Waymo vehicles were reported passing stopped school buses in Austin, prompting NHTSA to open a preliminary evaluation and Waymo to report a software hotfix followed by a recall decision. The public record does not establish a regulator-confirmed defect or a single verified incident total. Austin ISD cited 19 incidents in a communication recorded by NHTSA, while Waymo’s recall filing identified 12 related citations and reported no collisions for the behavior it described.
What NHTSA is investigating
NHTSA’s Office of Defects Investigation opened Preliminary Evaluation PE25013 on December 3, 2025. Its information request says the agency is examining “the performance of the Waymo ADS around stopped school buses and the system’s ability to follow traffic safety laws concerning school buses.” The document describes a reported Waymo vehicle approaching a stopped bus from a perpendicular side street, passing near the crossing control arm and students getting off, and then going around the bus. This is the incident account that prompted the agency’s action, not a final finding that Waymo violated the law or that its system has a confirmed defect.
Read NHTSA’s PE25013 information request.
How the incident counts fit together
The figures in the public documents come from different sources and should not be combined into one definitive total.
| Figure | What it represents | Source and qualification |
|---|---|---|
| 19 incidents | Waymo vehicles allegedly passing stopped school buses in Austin | Austin Independent School District cited this number in a communication with Waymo, as recorded in NHTSA correspondence. It is a district-reported count, not a final agency determination. NHTSA correspondence |
| 12 citations | Citations related to the behavior described in Waymo’s recall filing | Waymo identified this number in its Part 573 safety recall report. Waymo recall report 25E084 |
| No related collisions | Collisions associated with the behavior covered by the recall report | Waymo’s filing says none occurred. This is the manufacturer’s statement and is limited to the behavior described in that filing. |
What Waymo says it changed
Waymo’s recall report says the company identified the behavior in October 2025, developed a software change, and deployed a hotfix incrementally to affected vehicles between November 5 and November 17. The filing says Waymo’s Safety Board decided on December 2 to conduct a recall. A recall report documents the company’s identified condition and remedy; it does not by itself establish that every reported event was independently verified by NHTSA.

The available filing does not establish whether every potentially affected vehicle received the remedy, so that question remains for the regulatory review and subsequent records.
Why passing a stopped school bus is a serious safety issue
Red flashing lights and an extended stop arm indicate that children may be boarding, leaving, or crossing around the bus. NHTSA’s general guidance states: “In every state, it is illegal for you to pass a school bus while the stop-arm is extended and the red lights are flashing.” State statutes differ on roadway layouts, divided highways, exceptions, and penalties, so the exact rule must be checked for the relevant jurisdiction.

National context, not a Waymo measurement
NHTSA cites a National Association of State Directors of Pupil Transportation Services 2023 survey estimate of more than 43.5 million illegal school-bus passings in the United States during the 2022–2023 school year. That is a national estimate of driver-reported passings, not an estimate of Waymo events.
What happened in Austin
An NHTSA email dated November 24, 2025 records that Austin ISD had communicated with Waymo, cited 19 documented incidents, and asked the company to cease operations during common student pickup and drop-off times. The correspondence preserves the district’s account; it does not turn the 19 figure into an NHTSA-verified total.

The distinction matters because “19 incidents,” “12 citations,” and “no related collisions” describe different records, scopes, and reporting parties. None should be presented as a complete count of all Waymo school-bus encounters.

Was anyone hurt?
Waymo’s recall filing reports no collisions related to the behavior described in that filing. The documents reviewed here do not report a student injury connected to these events. That does not resolve every safety question: a near miss or illegal pass can create danger even without a collision, and NHTSA’s evaluation is intended to examine the system’s performance and legal compliance.

What is known about an NTSB investigation
A January 25, 2026 Futurism article reported that the NTSB had announced an investigation, citing a statement provided to TechCrunch about Austin incidents, and mentioned reports in Atlanta. The available record for this article does not include an official NTSB notice or establish the investigation’s current status, scope, or findings. Treat that report as secondary coverage rather than as a confirmed NTSB conclusion.
Futurism’s January 25, 2026 report.
What the controversy means for Waymo and regulators
For Waymo
- The company reported a software remedy and a recall decision after identifying the behavior.
- Its filing supplies the 12-citation and no-related-collision figures, with both claims limited to the filing’s scope.
- The incident raises questions about how the automated-driving system detects buses, stop arms, flashing lights, crossing children, and unusual approaches from side streets.
For NHTSA
- PE25013 is a preliminary evaluation, not an adjudication.
- The agency can request information and use the evaluation to determine whether further action is warranted.
- A final conclusion, if issued, would be needed to establish an agency finding about a defect or legal noncompliance.
For school districts and families
Districts should continue reporting suspected violations through local transportation and law-enforcement channels, preserve time and location details when possible, and follow state-specific school-bus rules. NHTSA notes automated stop-arm cameras as one possible way to register and document violations, but no particular provider or program is recommended here.
What remains unanswered
- Whether NHTSA will make a final finding after PE25013.
- How the agency reconciles the Austin ISD account with Waymo’s recall data.
- Whether any additional incidents, citations, injuries, or collisions are documented in later official records.
- The current status and findings, if any, of the NTSB activity described in secondary reporting.
- Whether all vehicles potentially affected by the software condition received the remedy.
Bottom line
The strongest established facts are that NHTSA opened a preliminary evaluation, Austin ISD cited 19 incidents in correspondence, and Waymo reported a November software hotfix plus a December recall decision. Waymo’s filing also reported 12 related citations and no related collisions. Those records justify serious scrutiny of Waymo’s school-bus behavior, but they do not yet support calling the incident count regulator-verified or declaring a final safety finding.
