Yes, you may be able to collect unemployment while receiving severance, but the effect depends on the state where you worked and how your former employer pays it. Severance is generally based on an agreement with your employer; unemployment insurance (UI) is a state-administered program with state-specific eligibility rules. Report severance as the claim form directs and ask your state agency how your particular payment arrangement affects your claim.
How severance and unemployment benefits differ
| Question | Severance pay | Unemployment insurance |
|---|---|---|
| Who provides or administers it? | Your former employer, under an agreement or plan. | Your state’s unemployment insurance program. |
| What determines whether you qualify? | The terms of the severance agreement, employment contract, or applicable plan. | State law and program requirements, including the circumstances of separation and other eligibility conditions. |
| When might money arrive? | According to the agreement—for example, as a lump sum or through continuing payments. | After you apply and the state processes the claim, subject to state rules. |
| Can one affect the other? | State rules and the payment arrangement can affect UI eligibility, amount, reporting, or timing. | The agency decides the claim under its state’s rules; there is no single nationwide severance rule. |
| Are payments generally taxable federally? | Yes. | Yes. |
Severance is usually an agreement, not a federal entitlement
The U.S. Department of Labor says the Fair Labor Standards Act does not require severance pay and describes it as a matter of agreement between an employer and an employee or their representative. Review the written offer, contract, or plan to determine what your employer promised and when it will pay. Department of Labor: Severance Pay.
Unemployment is decided under state rules
The Department of Labor describes UI as a federal-state program: states determine eligibility under their laws, and applicants must meet state requirements. A layoff for lack of work may qualify, but the separation alone does not guarantee benefits. You may also need to meet wage or work-history requirements and follow ongoing state rules. Can you get unemployment if you receive severance?
Possibly. Do not assume that receiving severance automatically disqualifies you, or that it has no effect. States may treat severance differently, and the details of the payment—such as a lump sum versus salary continuation—can matter. The relevant state agency must tell you how its current rules apply to your claim.
#1 Best Overall
Ask the agency specifically whether your severance arrangement affects:
- When your claim can begin or when payments may start.
- Your weekly benefit amount.
- How you must report the payment or any continuing employer payments.
- Whether you must take any additional steps while the claim is pending.
Give accurate answers whenever an application or weekly certification asks about income, severance, or employer payments. Do not omit or relabel the money. If the form does not clearly address your arrangement, ask the agency how to report it before submitting the information.

What to do after a layoff
- Read your severance documents. Identify whether payment is a lump sum, periodic salary continuation, or another arrangement. Note the payment dates and any conditions. The agreement—not a general description of severance—sets out what your employer promised.
- Contact the unemployment agency for the state where you worked. Use that state’s current instructions and file promptly. USAGov provides a directory and explains that state agencies handle unemployment benefits: USAGov: Unemployment benefits. Its page was last updated March 28, 2025.
- Explain the exact arrangement when you ask about severance. Tell the agency whether you received a lump sum or ongoing payments, and provide the dates and documents it requests. Ask how the arrangement affects eligibility, benefit calculation, timing, and reporting.
- Follow the state’s claim and ongoing-eligibility instructions. Respond to requests for information and complete any required certifications. Many states require claimants to look for work; check your state agency’s current requirements rather than assuming the rules are the same everywhere.
If you worked remotely or across state lines
The usual starting point is the state where you performed the work. If you worked in more than one state, worked remotely, or now live in a different state, ask an unemployment agency where and how to file. USAGov’s state directory can help you locate the agency, but the agency should confirm the correct filing route for your work history.
How unemployment and severance are taxed
For federal income tax purposes, both unemployment compensation and severance pay are generally taxable. The IRS says unemployment compensation is reportable income, typically reported to you on Form 1099-G. IRS Topic No. 418: Unemployment Compensation. The IRS also identifies severance and unemployment compensation as generally taxable after a job loss: IRS: What if I lose my job?

You can request federal income-tax withholding from unemployment compensation using Form W-4V, or make estimated tax payments if appropriate. Check current IRS guidance and your state’s tax instructions for the tax year that applies. Do not assume that taxes have already been withheld from either payment; check your payment records and tax forms.

The U.S. Department of Labor directs applicants to the state agency responsible for UI claims. Start with the USAGov state unemployment agency directory, then follow that agency’s current claim instructions. State rules can change, and the effect of a particular severance arrangement is not uniform nationwide; a state agency is the appropriate source for a decision on your circumstances.
