To delete a verification photo in Node.js once its retention window closes, schedule a deletion against a stored deadline, remove the file with fs.unlink (or fs.promises.unlink), and then confirm that every other copy the system controls has also been removed. fs.unlink handles only the local path you pass it. It does not overwrite data, and it does not reach derivatives, remote objects, or backups. Those gaps are where most privacy failures happen.
Start with the retention rule, not the code
Privacy law does not give you a fixed number of days for verification photos. Under the GDPR, the retention period depends on the purpose of the processing and on any statutory duties that apply to you as the controller. The Irish Data Protection Commission states that the GDPR “does not stipulate specific retention periods for different types of data, and so organisations must have regard to any statutory obligations imposed on them as a data controller when determining appropriate retention periods” (Irish DPC, How long should personal data be held to meet the obligations imposed by the GDPR?). Any article or internal policy that says “GDPR requires deletion after N days” is overstating the law.
The European Commission’s storage limitation principle is the working test. Personal data should be kept for the shortest time possible, and controllers should set time limits to erase or review what they hold. For a verification photo, that means the retention period should end when the verification purpose is complete, subject to any legal duty to keep a record for longer. Write that period down as a rule your engineers can implement.

Its biometric guidance is under review following UK legislative changes, so check the current version before relying on a UK-specific conclusion.

What fs.unlink actually does
The Node.js documentation for the file system module (v26.5.1 at the time of writing) describes fs.unlink(path, callback) as an operation that “Asynchronously removes a file or symbolic link.” Three properties matter for a privacy workflow:
- It acts on the named local path only. It does not search for copies elsewhere in your system.
- It removes a file or symbolic link. It does not work on a directory, so a deletion job that points at a folder will fail.
- It does not secure-erase the bytes. Describing the call as a secure overwrite, or as proof that the photo cannot be recovered, goes beyond what the API documents.
A minimal deletion step using the promise form looks like this:

}Treating ENOENT as a completed outcome makes the job safe to repeat. Every other error should surface so that the job can be retried or escalated rather than silently marked as done.
Map every copy before you claim deletion
The most common gap is not the call itself but the number of places a photo ends up. Before you say a verification photo has been deleted, trace its full path through the application and compare each location against what fs.unlink can reach.

The EDPB’s cloud guidance places deletion timelines in service agreements and calls for secure disposal of storage media. Those are contractual and operational controls. A line of code cannot provide them.
Build a deletion job that can be retried
Store an explicit retention deadline with each verification record, such as a retain_until timestamp, and run a scheduled or queued task that finds records past their deadline. The schema, queue, and scheduler are design choices for your system. The sources do not prescribe them.

- Find verification records where
retain_untilis in the past and deletion has not been recorded as complete. - Restrict access to the photo immediately, before any deletion runs, so that a delayed job does not leave the image available for ordinary use.
- Delete the local original and each recorded derivative with the function above.
- Issue deletion requests to remote storage and confirm the outcome the provider reports.
- Record the outcome for each location separately, so a partial failure is visible.
- Retry failed items with a limit, then escalate to a person if they still fail.
Each step should be safe to run twice. That is why the ENOENT handling matters. Keep the audit entry minimal, with the record identifier, timestamps, and per-location outcome. Keep it only if your purpose and retention rules justify keeping that entry. Do not write the photo, its bytes, or a reference that exposes the image into the log line.
Where the guidance stops
The sources establish the principles: a documented retention period matched to purpose and legal duties, deletion when that purpose ends, and attention to the cloud and backup copies. They do not give a universal number of days, a particular queue or database design, or a deletion schedule for any named provider. The ICO’s position that transient biometric probes can be deleted after an unsuccessful comparison is an example of minimisation where suitable, not a rule for every verification system. Whether that approach fits your system depends on the jurisdiction, the purpose of the processing, and whether the image is used to identify a person. For a compliance decision, take advice on your specific system.

If you process verification photos in more than one jurisdiction, record the retention period and legal basis for each one, and make the deletion job read them from configuration rather than from a single hard-coded constant.
