill generated by a portal. It should identify the GSTIN, tax period, statutory section, allegations, proposed tax, interest and penalty, computation method, evidence relied on, reply date and hearing details. Annexures, data extracts and earlier correspondence may be essential to understanding the case.

A demand notice is different from an adjudication order. Before an order, the company has an opportunity to answer the allegations and place evidence on record. After an order, the liability has been determined at that stage and the company must consider payment, rectification where available, or an appeal. The exact consequences depend on the provision and the document served.

The CGST Act has been amended over time. A newer section 74A framework addresses demands relating to financial year 2024–25 onward, but its mechanics and transition rules must be checked in the current consolidated Act. Do not select a limitation period, penalty rule or response strategy from an old article without matching the tax period and the version of the law in force.
First identify the procedural stage
Companies often call every electronic communication a “GST notice.” That shortcut can cause a missed deadline or an unnecessary payment. Classify the communication before deciding what to do.
| Stage | What it usually does | Company’s immediate task |
|---|---|---|
| Pre-notice intimation | Communicates an amount the officer has ascertained before issuing a show-cause notice, where the rule permits that step. | Check whether a statutory payment or explanation can resolve the issue, while preserving the right to challenge an incorrect calculation. |
| Show-cause notice | Sets out allegations and asks why tax, interest or penalty should not be demanded or determined. | File an evidence-backed, issue-by-issue reply by the date stated in the notice and request a hearing where appropriate. |
| Adjudication order | Records the officer’s determination and the amount payable at that procedural level. | Check reasons, computation, service date and appeal deadline; decide whether to pay, seek an available remedy or appeal. |
| Recovery communication | Moves an amount treated as payable into collection, potentially including action against ledgers, bank accounts or other assets under the applicable rules. | Obtain urgent advice, verify the underlying order and assess payment, pre-deposit, stay and recovery options. |
A portal label alone is not enough. Save the complete PDF or electronic record, every annexure, the date and method of service, and any earlier DRC-01A intimation or correspondence. Confirm that the GSTIN and legal name belong to the company and that the tax period is one for which it filed the returns in question.
What the GST forms tell you
Rule 142 of the CGST Rules provides electronic summaries for relevant notices and orders. These forms help with portal processing, but they do not replace the full notice, annexures or calculation.

| Form | Role in the process | Important qualification |
|---|---|---|
| DRC-01 | Summary associated with a show-cause notice in the situations covered by Rule 142. | Read the underlying notice and attachments; the summary may omit factual detail or transaction-level workings. |
| DRC-01A | Part A may communicate an amount ascertained before notice; Part B can record the person’s response where the rule applies. | Whether this route is available, and what effect a response or payment has, depends on the provision and stage. |
| DRC-02 | Summary of a statement in cases covered by the rule. | Check the statement and supporting material, not just the portal fields. |
| DRC-03 | Used to report a payment. | Payment does not have the same legal effect in every proceeding; confirm treatment of interest, penalty and closure. |
| DRC-04 | Acknowledgement of a payment in the circumstances specified by the rules. | Retain the acknowledgement and bank or electronic-ledger proof. |
| DRC-05 | May record conclusion of proceedings when the qualifying payment is made within the applicable post-notice window. | The qualifying window and waiver or closure effect are provision-specific. |
| DRC-06 | Prescribed representation or reply in the situations covered by Rule 142. | Attach the substantive response and reconciliation; do not rely on a short form-field explanation. |
| DRC-07 | Summary of an order. | Rule 142(6) states that the DRC-07 order summary “shall be treated as the notice for recovery.” Verify service and appeal rights immediately. |
Portal workflows and form versions can change. Confirm the current form, the section invoked and the instructions displayed for the company’s GST registration before filing.
What to do when the notice arrives
1. Preserve and authenticate the communication
- Download the notice, DRC summary, annexures and any order from the GST portal.
- Record the date and method of service, the issuing authority, document reference number, GSTIN, tax period and statutory provision.
- Search the portal and internal records for earlier notices, DRC-01A communications, replies, hearing notices, payments and orders on the same issue.
- Restrict editing of the downloaded files and keep a submission folder with an indexed copy of every exhibit.
Authentication matters because a company may receive several communications with similar subject lines but different legal effects. If the message appears to concern another GSTIN, period or entity, raise that mismatch promptly rather than assuming it is harmless.
2. Calculate the real deadline
Use the response date printed in the notice together with the deadline in the applicable provision and rules. There is no universal “GST notice reply” period. The calculation can depend on whether the document is a pre-notice intimation, show-cause notice, order or recovery communication; the date and mode of communication; extensions; adjournments; and the tax period.

3. Reconcile the proposed amount
Build a transaction- and tax-period-level reconciliation rather than responding to only the total. Compare the officer’s workings with:
- GSTR-1, GSTR-3B and other filed returns;
- tax invoices, credit notes, debit notes and export or supply documentation;
- books of account, sales and purchase registers and general-ledger entries;
- electronic liability, credit and cash ledgers;
- e-way bills or other movement records where relevant;
- payment challans, DRC-03 filings and prior acknowledgements; and
- earlier explanations or data supplied to the department.
Separate principal tax, interest and penalty. Test for duplicate invoices, wrong GSTINs, cancelled documents, reversed credits, amendments reported in a later period, incorrect tax rates, inter-state versus intra-state classification, arithmetic errors and payments that the officer has not credited. A schedule showing the officer’s figure, the company’s figure, the difference and the supporting exhibit is easier to verify than a narrative denial.
4. Prepare an issue-by-issue reply
Use the notice’s paragraph or allegation numbers as headings. For each issue, state the company’s position, the relevant dates and transactions, the legal ground, the amount accepted or disputed, and the exhibit proving it. Explain assumptions in the reconciliation and identify any amount that remains under verification.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteDo not submit only a spreadsheet. Explain why the records answer the allegation and point the officer to the exact invoice, return row, ledger entry or payment reference. If the notice relies on third-party data, ask for the underlying particulars needed to test it and identify any mismatch the company can demonstrate.

- Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft
5. Request a hearing and preserve proof of filing
Where a hearing is appropriate, request it in writing and attend with a person authorised by the company and, where needed, its GST practitioner, chartered accountant or tax lawyer. Section 75(4) contains hearing provisions in specified circumstances, including on a written request; counsel should assess how it applies to the particular notice.
File through the prescribed portal route before the deadline, save the acknowledgement, ARN or reference number, and retain the exact uploaded files. If a technical failure prevents filing, capture time-stamped screenshots and use the official support or alternative filing channel identified by the authority, while continuing to pursue a valid submission.
Should the company reply, pay, or contest?
The right choice depends on the stage, evidence and amount, not on the existence of a DRC form. Payment can be sensible for an undisputed liability or a time-limited statutory settlement, but it can also leave an incorrect calculation unchallenged. Contesting a demand requires a defensible factual record and disciplined deadline management.
| Option | When it may fit | Checks before choosing it |
|---|---|---|
| Reply and contest | The allegation or computation is disputed and the company has records or legal grounds supporting its position. | Completeness of reconciliation, hearing request, deadline, potential interest and penalty, and ability to explain every variance. |
| Pay an admitted amount | The core tax is accepted, or a provision offers a qualifying payment route that may affect interest, penalty or closure. | Correct tax period and head, interest calculation, payment form, timing, acknowledgement and whether payment resolves the proceeding. |
| Part-pay and contest the balance | Some transactions are accepted while others remain disputed. | Allocate payment clearly, state the disputed balance, and confirm that the partial payment does not create an unintended admission. |
| Appeal an order | The officer has issued an adverse determination and the company challenges the findings or amount. | Communication date, statutory pre-deposit, grounds, documents, recovery exposure and any stay or interim relief. |
Do not assume that payment is always an admission, that a reply automatically stops recovery, or that filing an appeal automatically stays recovery. The applicable section, payment timing, order and any separate stay direction control those effects.

If the officer confirms the demand
Read the order as carefully as the notice. Check whether it addresses each defence, gives reasons, identifies the correct tax period and computes tax, interest and penalty consistently. Compare the operative amount with the DRC-07 summary and the electronic liability ledger.
Section 107 generally allows an aggrieved person three months from communication of the decision or order to appeal to the Appellate Authority. A further one month may be allowed on sufficient cause. These are general statutory rules, not permission to wait: calculate the date from the actual communication record, check the current consolidated legislation and appeal rules, and obtain advice on the required pre-deposit and recovery position.
Prepare the appeal file while the notice history is fresh. Include the order, proof of communication, statement of facts, grounds, reconciliation, evidence, payment or pre-deposit proof and authority documents. If recovery is imminent, discuss available stay or interim measures with counsel rather than assuming the appeal itself suspends collection.

Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Historical section 128A relief: do not treat it as an open window
CBIC Circular 238/32/2024-GST describes relief under section 128A for eligible demands under section 73 relating to financial years 2017–18, 2018–19 and 2019–20, subject to statutory conditions. The circular states 31 March 2025 as the notified date by which full payment of the demanded tax was required for the described waiver of interest or penalty, or both.
That date has passed. The scheme should therefore be treated as historical unless a later notification or case-specific rule changes the position. A company should verify the latest official material and its own eligibility before relying on any waiver; the circular does not create a general response to every GST demand.
Common failure points and their fixes
- Replying to the summary only: obtain and answer the full notice, annexures and calculations.
- Using a generic deadline: calculate from the actual document, provision, service record and tax period.
- Arguing only in totals: provide invoice- and return-level schedules that explain every difference.
- Ignoring interest and penalty: reconcile them separately from principal tax and state the legal basis for each dispute.
- Paying without recording allocation: use the correct form and document the tax period, head and intended effect.
- Missing a later order: monitor the portal after filing, attend hearings and preserve every order and acknowledgement.
- Assuming an appeal stops recovery: check pre-deposit, stay requirements and any recovery communication immediately.
When to obtain professional help
A GST practitioner, chartered accountant or tax lawyer should review a material or disputed demand, especially where the notice involves multiple periods, input-tax-credit eligibility, classification, related-party transactions, alleged fraud or suppression, limitation, substantial penalty, or imminent recovery. The adviser needs the complete notice history and reconciliations, not just a screenshot of DRC-01.
CBIC states that its website content is general information and is not a substitute for specific legal or financial advice. This guide likewise explains the process; it cannot determine the company’s limitation defence, hearing entitlement, penalty exposure, eligibility for relief or appeal merits without the documents.
