Karnataka IT Minister Priyank Kharge says reported U.S. restrictions on several technology companies’ participation in the PERM green-card process could make it harder to relocate Indian engineers to the United States—and encourage multinationals to place more research, engineering and product work in India. That is a forecast, not evidence that jobs or investment have already shifted.
What is PERM, and where does it fit in the green-card process?
PERM, or Permanent Labor Certification, is a U.S. Department of Labor process for an employer seeking to fill a permanent U.S. job with a foreign worker. It is a labor-certification step, not a visa or a green card. In most cases, the employer must obtain a certified labor certification before petitioning U.S. Citizenship and Immigration Services.
The Department of Labor’s test is whether there are sufficient U.S. workers who are able, willing, qualified and available for the job, and whether hiring the foreign worker would adversely affect the wages and working conditions of similarly employed U.S. workers. Which companies are reported to face PERM restrictions?
Moneycontrol reported on October 9, 2026, that the U.S. government had suspended several major technology companies from participating in PERM, attributing the affected-company list to the Department of Labor. The report named Microsoft, Adobe, Cognizant, Infosys, Tata, Wipro, HCL and Capgemini.

The Department of Labor pages available here explain the PERM program and its disclosures, but do not independently confirm the company-specific restrictions, their legal basis, duration or procedural status. The reported action and list should therefore be understood as Moneycontrol’s account, not as a separately verified description of a final or permanent government action. The reporting also does not establish that every role, case or worker associated with those companies is covered.
Does a PERM restriction also stop H-1B work?
No. PERM is the labor-certification stage used in many employment-based green-card cases. H-1B is a temporary nonimmigrant work classification, and its labor-condition application is a different process from PERM. A reported restriction on an employer’s PERM participation does not, by itself, mean that the employer cannot hire foreign workers, that an employee’s existing status has been revoked, or that H-1B work authorization has been suspended.

The developments can be discussed amid broader scrutiny of employment-based immigration, but the programs should not be conflated: the reported PERM action concerns the permanent labor-certification process, not an automatic blanket ban on temporary work authorization.

Kharge’s argument is that if moving Indian engineers to the United States becomes more difficult or expensive, multinationals may choose to move some work instead of the people. He told Moneycontrol: “If relocating Indian engineers to the US becomes more difficult and expensive, global companies could increasingly move high-value technology work to locations where skilled talent is readily available, including India”.

That possibility has two sides. Companies that rely on relocating staff could face added friction in staffing U.S. roles. At the same time, they might consider giving India-based teams more responsibility for research and development, engineering, product development or work within global capability centres (GCCs). Moneycontrol reported that Karnataka accounts for around 40 percent of India’s IT and software exports; the report does not identify the underlying statistical publisher, so that figure is attributable to Moneycontrol.

- Whether the work requires employees to be physically present in the United States or can be performed from India.
- The cost and flexibility of U.S. staffing, including permanent-residency sponsorship.
- Whether an India-based GCC can take on higher-value research, engineering or product mandates.
- How quickly the company can shift roles, teams and operating responsibility.
The available reporting establishes no company-by-company relocation plans, cost estimates or observed job shifts tied to the reported restrictions. Kharge’s proposed movement of work is therefore a potential response, not a confirmed outcome.
What do PERM processing times indicate?
As of October 5, 2026, the Department of Labor’s processing page listed December 2025 priority dates for PERM analyst review and audit review. It reported an average analyst-review processing time of 336 calendar days for August 2026. These are time-sensitive queue measures, not predictions of how long any individual case will take.
