In the UK, a home CCTV camera is not automatically unlawful because it records part of a street or a neighbour’s property. But when it captures identifiable people beyond the boundary of your private domestic property—including in a neighbour’s home or garden, a shared space or a public area—UK data-protection law applies. You must operate the system responsibly, minimise unnecessary recording and protect the footage. The rules below describe UK household guidance; requirements differ by country.
When do UK privacy rules apply to home CCTV?
The UK government’s domestic CCTV guidance, updated 21 May 2026, covers CCTV and similar video surveillance, including video-equipped doorbells. It says the UK GDPR and Data Protection Act 2018 apply when your system captures images of people outside the boundary of your private domestic property. The guidance gives neighbours’ homes or gardens, shared spaces and public areas as examples. The Information Commissioner’s Office (ICO) regulates those data-protection laws.
Crossing the boundary brings data-protection responsibilities into scope; it does not, by itself, mean every recording is unlawful. The government guidance puts the emphasis on operating the system responsibly and respecting other people’s privacy. As it states: “A domestic CCTV or video surveillance system needs to be operated in a responsible way that respects the privacy of others.”

Can your camera record a neighbour’s garden or the street?
If you can meet your security need without capturing a neighbour’s property or more of a public area than necessary, adjust the camera to do so. The government recommends considering why CCTV is needed, what the camera needs to view and whether less intrusive measures—such as improved lighting—could meet the need.
Limit the field of view
Position the camera to focus on the area you need to protect. Where the view may include a neighbour’s property, pavement or other area, consider a privacy filter or blocker to obscure that part of the image. A feature described as “privacy zones” may help reduce unnecessary capture, but using one does not by itself establish that your system complies with the law.

Review when and what the camera records
Ask whether continuous recording is necessary or whether the camera can record only at particular times or when needed. Treat audio as a separate privacy issue: the government guidance specifically advises considering whether audio recording is necessary. A camera may need to capture an entrance without also recording conversations or activity in neighbouring spaces.
What should you do if your home camera captures people beyond your boundary?
The UK government guidance places responsibility for the installation and recorded information on the person operating the system. Its practical measures include transparency, limiting use, protecting access and reviewing whether the camera is still needed.

- Explain the recording. The guidance recommends informing neighbours and putting up a notice that recording is taking place. A notice can help people understand what is happening, but it does not make an unnecessarily intrusive camera view acceptable on its own.
- Use footage only for its stated purpose. For example, if the system was installed to protect your property, do not use recordings for unrelated purposes.
- Restrict access and secure recordings. Limit access to people who need it and take care to prevent unauthorised access or disclosure.
- Delete recordings when they are no longer needed. The household guidance does not set a universal retention period. Keep footage only as long as it is needed for the purpose for which it was recorded.
- Check the system periodically. Make sure the date and time are accurate, and review whether the camera is still needed and whether its position continues to limit intrusion.
What if someone asks for footage of themselves?
The UK household guidance says operators should respond appropriately to subject access requests. If someone asks for footage of themselves, consider the request under the data-protection rules that apply to your situation and take care not to disclose other people’s personal information unnecessarily. The household guidance does not set out a universal response deadline in the same detail as the separate business guidance.

Business CCTV in the UK
Business CCTV is a separate case. UK government business guidance says a business must register its details with the ICO and pay a data-protection fee unless exempt. It also says businesses must tell people they may be recorded, usually with clearly visible, readable signs; control access to footage; and use the system only for its intended purpose. The business page says anyone can ask for images of themselves and that footage is usually provided free within one calendar month. These business-specific details should not automatically be applied to every household camera.

Ireland
Ireland’s Data Protection Commission, in domestic CCTV guidance dated 14 January 2021, says a householder whose system captures images or sounds outside the property perimeter—for example, neighbouring homes or gardens, public footpaths or streets—cannot rely on the household exemption. Its guidance identifies lawful basis, transparency and signage, limited retention, security, and handling access or erasure requests as relevant obligations.

Switzerland
Switzerland’s Federal Data Protection and Information Commissioner says private video surveillance of identifiable people is governed by the Federal Act on Data Protection and advises limiting the recording area to the object being protected. The UK, Irish and Swiss guidance illustrates why the country matters; these examples do not establish the rules elsewhere.
