Virginia’s vape directory could give established manufacturers with federally authorized products a compliance advantage, but the available records do not prove the law was designed to benefit Big Tobacco or that those companies have gained sales. The practical test is product by product: whether a covered vape is certified and listed in Virginia’s directory.

What Virginia’s vape directory requires

Virginia makes certification and inclusion in a state directory a condition of retail sale for covered liquid nicotine and nicotine vapor products. Under the current provisions of Chapter 23.2 of the Code of Virginia, effective October 1, 2026, manufacturers must certify each retail product annually. A product can qualify through an FDA marketing authorization, or through specified legacy-market or pending-application routes.

The statute sets a $5,000 initial certification fee per product and a $2,500 annual recertification fee per product. Those product-level fees and requirements matter to the policy debate: they can make compliance harder for a manufacturer with many products or fewer resources. The rules do not, by themselves, establish which businesses can afford compliance or how the costs affect prices and sales.

Why a vape may still be on sale

The Virginia Attorney General’s directory guidance says manufacturers had until December 31, 2025, to certify products, that enforcement against unauthorized products began April 1, 2026, and that applications for new certification and annual recertification opened October 1, 2026. The page says enforcement against unauthorized products continues. A product’s presence in a shop is not proof that every product in that category is legal: check the specific product against the Attorney General’s directory and the current statute.

The Attorney General’s guidance also means availability can change as products are certified, recertified, or removed. The directory—not a brand name, flavor, or retailer’s assurance—is the relevant state reference for whether a covered product is listed.

Why the rules could favor large tobacco companies

Virginia’s eligibility gate links retail access to federal regulatory status, and the cost and paperwork apply product by product. That structure could favor manufacturers whose products already have the resources and regulatory position needed to qualify. FDA marketing orders make products from JUUL, R.J. Reynolds’ Vuse line, and NJOY relevant examples of companies with authorized products.

But a federal order applies to the products named in it, not automatically to a company’s entire catalog or to every product sold under a brand. The FDA’s marketing-orders page also records denials, including for blu Disposable in 2025 and for products from other firms in earlier years. Authorization must be checked at the product level.

FDA record Products identified in the FDA orders What the record does—and does not—show
Granted, July 2025 JUUL device and Virginia tobacco and menthol JUULpods These named products received marketing orders; the orders do not authorize all JUUL products.
Granted, July 2024 Vuse Alto power unit and tobacco-flavored pods These named products received marketing orders; the orders do not authorize all Vuse products.
Granted, June 2024 NJOY DAILY and ACE menthol products These named products received marketing orders; the orders do not authorize all NJOY products.
Denied, 2025 blu Disposable The FDA page lists a denial for this product; it is not evidence about every blu product.

The case for calling the law a “gift” is therefore a plausible market-structure argument, not a demonstrated outcome. The cited legal and FDA records do not count listed products by ownership, measure Virginia sales before and after implementation, or document sales losses or business closures caused by the directory. Nor do they establish legislative intent to benefit large manufacturers.

What else Virginia changed—and what remains unsettled

A separate measure added retail oversight. In a July 15, 2026 release, the Virginia Attorney General said a law effective July 1 requires convenience stores to obtain permits to sell vape and tobacco products and directs the Virginia ABC Authority to conduct regular inspections, including random underage checks and verification that stores sell approved products. Attorney General Jay Jones said, “If you are pushing a product that is illegal, we are going to step in and we are going to hold you accountable.”

The law’s court history needs care. Virginia’s February 13, 2026 annual directory report said Novo Distro Inc., Tobacco Hut, and Vape Fairfax Inc. sued state officials in October 2025; it reported that a federal district court preliminarily enjoined specified enforcement provisions on December 18, 2025, and that the Attorney General appealed. That report described a related case as pending in the Fourth Circuit at the time. The later Attorney General directory page reports that enforcement began April 1, 2026, but does not explain the litigation. These sources do not establish the injunction’s current scope or the outcome of later proceedings; the court docket is needed for a current legal account.

What the health figures can—and cannot—tell you

Virginia’s Department of Health and RVO Health’s Quit Now Virginia Stakeholder Report 2023, dated January 31, 2025, provides national context, not an evaluation of the directory law. It reports that 7.8% of U.S. high school students and 3.5% of U.S. middle school students reported e-cigarette use in the past 30 days in 2024, about 2.1 million young people. The report also says U.S. high school past-30-day use declined from 11.7% in 2017 to 7.8% in 2024.

The same report estimates that almost 15 million U.S. adults, or 6.0% of the adult population, used e-cigarettes in 2022. Among Quit Now Virginia respondents at seven-month follow-up, current ENDS use was 9% in Standard Care and 14% in the Behavioral Health program. Those figures describe different populations and measures; they do not show whether Virginia’s directory reduces youth access, affects adult cessation, or shifts sales toward larger manufacturers.

How to check a product before buying or selling it

  1. Identify the exact product. Use the product name and relevant variant, rather than relying on the manufacturer or brand alone.
  2. Check the Virginia Attorney General’s Liquid Nicotine & Nicotine Vape Product Directory. Confirm that the covered retail product appears in the directory.
  3. For FDA status, consult the FDA’s Tobacco Products Marketing Orders page. Match the order to the exact product; a company’s other authorized products do not establish this product’s status.
  4. For a legal dispute or enforcement question, consult the current Code of Virginia and relevant court docket. The February 2026 report and later directory guidance do not, on their own, settle the injunction’s present scope.
